The Division of Water Resources(the Division)hereby issues the attached NPDES permit for the subject
facility.This permit is issued pursuant to the requirements of North Carolina General Statute 143-215.1
and the Memorandum of Agreement between North Carolina and the U.S.Environmental Protection
Agency dated October 15,2007,or as subsequently amended.
The changes between this permit and the previous permit include the following:
• In accordance with the NPDES Permitting Strategy for WTP's,facilities discharging greater than
5000 gpd are required to install a continuous recorder to monitor wastewater discharge flows.
As a result, continuous flow monitoring has been added to your permit. The Town will have 18
months from the effective date of this permit to install a continuous flow meter. Until then
instantaneous measurements can be taken with the duration of discharge to be noted in log books
and a total daily discharge reported on the DMR.
• The new permit limit for Total Residual Chlorine(TRC)is 20 gg/L.
• A reasonable potential analysis(RPA)of the facility's Aluminum data indicated a reasonable
potential to exceed the EPA Human Health standard of 8000 gg/L. Please note the permit
requires monthly monitoring of Aluminum with a Monthly Average Limit of 9.6 mg/L. The
Town will have three(3)years from the effective date of this permit to comply with the monthly
average limit(9.6 mg/L)for Aluminum. Review of the Town's WTP facility site plan noted that
the design flow for the decant basin is 0.100 MGD. Considering that the facility has a maximum,
monthly average flow of 0.199 MGD this design flow for the decant basins may not provide
enough settling detection time resulting in higher effluent concentrations for Aluminum.
• Please note that we have included a re-opener clause in the permit for Whole Effluent Toxicity
Monitoring [Section A. (4)]. The Division includes this condition if the permittee has
demonstrated toxicity failures during the past permit cycle.

All previous NPDES Permits issued to this facility,whether for operation or discharge are hereby
revoked,and as of this issuance, any previously issued permit bearing this number is no longer effective.
Therefore,the exclusive authority to operate and discharge from this facility arises under the permit
conditions,requirements,terms, and provisions described herein.
The Town of Yadkinville

1. continue to operate a conventional water treatment plant with discharge of wastewaters from media
filter backwash, sedimentation basins, and an upflow clarification tank,to a circular clarifier for

discharge of 0.199 MGD,with water and wastewater treatment consisting of;

• a clear well [300,000 Gallons]

located at the Yadkinville Water Treatment Plant(WTP), 2820 Hwy 601 South, Yadkinville, Yadkin

2. discharge from said treatment works via Outfall 001 at a location specified on the attached map,
into South Deep Creek [Stream Segment 12-84-2-(5)], currently a Class C waterbody within
Subbasin 03-07-02 of the Yadkin-Pee Dee River Basin.

5. Samples shall be collected concurrently with WET-test samples.
6. Whole Effluent Toxicity(WET)testing-testing of Ceriodaphnia dubia shall be performed as 7-day pass/fail test at 84%
effluent concentration,during January,April,July and October[See A.(2)].
Comments:
Samples shall be taken at the outfall but prior to mixing with the receiving waters.
There shall be no discharge of floating solids or foam in other than trace amounts.

A. (2.) CHRONIC TOXICITY PASS/FAIL MONITORING (QUARTERLY)
The permittee shall conduct Quarterly chronic toxicity tests using test procedures outlined in the"North
Carolina Ceriodaphnia Chronic Effluent Bioassay Procedure,"Revised December 2010,or subsequent
versions.
The effluent concentration defined as treatment two in the procedure document is 84%. The testing shall
be performed as a Ceriodaphnia dubia 7-day pass/fail test. The tests will be performed during the
months.of January,April,July and October. These months signify the first month of each three
month toxicity testing quarter assigned to the facility. Effluent sampling for this testing must be
obtained during representative effluent discharge and shall be performed at the NPDES permitted final
effluent discharge below all treatment processes.
All toxicity testing results required as part of this permit condition will be entered on the Effluent
Discharge Monitoring Form(MR-1)for the month in which it was performed,using the parameter code
TGP3B. Additionally,DWR Form AT-1 (original) is to be sent to the following address:

