The Federal agencies have completed review of the proposal as presented by the application and your field investigation report. We recommend that the following conditions be included in the State -authorization: a.. All work authorized by this permit must be performed in strict compliance with the permit plans. b. Bulkhead and riprap alignments will be in strict accordance with permit plans. To prevent an unintentional violation of this authorization, representatives of the Corps of Engineers and the North Carolina Division of Coastal Management will be available to stake alignments prior to construction. . c. All backfill materials will be obtained from a highground source and confined landward of the permitted bulkhead. d. Riprap and fill material will be clean and free of any pollutants except in trace quantities. Metal products, organic materials, or unsightly debris will not be used. e. No vegetated wetlands will be excavated or filled. f. This permit does not authorize the interference with any existing or proposed Federal project, and the permittee will not be entitled to compensation for damage or injury to the authorized structure or work which may be caused from existing or future operations undertaken by the United States in the public interest. -2- g. No attempt will be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. Use of the permitted activity must not interfere with the public's right to free navigation on all navigable waters of the United States. h. If the display of lights and signals on the authorized structure is not otherwise provided for by law, such lights and signals as may be prescribed by the U.S. Coast Guard will be installed and maintained by and at the expense of the permittee. i. The permittee will maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. j. The activity will be conducted in such a manner as to prevent a significant increase in turbidity outside the area of construction or construction-related discharge. Increases such that the turbidity in the waterbody is 50 NTU's or less are not considered significant. According to said application Cecil Holden & Wilbur Holden proposes to construct a boat ramp, and maintain his existing shoreline erosion control structure by the addition of rip rap -and/or repair of failing sections of the existing bulkhead at the end of S.R. 1119 at Lockwood Folly Inlet. A copy of the entire application and additional information may be examined (or copies furnished upon request and payment of reproduction costs) during normal business hours at the office of Environment, Health and Natural Resources, Division of Coastal Management, and Division of Environmental Management, located at 127 Cardinal Drive Extension, Wilmington, North Carolina 28405, 919/395-3900. The Division of Environmental Management proposes to take final action on this water quality certification on or before June 27, 1993. The issuance of the CAMA Major Development permit and the Section 401 Certification may deviate from this projected date depending upon the nature of the comments submitted and subsequent hearings that may result. All persons desiring to make comments should do so in writing to Roger N. Schecter, Director, Division of Coastal Management, P.O. A review of your application received June 1, 1993, for Department of the Army authorization to place riprap material, reconstruct and backfill a bulkhead and construct a boatramp on the Atlantic Intracoastal Waterway (AIWW), Lockwood Folly Inlet, Brunswick County, North Carolina, indicates it to be a candidate for Federal authorization under this general permit. Comments from Federal review agencies will be furnished to the State. Holden: Reference your application for Department of the Army (DA) authorization to place riprap material, reconstruct and backfill a bulkhead and construct a boatramp on the Atlantic Intracoastal Waterway (AIWW), Lockwood Folly Inlet, Brunswick County, North Carolina. On February 6, 1990, the DA and the U.S. Environmental Protection Agency (EPA) signed a memorandum of agreement (MOA) establishing procedures to determine the type and level of mitigation necessary to comply with the Clean Water Act Section 404(b)(1) Guidelines. This MOA provides for first, avoiding impacts to waters and wetlands through the selection of the least damaging, practical alternative; second, taking appropriate and practical steps to minimize impacts on waters and wetlands; and finally, compensating for any remaining unavoidable impacts to the extent appropriate and practical. To enable us to process your application in full compliance with this MOA, we request that you provide the following additional information: a. Permits for work within wetlands or other special aquatic sites are available only if the proposed work is the least environmentally damaging, practicable alternative. Please furnish information regarding any other alternatives, including upland alternatives, to the work for which you have applied and provide justification that