I am responding to your email of March 7 requesting more information regarding the application for Shoreline 
Stabilization that was submitted on January 6, 2023. I have attached the following for your review: 

 Plot Plan from 2003 showing the location of Lot #248 within the development. 
 Site Plan illustrating the path that the Skid Steer path to the water. There is plenty of room between the trees to 
bring the stone to the shoreline. 
 No trees within the 50‐foot boundary will be removed while accessing the shoreline with stone. 
 There are three trees along the bank that have rootballs exposed on the waterside. Can these be removed as 
they are unstable and may fall? 
 Picture of Skid Steer path 
 Picture of debris that was dumped on my lot prior to purchase that will be removed. 
The stone will be placed to prevent further erosion and will mirror what’s in place on adjacent lots. The goal is to 
prevent further damage to the shoreline which is eroding. Please let me know what further information you need from

Hello Mr. Bailey, 

On January 9, 2023, the Division of Water Resources (Division) received your application requesting a 401 Water Quality 
Certification and Buffer Authorization from the Division for the subject project. The Division has determined that your 
application is incomplete and cannot be processed. The application is on‐hold until all of the following information is 
received: 

1. The application indicates that work will be done from land. Please clarify whether an access corridor resulting in 
the removal of trees within the 50‐foot buffer will be required for the project. [15A NCAC 02H .0502(a)(4); 15A 
NCAC 02B .0611(b)(1)(D)] 

2. The application did not include a detailed site plan showing property boundaries, proposed locations of 
vegetation clearing, proposed and existing structures, riprap, excavation or dredging below the Full Pond Level, 
and construction access corridors. Please submit a plan including this information so that impacts to water 
quality and the Catawba Buffer can be evaluated. An example plan is provided in the Instructions for Lake 
Shoreline Stabilization Application document:

Pursuant to Title 15A NCAC 02H .0502(c) and Title 15A NCAC 02B .0611(3), the applicant shall furnish all of the above 
requested information for the proper consideration of the application.  Please respond in writing within 30 calendar 
days. If all of the requested information is not received within 30 calendar days of receipt of this letter, the Division will 
be unable to approve the application and it will be denied as incomplete.  The denial of this project will necessitate 
reapplication to the Division for approval, including a complete application package and the appropriate fee. Please be 
aware that you have no authorization under the Section 401 of the Clean Water Act for this activity and any work done 
within waters of the state may be a violation of North Carolina General Statutes and Administrative Code.