Completed Aquatic Toxicity Test Forms shall be filed with the Environmental Sciences Section no later
than.30 days after the end of the reporting period for which the report is made.
Test data shall be complete and accurate and include all supporting chemical/physical measurements
performed in association with the toxicity tests, as well as all dose/response data. Total residual chlorine
of the effluent toxicity sample must be measured and reported if chlorine is employed for disinfection of
the waste stream.
Should there be no discharge of flow from the facility during a month in which toxicity monitoring is
required,the permittee will complete the information located at the top of the aquatic toxicity(AT)test
form indicating the facility name,permit number,pipe number, county, and the month/year of the report
with the notation of"No Flow"in the comment area of the form. The report shall be submitted to the
Environmental Sciences Section at the address cited above.
Should the permittee fail to monitor during a month in which toxicity monitoring is required,then
monthly monitoring will begin immediately. Upon submission of a valid test,this monthly test
requirement will revert to quarterly in the months specified above.
Should any test data from this monitoring requirement or tests performed by the North Carolina Division
of Water Resources indicate potential impacts to the receiving stream,this permit may be re-opened and
modified to include alternate monitoring requirements or limits.
If the Permittee monitors any pollutant more frequently than required by this permit,the results of such
monitoring shall be included in the calculation&reporting of the data submitted on the DMR&all AT
Forms submitted.

NOTE: Failure to achieve test conditions as specified in the cited document, such as minimum control
organism survival,minimum control organism reproduction, and appropriate environmental controls,
shall constitute an invalid test and will require immediate follow-up testing to be completed no later
than the last day of the month following the month of the initial monitoring.
A. (3.) ELECTRONIC REPORTING OF DISCHARGE MONITORING REPORTS
Proposed federal regulations require electronic submittal of all discharge monitoring reports (DMRs)
and specify that, if a state does not establish a system to receive such submittals,then permittees must
submit DMRs electronically to the Environmental Protection Agency(EPA). The Division anticipates
that these regulations will be adopted and is beginning implementation in late 2013.
NOTE: This special condition supplements or supersedes the following sections within Part.II of this
permit(Standard Conditions for NPDES Permits):

Beginning no later than 270 days from the effective date of this permit,the permittee shall begin
reporting discharge monitoring data electronically using the NC DWR's Electronic Discharge
Monitoring Report(eDMR)internet application.
Monitoring results obtained during the previous month(s) shall be summarized for each month and
submitted electronically using eDMR. The eDMR system allows permitted facilities to enter
monitoring data and submit DMRs electronically using the internet. Until such time that the state's
eDMR application is compliant with EPA's Cross-Media Electronic Reporting Regulation
(CROMERR),permittees will be required to submit all discharge monitoring data to the state
electronically using eDMR and will be required to complete the eDMR submission by printing,
signing, and submitting one signed original and a copy of the computer printed eDMR to the

If a permittee is unable to use the eDMR system due to a demonstrated hardship or due to the facility
being physically located in an area where less than 10 percent of the households have broadband
access,then a temporary waiver from the NPDES electronic reporting requirements may be granted
and discharge monitoring data may be submitted on paper DMR forms (MR 1, 1.1,2, 3) or
alternative forms approved by the Director. Duplicate signed copies shall be submitted to the
mailing address above.

Requests for temporary waivers from the NPDES electronic reporting requirements must be
submitted in writing to the Division for written approval at least sixty(60) days prior to the date the
facility would be required under this permit to begin using eDMR. Temporary waivers shall be valid
for twelve(12)months and shall thereupon expire. At such time, DMRs shall be submitted
electronically to the Division unless the permittee re-applies for and is granted a new temporary
waiver by the Division.

Regardless of the submission method,the first DMR is due on the last day of the month following
the issuance of the permit or in the case of a new facility, on the last day of the month following the
commencement of discharge.
2. Sianatory Requirements [Supplements Section B. (11.) (b) and supersedes Section B.(11.) (d)1
All eDMRs submitted to the permit issuing authority shall be signed by a person described in Part H,
Section B. (11.)(a) or by a duly authorized representative of that person as described in Part II,
Section B. (11.)(b). A person, and not a position,must be delegated signatory authority for eDMR
reporting purposes.
For eDMR submissions,the person signing and submitting the DMR must obtain an eDMR user
account and login credentials to access the eDMR system. For more information on North
Carolina's eDMR system,registering for eDMR and obtaining an eDMR user account,please visit

Certification. Any person submitting an electronic DMR using the state's eDMR system shall make
the following certification [40 CFR 122.22]. NO OTHER STATEMENTS OF CERTIFICATION

direction or supervision in accordance with a system designed to assure that qualified personnel

am aware that there are significant penalties for submitting false information, including the
possibility of fines and imprisonment for knowing violations."
3. Records Retention [Supplements Section D. (6.)]
The permittee shall retain records of all Discharge Monitoring Reports, including eDMR
submissions. These records or copies shall be maintained for a period of at least 3 years from the
date of the report. This period may be.extended by request of the Director at any time [40 CFR
122.41].

