Pitner, Wcjoski, and Hamstead, Enclosed is a request for Nationwide Permit 929 for the Nations Ford Road site on 10.97 acres located east of the intersection of Nations Ford Road and South Tryon Street in Charlotte, NC. The site is a proposed residential development and consists of one stream and one wetland. A Preliminary Jurisdictional Determination for the site was verified in July 2022. Please refer to the Jurisdictional Determination Information for information on onsite surface waters. As shown on the attached exhibits, the proposed project will include permanent impacts to one stream for a road crossing and permanent impacts to one wetland for grading associated with the road crossing. Temporary impacts are limited to construction access to install the proposed impacts. Total permanent impacts proposed include 64 linear feet (0.009 acres) of stream impact (Stream A) and 0.005 AC of wetland impact (Wetland B). Efforts of minimization were implemented during the design to preserve existing site hydrology and limit adverse effects to existing, onsite natural habitat. Retaining walls will be used to minimize impacts. The applicant has demonstrated avoidance and minimization efforts by dedicating avoiding 88% of onsite streams and 71% of onsite wetlands. Due to limited site impacts, no mitigation is proposed. Also enclosed is a copy of our Threatened/Endangered Species Evaluation for the site. Tryon Street - Threatened /Endangered /Protected Species Evaluation SPECIES DESCRIPTIONS: Three plant species with federal protection are listed as potentially occurring on the subject site: Schweinitz's Sunflower (Helianthus schweinitzii), listed as Federally Endangered, is typically found in open habitats which historically have been maintained by wildfires and grazing bison and elk herds. Now most occurrences are limited to roadsides, woodland and field edges, and utility rights -of -way (ROW). Smooth Coneflower (Echinacea laevigata), listed as Federally Endangered, is typically found in open woods, cedar barrens, roadsides, clear cuts, dry limestone bluffs and power line rights -of -way, requiring abundant sunlight and little competition from other plant species. Michaux's Sumac (Rhus michauxii), listed as Federally Endangered, requires habitat of sandy forests and woodland edges. This species requires periodic fire as a part of its ecology. Two animal species with federal protection are listed as potentially occurring on the subject site: Bald Eagle (Haliaeetus leucocephalus), protected by the Bald and Golden Eagle Protection Act, typically inhabits forested areas near large bodies of open water such as lakes, marshes, seacoasts and rivers, where there are suitable fish populations and tall trees for nesting and roosting. Tricolored Bat (Perimyotis subf/avus), proposed Endangered, is often found in caves, abandoned mines, and road culverts during winter. During the spring, summer, and fall, tricolored bats are found in forested habitats where they roost in trees. Tricolored bats face extinction due primarily to the range wide impacts of white -nose syndrome, a deadly disease affecting cave -dwelling bats across the continent. RESULTS: The site is primarily covered by an urban, small commercial business complex with a disturbed wooded stream buffer to the rear of the property adjacent to a railroad corridor. Tree species present in the disturbed wooded stream buffer include Shortleaf Pine (Pinus echinata), Virginia Pine (P. virginiana), Willow Oak (Quercus phellos), White Oak (Quercus alba), Mockernut Hickory (Carya tomentosa), Tulip Poplar (Liriodendron tulipifera), Sweetgum (Liquidambar styraciflua), American Elm (Ulmus americans), Red Maple (Acerrubrum), Green Ash (Fraxinus WEPG401125 7 Wetlands and Environmental Planning Group Leonard S. Vines include Japanese Honeysuckle (Lonicera japonica), Catbrier (Smilax sp.), Trumpet Creeper (Campsis radicans), and Poison Ivy (Toxicodendron radicans). The herbaceous layer is dominated by Japanese Stilt Grass (Microstegium vimineum) and includes Panic Grass (Panicum sp.), Christmas Fern (Po/ystichum acrostichoides), Ground Ivy (G/echoma hederacea), and River Oats (Chasmanthium /atifolium). The semi -disturbed strip buffer behind the urban land between the edges of the parking lots and the wooded area is dominated by common herbs including Broomsedge (Andropogon virginicus), Johnson Grass (Sorghum halepense), Poke Weed (Phyto/acca americans), Nightshade (So/anum sp.), Curly Dock (Rumex crispus), Dogbane (Apocynum cannabinum), Groundsel tree (Baccharis halimifolia), Goldenrod (Solidago sp.), and Sericea Lespedeza (Lespedeza cuneata). Threatened & Endangered/Protected Species Results • All potential habitats for Schweinitz's Sunflower along the roadside, transitional areas and woods edges were examined, and the species was not observed. WEPG concludes Schweinitz's Sunflower (Helianthus schweinitzii) does not occur on the site. • All potential habitats for Smooth Coneflower along the roadside, transitional areas and woods edges were examined, and the species was not observed. WEPG concludes Smooth Coneflower (Echinacea