your selected plan is the least damaging to water or wetland areas. b. It is necessary for you to have taken all appropriate and practical steps to minimize wetland losses. Please indicate all that you have done, especially regarding development and modification of plans and proposed construction techniques, to minimize adverse impacts. c. The MOA requires that appropriate and practical mitigation will be required for all unavoidable adverse impacts remaining after all appropriate and practical minimization has been employed. Please indicate your plan to mitigate for the projected, unavoidable loss of waters or wetlands or provide information as to the absence of any such appropriate and practical measures. -2- This information is essential to our expeditious processing of your application and it should be forwarded to us by July 6, 1993. Also, a copy of this information must be sent to the North Carolina Division of Environmental Management to enable them to adequately evaluate your application for a Water Quality Certification pursuant to Section 401 of the Clean Water Act. The Application provides adequate assurance that the discharge of fill material into the waters of Atlantic Intra Coastal Waterway in conjunction with the proposed development in Brunswick County will not result in a violation of applicable Water Quality Standards and discharge guidelines. Therefore, the State of North Carolina certifies that this activity will not violate Sections 301, 302, 303, 306, 307 of PL 92-500 and PL 95-217 if conducted in accordance with the application and conditions hereinafter set forth. Condition(s) of Certification: 1. That the activity be conducted in such a manner as to prevent significant increase in turbidity outside the area of construction or construction related discharge (increases such that the turbidity in the stream is 25 NTU's or less are not considered significant). 2. That all wet concrete poured below MHW be poured at low tide and that the forms be completely dewatered. No wet concrete shall be placed in the surface waters. 3. That the riprap material be of such size so it will not be carried off by wave action and will consist of clean rock or masonry material free of debris or toxic pullutants. Violations of any condition herein set forth shall result in revocation of this Certification. This Certification shall become null and void unless the above conditions are made conditions of the Federal or Coastal Area Management Act Permit If this Certification is unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this Certification. Thisrequest must be in the form of a written petition conforming to Chapter 1508 of the North Carolina General Statutes and filed with the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. Unless such demands are made, this Certification shall be final and binding. t This the 7th day of July, 1993. Wayne Holden Page 2 9. PROTECT DESCRIPTION The project site is located at the end of SR 1119, adjacent to the Atlantic Intracoastal Waterway (AIWW), in Brunswick County. The applicant's family property extends 5775 L.F. east and 1550 L. F. west of SR 1119 along the northern side #of the AIWW. the eastern portion of the property is situated directly behind (north) the Lockwood Folly Inlet. The strong currents generated by the inlet have created severe erosion along this shoreline, and the applicant's family have made attempts to stabilize the shoreline in the past. The existing shoreline erosion control project was originally permitted in 1976 by State Permit #154-76. The original permit included 4,220 L.F. of bulkhead construction, but only 1850 L.F. of bulkhead and rip rap were ever installed. The original permit was modified several times between 1976 and 1986, to include toe protection of the bulkhead with rip rap and the construction of a system of wooden groins waterward of the bulkhead. The eastern end of the property (approx. 450 L.F.) was stabilized using only rip rap. The structure includes a boat ramp on its western end (one of two originally proposed). The ramp is bordered by a breakwater wall on its western side which turns 90 degrees at the terminus of the ramp and continues parallel to the waterway for 28 feet. This parallel section shows severe damage and deterioration as it presently exists. A small area of Smooth Cordgrass (Spartina alterniflora), approximately 336 square feet, is located in this somewhat protected area behind the breakwater walls. The applicant shows the entire area behind the breakwater as previously stabilized with rip rap, however, onsite observations show primarily mud bottom. Whatever rip rap that was originally installed has settled and silted over, or was of insufficient size and has been dispersed by the strong currents in the area. The placement of rip rap to stabilize to toe of the original bulkhead also exhibits this settled and silted over condition. The existing structure also includes a boat slip in the central area of the property. This miniature boat basin