WQC has been delegated the review of major variances for the Environmental Management Commission (EMC). They have a large number of items and limited time for the meeting. I just found out that your request will be on the May meeting agenda. The meeting is 1-3 pm on Wednesday, May 131" here in the Ground Floor Hearing Room of the Archdale building located at 512 N. Salisbury Street in Raleigh. I recommend that you attend in case the committee has any questions for you. Please note that applicants are only allowed to speak if the committee invites to you speak. As I explained during our telephone conversation,the Division is considering not supporting your request for a major variance from the riparian buffer rules based on an evaluation of practical difficulties or unnecessary hardships required by the rule [15A NCAC 02B .0233(9)(i)]. It appears that the hardship was created by piecemealing the development of the project. With that being said, I have provided guidance to you for completing the variance application and presenting the facts of the case as they are relevant to the requirements of the rule. I have never discouraged you from applying for the variance request or denied your right to apply regardless of the Division's finding of fact that is required by the rule. The decision to grant or deny a major variance request lies with the WQC of the EMC. Although Division staff make a recommendation by either supporting or not supporting the request,the committee comes to their own decision and does not always accept staff's recommendation. I have a couple of additional questions that I believe will be helpful for the committee's review of the project that I will email you before the end of the week. A review of aerial photos show that the subject area has been in use as a beach boat launch as far back as 1993. In accordance15A NCAC 02B .0233 (3),(b) "A use shall be considered existing if it was present within the riparian buffer as of July 22, 1997." The subject area pre-dates the Neuse River Riparian Buffer Rules and is therefore exempt. Mr. Hedrick bought his property knowing what was next door to him... he usually complains 2-3 times a year, usually he starts up around this time of year, and has been doing so for the past seven years. That is because Mr. Scheller refused to send my deck permit to Raleigh for review and his Quote was "You will never have decks on these units" after Raleigh send him my permits for the decks he told me he sent them back to Raleigh and would not issue them. Raleigh send back to me and the decks are now in place. 2 This project since day one was designed for the Handi-caped, A V.A. loan has been given for unit#3. 1 have spoke to ADA and they have told me that this is rare and I should pursue this with Millary personal that are Handi-Caped, Which I have done many months ago. Now you can see why am saying I am being decimated against. Hope with you not supporting my projectis because you have regular contact with Mr. Scheller. I put in a $2000,000 plus sewer system to this project that will let all other property owners in the area hook up. I did this so you can drive up get out ofyour car and walk in the front. What Mr. Scheller says below is uncalled for and shows hisdisrespect for the laws he is suppose to up hold, disgrace for DWQ,and for the tax paying citizens., not to mention the Wet Lands Laws which he entrusted to enforce.
