Project Vicinity Map Existing Site Conditions The proposed project site is located on the south side of Island Creek Road (SR1002), approximately 5 miles west of the intersection of US 17 and NC 210 in Hampstead, North Carolina and the western edge of the site is adjacent to the Pender EMS and Fire Station 28 located at 1060-1622 State Rd 1002, Hampstead, NC 28443. The proposed site access road will connect directly with Island Creek Road (34.375199, - 77.784037), across the road from the Wylie Branch Subdivision (Habersham Avenue, Rocky Point, NC 28457; 34.375701,-77.783511; not shown on Figure 1). The access road will cross an existing right-of-way (ROW) and ditch along the south side of Island Creek Road. The site is bounded on the south by the Duke Energy/Carolina Power and Light Transmission right-of-way (ROW). This ROW intersects with Duke Energy dirt road (34.372128,-77.778970) that connects with Island Creek Road (34.376596, - 77.780952). Topography of the area is generally flat. Elevations in the study area range from 34 feet above mean sea level (MSL) to a high of approximately 38 feet above MSL based on a review of USGS topographic maps. The NRCS Soil Survey of Pender County depicts three mapped soil units in the study area, Baymeade fine sand, Torhunta mucky fine sandy loam, and Woodington fine sandy loam. Torhunta mucky fine sandy loam and Woodington fine sandy loam are hydric soil mapping units. Baymeade fine sand is a non-hydric soil mapping unit that may contain inclusions of hydric soils. Approximately 7.9 acres of the 8.428-acre site are forested and the canopy is dominated by a mixture of longleaf pine (Pious palustris) and loblolly pine (Pious taeda). The understory and midstory vegetation vary from open to moderately dense. Individual pines ranged from 6 to 19 inches in diameter (DBH). Canopy was estimated to have greater than 90% cover of pine species that are a least 30 years old and include some greater than 60 years old. Portion of some forested areas have been influenced by silvicultural practices. The southern portion of the project area includes an existing powerline clearing and easement that is composed of a non -forested landscape and dominated by a mixture of herbaceous vegetation. CZR Incorporated (CZR) completed an evaluation of Section 401 /404 jurisdictional areas (i.e., wetlands, waters, and streams) and delineated jurisdictional areas in the field with sequentially numbered pink flagging based on the 1987 Corps of Engineers iedands Delineation Manual and the Regional Supplement (Atlantic and Gulf Coast— November2010). Areas that met Section 401/404 criteria (WOTUS) were delineated in the field with sequentially numbered pink flagging. The USACE approved a preliminary jurisdictional determination dated 19 May 2022. The USACE conducted an on -site field review in October 2022 with Booth & Associates, LLC, Four County EMC, and CZR which resulted in a revised jurisdictional map depicting four jurisdictional wetlands that total 3.96 acres on the site (Figure 2). There are no coastal wetlands or Areas of Environmental Concern (AECs) under jurisdiction of the NC Division of Coastal Management within the project area. A summary of jurisdictional areas on the site is found in Table 1. Figure 2. Wetland delineation map depicting four jurisdictional wetlands Applicant's Stated Purpose Four County Electric Membership Corporation's (FCEMC) purpose for this project is to construct a new electrical Point of Delivery (POD) and substation adjacent to an existing DEP 230 kV transmission line and an existing FCEMC distribution line to improve electrical delivery reliability for existing FCEMC customers in the area of Pender County, North Carolina. This project will be estimated to enhance the delivery of power in this zone and speed reconnection of power during power outages. The proposed POD and Substation will take delivery of transmission voltage from DEP and step it down to distribution voltage to meet requirements of FCEMC in the vicinity. This operation will be ongoing 24 hours a day using electrical structures and equipment and secured by several measures, including fencing designed to keep out unauthorized personnel. Except for occasional routine maintenance, the site will not require the regular presence of employees. Most of the developed site will be adjacent to an existing 230 kV transmission line owned by DEP approximately 1400 feet south of SR 1002. Project Description The electrical Point of Delivery (POD) and Substation will require clearing of 7.0± acre of forested area including 1.37 acres of wetland within the property owned by FCEMC and adjacent to a Duke Energy Progress (DEP) 230kV transmission line. The proposed project includes construction of 0.23+ mile of new access road, above ground electrical powerline, electrical substation, and transmission tap line. Site construction will be completed as follows: initial construction will involve mechanical clearing of trees and other vegetation on non -wetland areas and the installation of sedimentation and erosion control measures. Hand clearing with no mechanical clearing or stump removal along the wetland found in project. Once clearing is complete, grading will start for the 0.23+ miles driveway corridor and the 1.7+ acre substation "pad" where substation structures and equipment will be located. Upon completion of grading activities, construction will continue with installation of concrete foundations, steel structural members, transmission and distribution power poles and conductor, and various high voltage equipment needed for function of the substation. The entrance of the proposed site connects directly with Island Creek Road (34.375199, - 77.784037), across from the Wylie Branch Subdivision (Habersham Avenue, Rocky Point, NC 28457; 34.375701, - 77.783511). A Duke Energy Progress (DEP) driveway will be provided from their right-of-way (ROW). The ROW adjoins the access road which connects to Island Creek Road 0.2 miles northeast from the proposed project access. Description of Impacts to Jurisdictional Areas The proposed project includes unavoidable impacts to Jurisdictional wetlands. Proposed impacts to jurisdictional wetlands are shown in Table 1 and depicted in Figure 3.1 and 3.2. Table 1. Sheet CG401 of Hampstead POD Site Plans showing wetland impact Avoidance and Minimization Multiple rounds of alternatives were evaluated to avoid and minimize wetland impacts, which resulted in the current project design. The applicant has avoided impacts to wetlands to the greatest extent practicable. The access road has been designed to minimize impacts to wetlands. The substation pad has been placed between the distribution lines adjacent to SR 1002 and the existing DEP transmission line to minimize the overall