laevigata) does not occur on the site. • All potential habitats for Michaux's Sumac along the roadside, transitional areas and woods edges were examined, and the species was not observed. WEPG concludes Michaux's Sumac (Rhus michauxii) does not occur on the site. • No habitat exists on the site for Bald Eagles. We submit the following comments in accordance with the provisions of the Fish and Wildlife Coordination Act, as amended (16 U.S.C. 661-667e); the National Environmental Policy Act (42 U.S.C. §4321 et seq.); and section 7 of the Endangered Species Act of 1973, as amended (16 U.S.C. 1531-1543) (Act). Project Description According to the information provided, the Applicant proposes to construct a residential development and appurtenances on approximately 11 partially forested acres in Charlotte, North Carolina. Much of the site is composed of existing developments. The information provided suggests that the proposed project will require authorization from the U.S. Army Corps of Engineers for unavoidable impacts to Waters of the United States. Site development plans and/or a description of impacts to Waters of the U.S. or onsite habitats have not been prepared or provided at this time. Federally Listed Plant Species Your correspondence indicates that suitable habitat is present within the action area (50CFR 402.02) for the federally endangered Schweinitz's sunflower (Helianthus schweinitzii), smooth coneflower (Echinacea laevigata), and Michaux's sumac (Rhus michauxii). However, targeted botanical surveys conducted during the appropriate timeframe (September 26, 2022) detected no evidence for these species at that time. Therefore, we believe that the probability for inadvertent loss of these plants is insignificant and discountable and would concur with "may affect, not likely to adversely affect" determinations from the action agency for these species. Botanical survey results are valid for two years for the purposes of consultation under the Act: httDs://www.fws. izov/asheville/bdfs/ODtimal%2OSurvev%2OWindows%20for%201isted%20DIant s%202020.pdf Tricolored bat Based on the information provided, suitable habitat may occur within the action area for the proposed endangered tricolored bat (Perimyotis subflavus). On September 14, 2022, the Service published a proposal in the Federal Register to list the tricolored bat as endangered under the Act. The Service has up to 12 months from the date the proposal published to make a final determination, either to list the tricolored bat under the Act or to withdraw the proposal. The Service determined the bat faces extinction primarily due to the range -wide impacts of White Nose Syndrome (WNS). Because tricolored bat populations have been greatly reduced due to WNS, surviving bat populations are now more vulnerable to other stressors such as human disturbance and habitat loss. Species proposed for listing are not afforded protection under the Act; however, as soon as a listing becomes effective (typically 30 days after publication of the final rule in the Federal Register), the prohibitions against jeopardizing its continued existence and "take" will apply. Although not required at this time, we encourage the Applicant to avoid all necessary project - mediated tree clearing during this animal's active season (April 1 - October 15). This measure would support our concurrence with a "may affect, not likely to adversely affect," determination should this species become listed in the future. Monarch Butterfly Monarch butterfly is a candidate species, and we appreciate the project proponent's consideration of monarch butterfly when evaluating the action area for impacts to federally listed species and their habitats. The species is not subject to section 7 consultation, and an effects determination is not necessary. General recommendations for pollinators can be provided and would be protective of monarch butterfly should the project proponent like to implement them in the future. Your correspondence indicates that suitable habitat is not present within the action area for any other federally protected species. Therefore, we require no further information and consider consultation to be complete at this time. Please be aware that obligations under section 7 of the Act must be reconsidered if. (1) new information reveals impacts of the identified action may affect listed species or critical habitat in a manner not previously considered, (2) the identified action is subsequently modified in a manner that was not considered in this review, or (3) a new species is listed or critical habitat is determined that may be affected by the identified action. We offer the following recommendations on behalf of natural resources: Erosion and Sediment Control Measures to control sediment and erosion should be installed before any ground -disturbing activities occur. Grading and backfilling should be minimized, and existing native vegetation should be retained (if possible) to maintain riparian cover for fish and wildlife. Disturbed areas should be revegetated with native vegetation as soon as the project is completed. Ground disturbance