Staff review of the plans'and specifications has determined that the project, as proposed, will comply with the Stormwater Regulations set forth in Title 15A NC.AC 2H.1000. We are forwarding Permit No. SW8 980817 Modification dated September 8, 1999, for the construction of Gateway Plaza. This permit shall be effective from the date of issuance until September 8, 2009, and shall be subject to the conditions and limitations as specified therein. Please pay special attention to the Operation and Maintenance requirements in this permit. Failure to establish an adequate system for operation and maintenance of the stormwater management system will result in future compliance problems. If any parts, requirements, or limitations contained in this permit are unacceptable, you have the right to request an adjudicatory hearing upon written request within thirty (30) days following receipt of this permit. This request must be in the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of Administrative Hearings, P.O. Drawer 27447, Raleigh, NC 27611-7447. Unless such demands are made this permit shall be final and binding. SCHEDULE OF COMPLIANCE 1. The stormwater management system shall be constructed in it's entirety, vegetated and operational for its intended use prior to the construction of any built -upon surface except roads. 2. During construction, erosion shall be kept to a minimum and any eroded areas of the system will be repaired immediately. 3. All connections into the stormwater system from future areas/outparcels shall be made such that short-circuiting of the system does not occur. 4. The permittee shall at all times provide the operation and maintenance necessary to assure the permitted stormwater system functions at optimum efficiency. The approved Operation and Maintenance Plan must be followed in its entirety and maintenance must occur at the scheduled intervals including, but not limited to: a. Semiannual scheduled inspections (every 6 months). b. Sediment removal. _ C. Mowing and revegetation of side slopes. d. Immediate repair of eroded areas. e. Maintenance of side slopes in accordance with approved plans and specifications. f. Debris removal and unclogging of outlet structure, orifice device and catch basins and piping. g. Access to the outlet structure must be available at all times. 5. Records of maintenance activities must be kept and made available upon request to authorized personnel of DWQ. The records will indicate the date, activity, name of person performing the work and what actions were taken. Decorative spray fountains will not be allowed in the stormwater treatment system. The facilities shall be constructed as shown on the approved plans. This permit shall become voidable unless the facilities are constructed in accordance with the conditions of this permit, the approved plans and specifications, and other supporting data. Upon completion of construction, prior to issuance of a Certificate of Occupancy, and prior to operation of this permitted facility, a certification must be received from an appropriate designer for the system installed certifying that the permitted facility has been installed in accordance with this permit, the approved plans and specifications, and other supporting documentation. Any deviations from the approved plans and specifications must be noted on the Certification. A copy of the approved plans and specifications shall be maintained on file by the Permittee for a minimum of ten years from the date of the completion of construction. 10. Prior to the sale of any portion of the property, an access/maintenance easement to the stormwater facilities shall be granted in favor of the permittee if access to the stormwater facilities will be restricted by the sale of any portion of the property. 11. The permittee is responsible for verifying that the proposed built -upon area does not exceed the allowable built -upon area. 12. If the stormwater system was used as an Erosion Control device, it must be restored to design condition prior to operation as a stormwater treatment device, and prior to occupancy of the facility. .19 State Stormwater Management Systems Permit No. SW8 980817 Modification II. Each outparcel has been accounted for at 100% built -upon area in the pond design. The development on each outparcel must be permitted through the Division of Water Quality -Stormwater under the offsite permit, prior to construction on that outparcel. 14. The built -upon area amount includes any built -upon area constructed within the property boundaries, and that portion of the right-of-way between the lot lines and the edge of the pavement. Built upon area includes, but is not limited to, structures, asphalt, concrete, gravel, brick, stone, slate, and coquina, but does not include raised, open wood decking, or the water surface of swimming pools. 15. In order to maintain compliance with the permit, the following deed restriction statements must be recorded with the Register of Deeds Office: a. "The runoff from all built -upon area on the outparcel and future development area must be directed into the permitted stormwater control system." b. 'Built -upon area in excess of the permitted amount will require a permit modification." C. "The connection into the stormwater control shall be made such that short-circuiting of the system does not occur." 14. A copy of the recorded deed restrictions must be submitted to the DWQ within 30 days of the date of the recording. The recorded copy must be signed by the permittee, dated, stampod with the deed book number and page, and bear the stamp of the Register of Deeds. 15. The following items will require a modification to the permit: a. Any revision to the approved plans, regardless of size. b. Project name change. C. Transfer -of ownership. d. Redesign or addition to the approved amount of built -upon area. e. Further subdivision of the project area. f. Filling in, altering, or piping of any vegetative conveyance shown on the approved plan. 16. The Director may determine that other revisions to the project should require a modification to the permit. 17. The Director may notify the permittee when the permitted site does not meet one or more of the minimum requirements of the permit. Within the time frame specified in the notice, the permittee shall submit a written time schedule to the Director for modifying the site to meet minimum requirements. The permittee shall provide copies of revised plans and certification in writing to the Director that the changes have been made. State Stormwater Management Systems Permit No. SW8 980817 Modification III. GENERAL CONDITIONS This permit is not transferable. In the event there is a desire for the facilities to change ownership, or there is a name change of the Permittee, a formal permit request must be submitted to the Division of Water Quality accompanied by an application fee, documentation from the parties involved, and other supporting materials as may be appropriate. The approval of this request will be considered on its merits and may or may not be approved. 2. Failure to abide by the conditions and limitations contained in this permit may subject the Permittee to enforcement action by the Division of Water Quality, in accordance with North Carolina General Statute 143-215.6A to 143- 215.6C. 3. The issuance of this permit does not preclude the Permittee from complying with any and all statutes, rules, regulations, or ordinances which maybe imposed by other government agencies (local, state, and federal) which have jurisdiction. 