transmission line and service road distance needed. Proposed impacts to the 3.93 acres of the total wetland on site were reduced to 1.37 acres and included: reduction of the road width to the minimum width necessary to accommodate vehicles that needed to access to the site; substation pad reduced to the minimum size necessary to accommodate equipment needed to operate the substation; substation pad located to maximize use of non -jurisdictional wetland areas in the southeastern corner of the property; stockpile located on non -wetland area. Mitigation The applicant proposes to purchase wetland mitigation credits from the Northeast Cape Fear Umbrella Mitigation Bank, which is located within the same service area and has obtained a pre -approval letter from the bank to provide needed compensatory mitigation credit for proposed impacts to non -riparian wetlands. Essential Fish Habitat Essential fish habitat (EFH) is defined as "those waters and substrate necessary to fish for spawning, breeding, feeding, or growth to maturity" pursuant to the Magnuson -Stevens Fishery Conservation and Management Act. There are no surface waterbodies present on the site and review of the NOAA EFH online mapper do not indicate any EFH within the area, thus the proposed project will not adversely impact EFH or associated fisheries managed by the South Atlantic or Mid Atlantic Fishery Management Councils or the National Marine Fisheries Service. Cultural Resources No historic properties, nor properties eligible for inclusion in the National Register, are present within the Corps' permit area; therefore, there will be no historic properties affected. Endangered Species Federally listed species for Pender County, including one candidate and one proposed species under the Endangered Species Act (ESA) are listing in Table 2. Additional state -listed species (without federal listing) that may occur in Pender County, as identified by the North Carolina Natural Heritage Program are identified in Table 2 and Attachments 4 and 5. Table 2 also indicates the presence or absence of potentially suitable habitat for each species in the study area based on field reconnaissance. The bald eagle is protected under the Bald and Golden Eagle Protection Act. Table 2. Species listed by USFWS as requiring evaluation for activities at this location. The majority of the project area is composed of forested areas dominated by longleaf pine. The study area also includes maintained open habitats adjacent to Island Creek Road and within the existing transmission line. Approximately 7.9 acres of forested areas occur within the project area, all of which may be subject to clearing with the proposed project. Potentially suitable habitat is present in the study area for the following federally protected (or candidate) species: northern long-eared bat, tricolored bat, red -cockaded woodpecker, and monarch butterfly. Tricolored Bat Potentially suitable habitat for tricolored bat is present in the forested areas. Tricolored bat is currently a species proposed for listing, but is not officially listed, or protected under the Endangered Species Act. A proposed species is one that is currently being reviewed and evaluated to determine if official listing is warranted, however, no official coordination with the USFWS under the ESA is required for proposed species. Northern Long-eared Bat Potentially suitable habitat for northern long-eared bat is present in the forested areas. Potential effects to northern long-eared bat were evaluated using the USFWS Information Planning and Consultation JPaC) system using the IPaC key to determine if the proposed Action is consistent with activities analyzed in the Programmatic Biological opinion (PBO) for this species. The IPaC was run under the assumption that tree clearing will include all forested areas within the study area. The PBO addressed activities excepted from the "take" provision of the Endangered Species Act of 1973 (ESA). The proposed Action includes "Forest Conversion," an action consistent with the PBO. The proposed Action "May Effect" the northern long- eared bat; however, any take that may occur as a result of the proposed Action is not prohibited under the ESA Section 4(d) rule adopted for this species. No comments or revision of the IPaC-assisted determination were received from the initial USFWS consultation (submitted 06 January 2022 and expired in January 2023) and subsequently updated and submitted 20 February 2023 (Attachment). The current consultation letter is valid for one year with some exceptions. The most likely exception is that the species is scheduled to be reclassified from "Threatened" to "Endangered" on 31 March 2023, and the letter will no longer be valid. Red -cockaded Woodpecker Potentially suitable foraging and nesting habitat for red -cockaded woodpecker occurs in the project area and within 0.5-mile project area. The forested portions of the project area are dominated by longleaf pine and include longleaf pine that is large/old enough to be considered nesting habitat. In a survey completed by CZR Incorporated (21 December 2022) and concurred with by the U.S, Fish and Wildlife Service (07 February 2023) no red -cockaded woodpecker individuals, cavity trees, or cavity tree starts were found in project area or within 200 feet of the project area. In addition, no red -cockaded woodpecker individuals, cavity trees, or cavity tree starts were observed within 0.5-mile of the project area. Since no red -cockaded woodpecker cavity trees or cavity tree starts were observed within the project area or within 0.5-mile and there are no known records of red -cockaded woodpeckers within 1.5-mile of the project area the proposed project "May Affect, Not Likely to Adversely Affect" (see attached SLOPES evaluation form). Monarch Butterfly Potentially suitable habit for the monarch butterfly (a candidate for federal listing) in the project area includes open/ecotone areas. The monarch butterfly is currently a candidate species and not officially listed. A candidate species is one that is currently being reviewed and evaluated to determine if official listing is warranted, however, no official coordination with the USFWS under the ESA is required for candidate species. The field evaluation documented no federal or state listed protected (endangered and/or threatened) species. Other state -listed species Suitable habitat may be present for additional state listed species that do not have federal (threatened/endangered) protection status. Surveys for state listed species are not generally conducted unless required or requested by regulatory agencies. The evaluation for these species was limited to the identification of potentially suitable habitat and no field surveys for these specific species were conducted.