should be limited to what will be stabilized quickly, preferably by the end of the workday. Natural fiber matting (coir) should be used for erosion control as synthetic netting can trap animals and persist in the environment beyond its intended purpose. Impervious Surfaces and Low -Impact Development Increased storm -water runoff also degrades aquatic and riparian habitat, causing stream -bank and stream -channel scouring. Impervious surfaces reduce groundwater recharge, resulting in even lower than expected stream flows during drought periods, which can induce potentially catastrophic effects for fish, mussels, and other aquatic life. Accordingly, we recommend that all new development, regardless of the percentage of impervious surface area they will create, implement storm -water -retention and -treatment measures designed to replicate and maintain the hydrograph at the preconstruction condition to avoid any additional impacts to habitat quality within the watershed. We recommend the use of low -impact -development techniques, such as reduced road widths, grassed swales in place of curb and gutter, rain gardens, and wetland retention areas, for retaining and treating storm -water runoff rather than the more traditional measures, such as large retention ponds, etc. These designs often cost less to install and significantly reduce environmental impacts from development. Where detention ponds are used, storm -water outlets should drain through a vegetated area prior to reaching any natural stream or wetland area. Detention structures should be designed to allow for the slow discharge of storm water, attenuating the potential adverse effects of storm -water surges; thermal spikes; and sediment, nutrient, and chemical discharges. Also, because the purpose of storm -water -control measures is to protect streams and wetlands, no storm -water -control measures or best management practices should be installed within any stream (perennial or intermittent) or wetland. Webb & Associates No. 23-649-207 Dear Ms. Lipsky: BACKGROUND During March 2023, R.S. Webb & Associates (RSWA) conducted a cultural resources literature review for the 4809 South Tryon Street development tract in the Yorkmount area of Charlotte, Mecklenburg County, North Carolina. The project area covers approximately 11 acres located east of the intersection of South Tryon Street and Nations Ford Road in southwestern Mecklenburg County (Figure 1). For this study, a cultural resource is defined as a discrete area of human activity that is at least 50 years old. Cultural resources include, but are not limited to, archeological sites, historic structures, military earthworks, mines/mining features, historic cemeteries, and historic landscape features. The purpose of the current study was to determine if previously recorded cultural resources are located within the project area. METHODOLOGY Through the State Historic Preservation Office's (SHPO) HPOWEB database, information was reviewed regarding National Register of Historic Places (NRHP) properties, Mecklenburg County surveyed -only historic resources, local landmarks, state study -list sites and historic resources determined by the SHPO to be eligible for the NRHP. Historic county maps were examined online through North Carolina Maps, a collaboration of the University of North Carolina, the State Archives of North Carolina, and the Outer Banks History Center. Historic aerial photography and additional historic maps were accessed through Historicaerials.com, Earthexplorer.usgs.gov, Legacy.lib.utexas.edu/maps/ and/or Alabamamaps.ua.edu. Research on recorded archeological sites was performed at the North Carolina Office of State Archaeology (OSA) by Commonwealth Heritage Services, Inc., who then provided RSWA with pertinent information via email regarding archeological sites located within 1.0 mile of the project area. Provided site information includes available site forms, location maps and partial or full reports. Findings - Cultural Resources Literature Review, 4809 South Tryon Street Development Tract Page 2 March 30, 2023 The following primary sources were found to be useful in searching for historic resources within and adjacent to the project area: • 1907 USGS Charlotte, North Carolina -South Carolina 15-Minute quadrangle • 1910 USDA Soil Map of Mecklenburg County • 1911 County Commissioner's Map of Mecklenburg County • 1912 Rural Delivery Map of Mecklenburg County • 1938 and 1969 State Highway and Public Works Commission Map of Mecklenburg County • 1956, 1965, 1968, 1978, and 1983 aerial photographs of Mecklenburg County • 1948/1949-1968 and 1993 USGS Charlotte West, NC -SC 7.5-Minute quadrangle • 1993-2018 Google Earth aerial photography. RESULTS Previous Archeological Investigations: OSA records indicate that at least one cultural resources management project has been performed within 1.0 kilometers (km) of the project area. The previous project (ER 19-5009) involves the removal of a transmission line, that at its closest point, is approximately 550 m northeast of the study tract (Figure 1). This project remains active and no project report was