Dear Mr. Miller:
In accordance with the application for a discharge permit received on December 20, 1995, the
Division is forwarding herewith the subject NPDES permit. This permit is issued pursuant to the
requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between
North Carolina and the U.S. Environmental Protection Agency dated December 6, 1983.
A standby power supply requirement has been added to the permit as a special condition. According
to Division of Environmental Management regulations (T15A: 02H .0124 (2)), to insure adequate
continual wastewater treatment, the permitted facility must have dual or standby power onsite.
If any parts, measurement frequencies or sampling requirements contained in this permit are
unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30)
days following receipt of this letter. This request must be in the form of a written petition, conforming to
Chapter 150B of the North Carolina General Statutes, and filed with the Office of Administrative
Hearings, Post Office Drawer 27447, Raleigh, North Carolina 27611-7447. Unless such demand is
made, this decision shall be final and binding.
Please take note that this permit is not transferable. Part H, EA. addresses the requirements to be
followed in case of change in ownership or control of this discharge.
This permit does not affect the legal requirements to obtain other permits which may be required by
the Division of Environmental Management or permits required by the Division of Land Resources or any
other Federal or Local governmental permit that may be required.

in accordance with effluent limitations, monitoring requirements, and other conditions set forth in Parts I,
II, III, and IV hereof.
The permit shall become effective August 1, 1996

1. Continue to operate an existing wastewater treatment facility consisting of influent pump
station, bar screen, a flow splitting device, four extended aeration package treatment plants
having a total capacity of 0.260 MGD (20.1 MGD, 2x0.03 MGD), an aerated sludge holding
tank, tablet chlorinators, and chlorine contact. chamber, a recording flow meter, an effluent
pump station, and eight -inch force main (approximately 7750 feet) located at the Cape Golf
and Racquet Club, 900 Cape Boulevard, Wilmington, New Hanover County (See Part III of
this permit),
2. After receiving an Authorization to Construct, expand wastewater treatment plant s capacity
to 0.350 MGD, and
3. Discharge wastewater from said treatment works at the location specified on the attached
map into the Cape Fear River which is classified Class SC waters in the Cape Fear River
Basin.

Fairways Utilities - The Cape wastewater treatment facility currently treats wastewater
generated by The Cape Golf and Racquet Club. The facility's design capacity is 0.35
MGD, but only treats 0.26 MGD.
Review of 1994-95 DMR data indicates the facility is meeting effluent limits.
A special condition requiring the installation of standby power shall be added to the permit.
In February 1995, Mr. Nathan Sanders (Ocean Forest Lakes) and Mr. Steve Miller
(Fairways Utilities) requested the transfer of Ocean Forest Lakes Development
(NC0059978) to Fairways Utilities/The Cape (NC0057703). In May, 1995, this
name/ownership change was granted. Fairways Utilities/Ocean Forest Lakes development
is only partially constructed. Part of Ocean Forest Lakes' wastewater goes to Fairways
Utilities/The Cape's wastewater treatment facility and the remainder of the Ocean Forest
Lakes development is on septic tank. The current NPDES permit for Fairways
Utilities/Ocean Lakes will be renewed for the following reasons:
1) Ocean Forest Lakes is not completed, there will be a need for additional wastewater
treatment capacity in the future.
2) The part of Ocean Forest Lakes currently served by septic tank may eventually connect
to a sewerage system and their wastewater will need to be treated.
3) New Hanover wastewater collection system may not be able to accept Ocean Lakes
wastewater. (see paragraph below)
New Hanover County has a wastewater collection system, but no wastewater treatment
facility. The county is planning to construct a wastewater treatment facility on a site
adjacent to one of City of Wilmington's two wastewater treatment facilities. Fairways
Utilities facilities are probably too far away to make connecting financially feasible.

meter.

proposed for the future.

PART IV - EVALUATION AND RECOMENDATIONS
The plant has been compliant with permit effluent limits
over the past year according to reports submitted by the
Permittee. The facility is generally in good mechanical
condition.
It is recommended that a draft permit be prepared and placed
at public notice. If no significant adverse public comment is
received, it is recommended NPDES Permit No. NC0057703 be
reissued to the Fairways Utilities in accordance with the
Cape Fear River basin -wide permitting strategy.
