Thank you for your letter of 9 May 2000 concerning an exemption from
DWQ's wetland standards for these temporary mining roads in accordance with
15A NCAC 2B .0232 since the activity is exempt from 404 Permitting under the
Clean Water Act according to Section 404 (f). DWQ agrees that this activity as
outlined in your 9 May 2000 letter and shown on the accompanying map are
exempt from wetland standards. However as stated in your letter, if these roads
become permanent this impact must be considered as part of the 401/404
permitting process.