was dug out of highground and connected to the water by removing a 10 ft. section of the bulkhead. The boat slip is 60 feet wide and 60 feet long. It is dry at low water. Currently, due to the age of the structure, the bulkhead is beginning to show deterioration. There are two areas between SR 1119 and the boat slip where the bulkhead is failing and erosion landward of the wall is evident. Contributing to the failure of the bulkhead are the strong currents created by the inlet. This is evidenced by the depth of water adjacent to the bulkhead (15 ft. at MLW), where the structure is perpendicular with the direct flow of the inlet opening. Shoreline erosion adjacent to either end of the existing structure is also evident. The highground property adjacent to the bulkhead is relatively flat and open. The inland property is wooded, primarily in pines. The waters adjacent to the project are classified SA by the N. C. Division of Environmental Management, and are OPEN to the harvest of shellfish. The adjacent waters are not designated as primary nursery area. The applicant is proposing the additional placement of material along the existing bulkhead. The toe of the rip rap would extend 12 feet waterward of the bulkhead. Additional material would also be placed along the 450 LF of existing rip rap shoreline on the east side of the project. The applicant proposes to extend the west end of the project by placement of 100 L.F. of rip rap along the shoreline west of the existing boat ramp, and adjacent to the breakwater walls which form the Wayne Holden Page 3 western side of the boat ramp. The 336 square feet of Smooth Cordgrass (Spartina alterniflora) would be left uncovered. In the central area of the project, the applicant is proposing to stabilize the perimeter of the existing boat slip, as well as rebuild the breakwater wall with rip rap. Placement of the rip rap around the boat slip would be at or above MHW, or landward of the existing wingwalls. The breakwater wall exists in two sections,-40 feet long and 10 feet long, with an opening 10 feet wide separating the two secttions. The toe of the rip rap breakwater would also extend 12 feet waterward of the existing bulkhead alignment. A new boat ramp is proposed at the east end of the existing bulkhead. The boat ramp would be concrete, 25 feet wide and 75 feet long. The boat ramp would extend approximately 60 feet below MHW, but only 15 feet waterward of the adjacent bulkhead. In the two areas where the bulkhead is failing and eroding landward of the structure, the applicant is proposing to excavate the highground behind the bulkhead and continue the slope of the rip rap landward, approximately 40-50 feet. The existing bulkhead wall would remain to act as a breakwater. If the applicant observes good results, he may eventually convert the entire structure to this design. 10. ANTICIPATED IMPACTS The proposed project would incorporate an additional 11,100 sq.ft. of shallow bottom by the extension of the rip rap alignment waterward of the bulkhead from the 6 feet, previously permitted to 12 feet. If the rip rap placed below MHW is of insufficient size and weight, it could potentially be moved by strong currents in this area, as evidenced by the current condition of previously installed rip rap. Wayne Holden Page 2 9. PROTECT DESCRIPTION The project site is located at the end of SR 1119, adjacent to the Atlantic Intracoastal Waterway (AIWW), in Brunswick County. The applicant's family property extends 5775 L.F. east and 1550 L. F. west of SR 1119 along the northern side, of the AIWW. The eastern portion of the property is situated directly behind (north) the Lockwood Folly Inlet. The strong currents generated by the inlet have created severe erosion along this shoreline, and the applicant's family have made attempts to stabilize the shoreline in the past. The existing shoreline erosion control project was originally permitted in 1976 by State Permit #154-76. The original permit included 4,220 L.F. of bulkhead construction, but only 1850 L.F. of bulkhead and rip rap were ever installed. The original permit was modified several times between 1976 and 1986, to include toe protection of the bulkhead with rip rap and the construction of a system of wooden groins waterward of the bulkhead. The eastern end of the property (approx. 