available for review. Previous Architectural Investigations: According to SHPO personnel, the North Carolina HPOWEB database is the definitive source of architectural survey information in North Carolina. HPOWEB contains information from the various architectural surveys conducted in Mecklenburg County but does not identify the boundaries of individual surveys. National Register of Historic Places: There are no NRHP-listed historic properties located within 1.0 km of the current study tract. Mecklenburg County Historic Resources: The HPOWEB database identifies no recorded historic resources within 1.0 km of the study tract. Recorded Archeological Sites: According to the OSA archeological site files, there are no recorded archeological sites located within 1.0 km of the project area. Revolutionary War Actions/Features: There were at least five reported Revolutionary War military engagements in Mecklenburg County. The closest of these was an attack on a British outpost at Polk's Mill on October 9, 1780, approximately four km northeast of the study tract (Lewis 2021). Civil War Actions/Features: Review of the official military atlas for the Civil War (Davis et al. 1983) revealed that no significant Civil War military activity occurred in present-day Mecklenburg County, North Carolina. Union General William T. Sherman, following the capture of Columbia, South Carolina on February 17, 1865, moved north to the vicinity of Lancaster, South Carolina (50 km southeast). The Union armies then turned to the northeast and moved toward Laurel Hill and Fayetteville, North Carolina, thus bypassing the project region (Davis et al. 1983). Historic Cemeteries: The USGS topographic maps reviewed show two mapped cemeteries are within 1.0 km of the project area. These cemeteries include (Figure 1): a cemetery immediately north of Findings - Cultural Resources Literature Review, 4809 South Tryon Street Development Tract Page 3 March 30, 2023 The Church of Pentecost, approximately 415 m south of the project area; and York Memorial Cemetery located approximately 775 m southwest of the study tract. The Southern Railway: The Charlotte & South Carolina Railroad, which later became part of the Southern Railway network, was constructed approximately 800 m east of the project circa 1852 (Figure 1). A review of historic and non -historic maps indicates abandonment of this circa 1852 rail corridor north of the project area at Woodlawn Road. Commercial/industrial rail traffic appears to have been transferred during the middle 1950s to the Southern Railway corridor (east study tract boundary); since this rail corridor is more than 50 years old, it is considered a historic resource. Structures on Historic Maps and Aerial Photographs: Both South Tryon Street and Nations Ford Road are believed to have pre -European contact origins. Maps from the first quarter of the 20' century show Yorkville Road (now known as South Tryon Street), Nations Ford Road, and Yorkmount Road converging at the project area, generally as they are currently aligned. These maps indicate as many as three buildings in the study tract, the more northerly of which was known as "Longs Store". Subsequent maps indicate two dwellings and an outbuilding present in the project area as of 1948. The Southern Railway corridor along the eastern study tract boundary is not present on the 1948 aerials, but is in place by 1968. Middle 20t' century maps suggest mixed commercial and domestic occupation of the project area that changed to exclusively commercial use by 1969. Maps show two large commercial buildings in the project area as of 1980 (Figure 1). Aerial photographs from 1956 suggest that the rail corridor along the east side of the project area was newly established at that time, and there was an ell -shaped commercial building in the center of the study tract flanked north and south by building. These aerial photos also show a narrow area of open, grassed/pastured land near road corridors and woodlands in the east half of the study tract. Aerial photographs taken in 1965 show a much smaller ell -shaped building in the north -central part of the project area and a large commercial building to its northeast, within the study tract. As of 1968, a second large building was present in the south part of the project are and the entire tract had been cleared of vegetation. By 1978, a large parking lot was in place along with a fourth building located in the southwest part of the study tract. CONCLUSIONS There are no NRHP-listed properties, recorded archeological sites, determined -eligible historic properties, state study -list resources, designated local landmarks, or cemeteries are located within the study tract. The closest known cultural resources are the middle 20t' century Southern Railway corridor adjacent to the east project area boundary and the cemetery adjacent to The Church of Pentecost located approximately 415 m south of the study tract. Historic/modern maps and aerial photographs indicate the presence of buildings and associated features within the project area from at least the middle 20t' century into the 2 Pt century.