A. (4.) PERMIT RE-OPENER: WHOLE EFFLUENT TOXICITY
Whole Effluent Toxicity monitoring results indicating aquatic toxicity may result in the Division of
Water Resources re-opening this permit or requesting by letter that further action be taken. Additional
metals testing,a toxicity identification evaluation, a toxicity reduction evaluation,and/or an assessment
of discharge treatment alternatives may be requested.

Facility Summary
This facility is a Conventional water treatment plant with discharge of wastewaters from media filter
backwash, sedimentation basins,and an upflow clarification tank,to a circular clarifier for settling,with a
design potable flowrate of 1.67 MGD and a maximum monthly average wastewater discharge of 0.199
MGD. The facility consists of the following water and wastewater treatment units: a 300,000 gallon clear
well,a 0.100 MGD decant basin,decant pump station with dechlorination, sludge drying beds,and effluent
piping.
Toxici —With an IWC>0.25%,this permit requires Chronic Whole Effluent Toxicity(WET)testing
using Ceriodaphnia dubia to be performed as a 7-day pass/fail test at 84% effluent concentration, during
January,April,July and October[TGP3B]. For Conventional WTP's failing toxicity tests a toxicity re-
opener clause was inserted into the draft permit. One toxicity test was reported as"FAIL"within two years
(failed on 10-06-2011 and four(4)toxicity tests since 2010 were reported as"FAIL"(04/07/2010,
07/07/2010, 10/06/2010 and 04/14/2011).
For Renewal—This permit reflects discharge at Outfall 001. DWR updated the facility description and
Map;added parameter codes to Section A.(1.); and added Electronic Reporting-Discharge Monitoring
Reports page. Added Permit Re-Op nerr fojthgjy/Wfluent Toxicity Monitoring[Section A.(4.)]
because of TOX test failure within W years. he Total Residual Chlorine(TRC)limit was updated
from 21µg/L to 20gg/L as a result of using maximum,monthly flow of 0.199 MGD in IWC Calculations
for TRC.

Stream—Discharge from WTP for outfall 001 is into South Deep Creek[Stream Segment 12-84-2-(5)].
The segment is not currently listed as impaired in the 2012 North Carolina Integrated report.
RPA—A Reasonable Potential Analysis(RPA)was conducted on Copper,Zinc,Aluminum, Iron and
Fluoride effluent parameters data because Discharge Monitoring Reports(DMRs)reported concentration
above method-detection levels(MDLs)for the past four and one half(4 1/2)years(July2009-Sept2013).
[See attached RPA summary sheets.]
• Copper showed reasonable potential to violate state water quality standards(WQS). Since Copper
has an action level standard quarterly monitoring will be maintained in conjunction with toxicity
testing.
• Fluoride did not show reasonable potential to violate state WQS; however, since the predicted
maximum effluent concentration was greater than 50%of the allowable concentration quarterly
monitoring was maintained.
• Zinc showed reasonable potential to violate state water quality standards(WQS). Since Zinc has an
action level standard quarterly monitoring will be maintained in conjunction with toxicity testing.
• The RPA on Aluminum effluent data indicated a reasonable potential to exceed the EPA Human
Health standard of 8000 gg/L. The draft permit requires monthly monitoring of Aluminum with a
Monthly Average Limit of 9.6 mg/L.The Town will have three(3)years from the effective date of
this permit to comply with the monthly average limit(9.6 mg/L)for Aluminum. Note: Looking at
sources for the high concentration of Aluminum in the effluent,there were no violations for TSS
noted in the data. The greatest value reported for TSS was 24 mg/L in October 2013. Review of
the Town's WTP facility site plan noted that the design flow for the decant basin is 0.100 MGD.
Considering that the facility has a maximum,monthly average flow of 0.199 MGD this design flow
for the decant basins may not provide enough settling detection time resulting in higher effluent
concentrations for Aluminum.
• Iron showed reasonable potential to violate state water quality standards(WQS). Since Iron has an
action level standard quarterly monitoring will be maintained in conjunction with toxicity testing.
Monthly average FLOW(MGD)—Last 36 months Nov2010-Oct2013:
[Ave 0.067 MGD;Maximum,Monthly average flow=0.199 MGD]
Flow measurement was changed from Instantaneous to Continuous flow in accordance with NPDES
permitting strategies for potable water treatment plants. The maximum,monthly average discharge in the
most recent three year period(November 2010-October 2013)for this facility is 0.199 MGD. Continuous
monitoring is required for facilities discharging greater than 50,000 gpd. The Town will have 18 months
from the effective date of this permit to install a continuous flow meter. Until then instantaneous
measurements can be taken with the duration of discharge to be noted in log books and a total daily
discharge reported on the DMR.