450 L.F.) was stabilized using only rip rap. The structure includes a boat ramp on its western end (one of two originally proposed). The ramp is bordered by a breakwater wall on its western side which turns 90 degrees at the terminus of the ramp and continues parallel to the waterway for 28 feet. This parallel section shows severe damage and deterioration as it presently exists. A small area of Smooth Cordgrass (Spartina alterniflora), approximately 336 square feet, is located in this somewhat protected area behind the breakwater walls. The applicant shows the entire area behind the breakwater as previously stabilized with rip rap, however, onsite observations show primarily mud bottom. Whatever rip rap that was originally installed has settled and silted over, or was of insufficient size and has been dispersed by the strong currents in the area. The placement of rip rap to stabilize to toe of the original bulkhead also exhibits this settled and silted over condition. The existing structure also includes a boat slip in the central area of the property. This miniature boat basin was dug out of highground and connected to the water by removing a 10 ft. section of the bulkhead. The boat slip is 60 feet wide and 60 feet long. It is dry at low water. Currently, due to the age of the structure, the bulkhead is beginning to show deterioration. There are two areas between SR 1119 and the boat slip where the bulkhead is failing and erosion landward of the wall is evident. Contributing to the failure of the bulkhead are the strong currents created by the inlet. This is evidenced by the depth of water adjacent to the bulkhead (15 ft. at MLW), where the structure is perpendicular with the direct flow of the inlet opening. Shoreline erosion adjacent to either end of the existing structure is also evident. The highground property adjacent to the bulkhead is relatively flat and open. The inland property is wooded, primarily in pines. The waters adjacent to the project are classified SA by the N. C. Division of Environmental Management, and are OPEN to the harvest of shellfish. The adjacent waters are not designated as primary nursery area. The applicant is proposing the additional placement of material along the existing bulkhead. The toe of the rip rap would extend 12 feet waterward of the bulkhead. Additional material would also be placed along the 450 LF of existing rip rap shoreline on the east side of the project. The applicant proposes to extend the west end of the project by placement of 100 L.F. of rip rap along the shoreline west of the existing boat ramp; -rd adjacent to the breakwater walls which form the Wayne Holden Page 3 western side of the boat ramp. The 336 square feet of Smooth Cordgrass (Spartina alterniflora) would be left uncovered. In the central area of the project, the applicant is proposing to stabilize the perimeter of the existing boat slip, as well as rebuild the breakwater wall with rip rap. Placement of the rip rap around the boat slip would be at oz above MHW, or landward of the existing wingwalls. The breakwater wall exists; in two sections, 40 feet long and 10 feet long, with an opening 10 feet wide separating the two sections. The toe of the rip rap breakwater would also extend 12 feet waterward of the existing bulkhead alignment. A new boat ramp is proposed at the east end of the existing bulkhead. The boat ramp would be concrete, 25 feet wide and 75 feet long. The boat ramp would extend approximately 60 feet below MHW, but only 15 feet waterward of the adjacent bulkhead. In the two areas where the bulkhead is failing and eroding landward of the structure, the applicant is proposing to excavate the highground behind the bulkhead and continue the slope of the rip rap landward, approximately 40-50 feet. The existing bulkhead wall would remain to act as a breakwater. If the applicant observes good results, he may eventually convert the entire structure to this design. 10. ANTICIPATED IMPACTS The proposed project would incorporate an additional 11,100 sq.ft. of shallow bottom by the extension of the rip rap alignment waterward of the bulkhead from the 6 feet, previously permitted to 12 feet. If the rip rap placed below MHW is of insufficient size and weight, it could potentially be moved by strong currents in this area, as evidenced by the current condition of previously installed rip rap. It was received on April 29, 1993 , and appears to be adequate for processing at this time. The projected deadline for making a decision is July 13, 1993. An additional 75-day review period is provided by law when such time is necessary to complete the review. If you have not been notified of a final action by the initial deadline stated above, you should consider the review period extended. Under those circumstances, this letter will serve as your notice of an extended review. However, an additional letter will be provided on or about the 75th day. NCGS 113A-119(b) requires that Notice of an application be posted at the location of the proposed development. Enclosed you will find a "Notice of Permit Filing" postcard which must be posted at the property of your proposed development. You should post this notice at a conspicuous point along your property where it can be observed from a public road. Some examples would be: Nailing the notice card to a telephone pole or tree along the road right-of-way fronting your property; or at a point along the road right-of-way where a private road would lead one into your property. Failure to post this notice could result in an incomplete application. A field report has been prepared and is in the process of being circulated to the various state and federal review agencies for their comments.