4. In the event that the facilities fail to perform satisfactorily, including the creation of nuisance conditions, the Permittee shall take immediate corrective action, including those as may be required by this Division, such as the construction of additional or replacement stormwater management systems. 5. The permittee grants DENR Staff permission to enter the property for the purpose of inspecting all components of the permitted stormwater management facility. 6. The permit may be modified, revoked and reissued or terminated for cause. The filing of a request for a permit modification, revocation and reissuance or termination does not stay any permit condition. Permit issued this the 8th day of September, 1999. Onslow County Dear Mr. Zimmer: The Wilmington Regional Office received previously requested information for the Stormwater Management Permit Application for Gateway Plaza on June 23, 1999. A review of that information has determined that the application is still not complete. The main problem is the short-circuiting of runoff carried in the southeastern pipe. I am apparently not making it clear to the engineer that this pond, as currently proposed; is short-circuiting. I will attempt here to explain why in detail. The design of a wet pond is based on a single inlet and outlet located as far as possible from each other to maximize the flow path, which allows the runoff to drop it's sediment load. By introducing multiple inlets to the pond at various places, the engineer is challenged to meet the requirements of the rules because the runoff entering the pond nearest the outlet does not receive the benefit of the entire flow path, which is called "short-circuiting". This is what is happening with this pond. The runoff entering the pond from the pipe located on the southeast side of the site, carries almost 50% of the runoff load. If we look at this pipe's drainage area independently, it would require almost 3 8,000 square feet of pond surface area, however, only a little over 20,000 square feet is provided between the inlet and the outlet. Please refer to the enclosed sketch. Somehow, the runoff in this pipe needs to be carried further away from the outlet, and the outlet needs to be relocated in order to eliminate the short-circuiting, or the pond's configuration and outlet location need to be drastically altcrcd to create a longer flow path. The return of a project will necessitate resubmittal of all required items, including the application fee. The forebays on the southern end of the pond have been redesigned/reconfigured to avoid short-circuiting (total forebay area has not changed). Also, two outlets in this area have been combined into one by adding additional piping. 2. The long narrow forebays on the southern end have been eliminated. The pipes entering the forebay on the northern end of the pond have been turned at a 45 degree angle to preclude soil erosion on the oppostie bank of the pond. Please note that the forebay surface area is 33' wide at this location, which along with the 45 degree pipe outlets is considered adequate to avoid soil erosion/washout. A preliminary review of that information has determined that the application is not complete. The following information is needed to continue the stormwater review: 1. The pond as designed is still short-circuiting. The creation of forebays at inlets that are too close to the outlet to begin with does not create a longer flow path in this case. As previously requested, please create only one or two inlets at the upper end of the pond and allow the runoff to utilize the entire surface area of the pond for treatment. Again, about 54 %of the runoff from this site enters the pond at 3 points, each a maximum of 260' feet from the outlet, across a narrow leg of a 540' long pond. The pond design is completely backwards from the desired configuration of narrower at the inlet, gradually widening and deepening to the outlet. 2. The long, narrow forebays you have created are also going to cause problems for the developer from a maintenance standpoint. If the inlet piping was parallel to the long side of the forebay, you might get away with that design, however, the proposed inlet piping is entering perpendicular to the forebay. The force of the water flow coming into the pond will continually wash out the berm, resulting in excess sediment entering the main pond body. As requested in my letter of October 29, 1998, please relocate the outlet structure, or relocate the southern -most inlet into the pond. That inlet carries the lion's share of the runoff into the pond, but it is receiving very little treatment because the outlet structure is located only 120' away. Short-circuiting is a problem in this pond. Ideally, there should be only 1 or 2 inlets located at the opposite end from the outlet structure, allowing the entire pond length to promote settling of the particles. 2. The supplement and plans indicate that the permanent pool is 40.5 and the storage pool is 41.85, but the calculations show the permanent pool as 41.5 and the storage pool as 42.85, each a foot higher than the plans show. Please clarify. At which elevation has the 82,700 square feet been provided, 40.5 or 41.5? 3. As previously requested, please add a vicinity map to Sheet 1 of 14. 4. When I add up the acreages shown for the outparcels, the total is 6.5 acres, or 283,140 square feet. Please revise the calculations and application to account for the 3,050 square foot difference. 5. The pond grading plan does not show the locations or grading for the forebays. Please add these. Again, please try to have only 1 or 2 inlets with forebays located opposite the outlet, to prevent short-circuiting and utilize the entire pond for treatment, as required. 6. There is a rote on the plans which refers to Lot 7 being permitted already and not included with this project. What is the permit number for this lot? It appears that you have included this lot within the drainage area because the inlets which drain that lot are directed into the pond. A preliminary review of that information has determined that the application is not complete. The following information is needed to continue the stormwater review: 1. Please relocate the southeast -most inlet into the pond. It drains over 1/3 of the total impervious area associated with the project, but the inlet is situated such that only a small portion of the pond area is available for treatment. Piping it up to the other inlet will be satisfactory, or providing baffles in the pond that can create a long flow path (at least 3:1). The top of the baffles should be higher than the storage elevation to prevent shortcircuiting. 2.- Please provide a location map on the plans. 3. The drainage area you use for calculation-puiposes (1,015,773) is different than the drainage area listed on the supplement form (1,044;013). The drainage area must include the pond and the pond slopes. Please revise. 4. As a result of #3 above, the surface area is deficient. Additionally, the SA/DA ratio for a 95 % impervious pond at 6' deep, and 90 % TSS removal is 5.5 %, not 4.85. Please check: 5. Delineate all wetlands on site, or note oli"the !plans that none exist.
