Page 2 9. PROJECT DESCRIPTION: The project site is located at 719 Hughes Road adjacent to the AIWW, in Long Point Estates, Hampstead, Pender County. To access the site from Wilmington, take US Hwy 17 N. Travel approximately 11 miles to Washington Acres Road. Turn right onto Washington Acres Road and travel approximately 1.8 miles to the Atlantic Intracoastal Waterway. The site is located ahead and on the right at 719 Washington Acres Road. The subject property is void of any made -made development with exception of a boat ramp, five slip docking facility and bulkhead, which was permitted under CAMA Major Permit No 77-08, and issued to The Land Company of Fender County, LLC in May 2008. CAMA Major permit 77-08 was modified on April 28, 2010, for expansion of the existing facility to include a total of nine slips (four additional); however, the work was never completed, and the permit expired on August 19, 2014. The applicant is now proposing to re -apply for a new five slip docking facility (creating ten slips total within the basin), perform maintenance dredging around the existing five slip docking facility and perform new dredging around the proposed five slip docking facility. The width of the waterbody in the location of the proposed docking facility is approximately 150'-165' from the edge of marsh on one side to the edge of marsh opposite, allowing a maximum distance of 37'-4l' beyond the nearshore edge of marsh. The canal has a documented history of dredging, as documented in CAMA Major/Dredge and Fill Permit 175-07, which was issued to Mill Creek Waterway Restoration, Inc. According to the permit, the subject channel was dredge at a width of approximately 25', along the centerline. As proposed, the new dredge work associated with the subject application would be located outside of the existing dredge footprint; therefore, it would be considered new dredging. The waters of the AIWW adjacent to the project site are classified as SA-HQW by the North Carolina Division of Water Resources. They area is NOT designated as a Primary Nursery Area P( NA) by the North Carolina Division of Marine Fisheries, and they are CLOSED to the harvest of shellfish. PROPOSED PROJECT: The applicant proposes to expand an existing community docking facility, by adding five (5) additional slips (totaling ten boat slips), and excavate a boat basin within Mill Creek.. As proposed, the total slip count at the subject property would be expanded from five (current) to ten. In addition to construction of a new docking facility, the applicant is proposing to dredge an area around and beneath the proposed slips, as well as perform maintenance dredging around the existing facility and boat ramp. Please refer to Sheet No. 2 of 5 for detailed location of the proposed docking facility and dredge footprint. Page 3 As designed, the docking facility would be access by a new 6' x 110' access pier that would originate along the western shoreline of 719 Washington Acres Road. The pier would extend toward the south, abutting the outer edge of coastal wetlands, just along the open water shoreline. Extending from the access pier, the applicant proposes to install five finger piers (each measuring 4' x 36') that would run perpendicular to the shoreline. Along the outer edge of each finger pier, the applicant proposes to install five (5) boatlifts, each measuring approximate 12' x 12'. Based on the site plan drawings (specifically sheet 2 of 5), it appears the southern most finger piers and boat lifts would be located beyond the t/4 width of waterbody limitation, so I encourage staff to condition anypotential permit to address this discrepancy. According to information presented on the site plan drawing, existing water depths in the vicinity of the proposed dock range from 0' to -3.0' at normal low water (NLW). In addition to the proposed docking facility, the applicant is requesting authorization to perform new dredging within the footprint of the proposed docking facility. As designed, an approximate 125' x 36' boat basin would be dredge to a depth of approximately -4' @ NLW. Concurrent to the proposed new work, a maintenance dredging request is being sought for the area beneath and around the existing facility (8l' x 25' x -4' NLW), and around the existing boat ramp (41' x 34' x -4' NLW). Considering the main channel of Mill Creek, including the side channel which provides access to the subject facility, has been previously dredged under CAMA major permit 175-07, the new proposal does not appear to be inconsistent with current DCM Rules. Spoil material resulting for the proposed dredging operations would be handled via a bucket to barge type operation, and would be disposed of on property located at 719 Hughes Road, which is owned by Long Point Estates HOA, Inc. Based on previous site visits, there does not appear to be any SAV within the project area; however, there are shellfish resources scattered throughout. 10. ANTICIPATED IMPACTS The proposed new docking facility would incorporate approximately 2,100 sq. ft. of Estuarine Waters and Pubic Trust Area. The proposed docking structure would not encroach into the adjacent 15' Riparian Corridor Setback Areas; however, it may extend beyond the'/4 width limitation (approximately 40' beyond the edge of marsh). The proposed dredging would disturb approximately 4,500 sq. ft. of previously undisturbed bottom and approximately 3,419 sq. ft, of previously disturbed bottom. Minor increases in turbidity should be expected; however, no long term impacts are anticipated. The total area of the proposed structures was calculated as follows: Shoreline length = +/-370 ft. x 8 sq. ft. = 2,000 sq. ft. allowable. Proposed: Access Pier = 6' x 110' = 660 sq. ft. Finger Piers = 4' x 36' x 5 = 720 sq. ft. Proposed Total = 720 sq. ft. Existing Total = 432 sq. ft. (existing finger piers — 3 @ 4' x 36'). Project Narrative 4,1.1 Project Location and Existing Conditions This project is located off Hughes Road in Hampstead, Pender County, North Carolina. It is found on Mill Creek where the surface water classification is SA;HQW and considered secondary nursery area. The area is also permanently closed to shell fishing. A survey of the project area water depths, referenced to Mean Low Water NAVD88, was conducted by ESP Associates on April 5, 2022 and represents conditions at that time, There is an existing boat ramp, bulkhead, one floating dock, and three finger piers accommodating five boat slips. The most recent maintenance dredging was permitted in 2019 under CAMA general permit no. 74266 and permitted dredging under the existing finger piers and boat lifts. Both adjacent properties have water and boat access structures. The property to the north has a boat ramp and parking and the property to the south is a single-family home with a fixed pier and floating dock. 4.1.2 Proposed Action Within the Long Point Estates community, all properties have water access excluding 5 homeowners. The applicant proposes 5 additional boat lifts to accommodate the remaining property owners within the community that are lacking water access. A fixed pier measuring 110 by 6 feet will tie into the existing bulkhead and provide access to 5 fixed finger piers that will measure 36 by 4 feet. The lift pilings measure 12.5 by 12.5 feet on center. With the addition of 5 more lift slips, the property will have a total of 10 boat slips. The total dredging footprint is 7,230 square feet and includes the area under both the existing and proposed structures. Both proposed dredging and maintenance dredging are requested to be authorized under this permit, and the total volume of dredge material for the entire footprint is 510 cy. At this time, only 350 cubic yards will be dredged under the proposed structures. Under the existing structures, the remaining 160 cy (110 cy maintenance & 50 cy proposed) will be dredged at a later date. The landowners will use an upland on -site location on the property for the spoil location. See Appendix A for details. The most recent maintenance dredging was permitted in 2019 under CAMA general permit no. 74266. Both adjacent properties have water and boat access structures. The property to the north has a boat ramp and parking and the property to the south is a single-family home with a fixed pier and floating dock. The applicant proposes installing a fixed pier measuring 110 by 6 feet that will tie into the existing bulkhead. Connected to the pier will be five fixed finger piers that will measure 36 by 4 feet and provide access to the 5 proposed boat lift slips. The lift pilings measure 12 by 12 feet on center and will be designated for use by the Long Point Estates HOA. With the addition of 5 more lift slips, the property will have a total of 10 boat slips. The total maintenance dredging footprint is 7,250 square feet and includes the area under both the existing and proposed structures.