Division personnel have reviewed and approved your application for renewal of the subject permit.
Accordingly, we are forwarding the attached NPDES discharge permit. This permit is issued pursuant
to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement
between North Carolina and the U.S. Environmental Protection Agency dated May 9, 1994 (or as
subsequently amended).
The terms included in this final permit are considerably different from those found in draft permit sent to
you on July 15, 2009. Since that time, this office has reevaluated its guidance for the permitting of
wastewater discharges from conventional water treatment plants. The results of that reevaluation are
included in the permit. While some parameters have been removed from the list of those to be
monitored and others have been added, the overall effect of these changes is believed to impose less of a
regulatory burden to the permittee. We would like to thank you for your assistance and persistence
during the permitting process.
The changes between this final permit and the original draft were described in an October 15, 2009 e-
mail from Bob Sledge of our staff to you. Changes in this final version include:
• The flow limit has been removed.
• Monitoring for Calcium and Magnesium have been eliminated from the permit.
• Monitoring for Turbidity has been reestablished as a term of the permit, but monitoring of the
effluent (as opposed to instrearn monitoring) is now to be performed.
• Monitoring for most constituent parameters has been reduced to quarterly.

• Footnote 3 from the draft permit has been removed. There is no explicit provision within this permit
to have monitoring for particular parameters reduced or removed during the life of the permit based
upon submittal of data from the discharge. Such modification may be requested, but would be
deemed a major modification of the permit and subject to(currently) a$260.00 modification fee.
Otherwise, monitoring frequencies shall remain the same through the full term of the permit. At the
time of the next permit renewal,monitoring parameters, frequencies and limits could be changed
(added, reduced or eliminated)based upon results of sampling during this permit cycle.
If any parts, measurement frequencies or sampling requirements contained in this permit are
unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty

conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of

such demand is made, this decision shall be final and binding.
Please note that this permit is not transferable except after notice to the Division. The Division may
require modification or revocation and reissuance of the permit. This permit does not affect the legal
requirements to obtain other permits which may be required by the Division of Water Quality or permits
required by the Division of Land Resources, the Coastal Area Management Act or any other Federal or
Local governmental permit that may be required.

A."tONI TOXICITY-MONITORING ONLY (QUARTERLY)
The permittee sh 11 conduct quarterly chronic toxicity tests using test procedures outlined in the"North
Carolina Ceriodap 'a Chronic Effluent Bioassay Procedure,"Revised February 1998, or subsequent
versions.
The effluent concentration efined as treatment two in the procedure document is 81 %. The permit
holder shall perform quarte monitoring using this procedure to establish compliance with the permit
condition. The tests will be pe ormed during the months of January,April,July and October.
Effluent sampling for this testin shall be performed at the NPDES permitted final effluent discharge
below all treatment processes.
All toxicity testing results required a part of this permit condition will be entered on the Effluent
Discharge Monitoring Form(MR-1) the month in which it was performed, using the parameter code
QTB5Additionally, DWQ Form AT- (original) is to be sent to the following address:

Completed Aquatic Toxicity Test Forms shall be filed with the Environmental Sciences Section no later
than 30 days after the end of the reporting period for which the report is made.
Test data shall be complete and accurate and include all supporting chemical/physical measurements
performed in association with the toxicity tests, as well as all dose/response data. Total residual chlorine
of the effluent toxicity sample must be measured and reported if chlorine is employed for disinfection of
the waste stream.
Should there be no discharge of flow from the facility during a month in which toxicity monitoring is
required, the permittee will complete the information located at the top of the aquatic toxicity (AT)test
form indicating the facility name,permit number, pipe number,county, and the month/year of the report
with the notation of"No Flow" in the comment area of the form. The report shall be submitted to the
Environmental Sciences Section at the address cited above.
Should the permittee fail to monitor during a month in which toxicity monitoring is required, then
monthly monitoring will begin immediately. Upon submission of a valid test, this monthly test
requirement will revert to quarterly in the months specified above.
Should any test data from this monitoring requirement or tests performed by the North Carolina Division
of Water Quality indicate potential impacts to the receiving stream, this permit may be re-opened and
modified to include alternate monitoring requirements or limits.
NOTE: Failure to achieve test conditions as specified in the cited document, such as minimum control
organism survival, minimum control organism reproduction,and appropriate environmental controls,
shall constitute an invalid test and will require immediate follow-up testing to be completed no later than
the last day of the month following the month of the initial monitoring.

Hi Mr.Walker,
I'm sorry it's taken so long to bring about more movement on the issuance of this permit. There has been a good deal of
reevaluation of our current permitting strategy for WTPs over the past few months. Those who have conducted the
review will soon issue a modified strategy to our staff for development of new permits. Because of the incomplete
status of some of the permit renewals I'm handling, I've been authorized to offer the terms of the modified strategy to
those permittees. While there may be parts of this strategy that some people will remain dissatisfied with, I believe that
overall, it is an improvement from what we were using in the past.
Please be advised that for the combined sake of consistency and management of the workload in this office, I can offer
you essentially the terms you saw in the draft permit,or those noted within this draft version of a modified permitting
strategy for conventional water treatment plant discharges.Changes within the new strategy include:
The new strategy contains no flow limit. However,flow-based monitoring requirements and limits will be determined
through reexamination of flow data already provided.
Monitoring for most constituent parameters will be quarterly.
Turbidity is again included as a monitored parameter(as it is in the current permit).
There is no explicit provision under this strategy to have monitoring for particular parameters reduced or removed
during the life of the permit based upon submittal of data from the discharge. Such modification may be requested, but
would be deemed a major modification of the permit and subject to a$260.00 modification fee. Otherwise, monitoring
frequencies shall remain the same through the full term of the permit. At the time of the next permit renewal,
monitoring parameters,frequencies and limits could be changed (added, reduced or eliminated) based upon results of
sampling during this permit cycle.
A copy of a proposed monitoring and limits page for the permit is attached. Please note for your particular permit that
effluent monitoring for pH has been added. This parameter was left out of the draft permit in error and will be included
in either version you would choose.
It would appear to me that the new strategy option would be the better deal for most WTPs. If you would like to talk

A. (1) EFFLUENT LIMITATIONS AND MONITORING REQUIREMENTS
During the period beginning on the effective date of this permit and lasting until expiration,the
Permittee is authorized to discharge from outfall 001. Such discharges shall be limited and monitored
by the Permittee as specified below:

2. The Division shall consider all effluent TRC values reported below 50µg/L to be in compliance
with the permit. However,the Permittee shall continue to record and submit all values reported by
a North Carolina certified laboratory (including field certified), even if these values fall below 50
ug/L•
•; 3. The pH shall not be less than 6.0 standard units, nor greater than 9.0 standard units.
4. Monitoring should be performed in conjunction with toxicity testing.
5. See Condition A. (2.)for toxicity testing requirements. Toxicity sampling should coincide with
sampling for parameters covered by footnote 4.
All samples collected should be of a representative discharge.
There shall be no discharge of floating solids or visible foam in other than trace amounts.

tasked with shepherding the WTP's wastewater discharge permit toward renewal.
Some new permitting initiatives have been developed for water treatment plant discharges that
require me to ask you a couple of questions.
First, does the Town use zinc orthophosphate as a corrosion inhibitor at the WTP? Second,
does the Town ever use chloramines as a form of disinfection?
