Thanks for the communication and discussion. Condition #3 is implied to minimize
downstream impacts.
Condition #3 can be a recommendation.
Since visual monitoring ( #4) is also a requirement it will capture downstream stability
evaluation.

Tim,

I would like to request a modification of the 401 certification issues on April 10, 2015 for Highland Falls. We believe that
condition 3 is inappropriate for this project and should be removed from the certification. Condition 3 requires the
.installation of woody vegetation following the EEP Guidelines for Riparian Buffer Restoration. There are two reasons
for this objection: 1.) The grassed lawn downstream of the project is not owned by the applicant and is not part of our
project. 2.) DWR is requiring mitigation for this project, when none is required. I look forward to speaking
with you when you return from vacation.
