Mr. and Mrs. Roberts,
After reviewing the application for project #19-0589 the Division has determined that your application is incomplete
and is on -hold until the following information is received:
1. Show the two zones of the riparian buffer on the impact map as measured from the top of the
streambank. Zone 1 is measured 30 feet from the top of the stream bank, and Zone 2 is measured from 30
feet to 50 feet. These riparian buffers parallel the stream pattern. I have attached an impact map example for
your convenience.
2. Please see the clarification memo for how a buffer is measured around culverts. The buffer is measured in a 50
foot bubble arching downstream of the culvert pipe. If the stream is not culverted on your neighbor's property
and then goes into the culvert then that 50 foot bubble arches downstream. It appears that these two arching
50 foot bubbles will overlap. Please depict this on the impact map as well.
3. The impact map must depict the footprint of the proposed permanent impacts within Zone 2 only to qualify for
a minor variance.
4. The square footage of the impacts in Zone 2 must be identified/depicted on the impact map.
5. Describe efforts to avoid and minimize impacts to the buffers. Please explain why the detached garage cannot
be moved out of the buffer area further into the southwestern portion of the property.
6. It is unclear what the yellow and blue lines are on the impact map. Please describe in detail exactly what these
depicted colors involve. Is the yellow line a driveway?
7. Mitigation requirements -The buffer restoration or enhancement requirements are as follows: Basically, in the
help document it describes the requirements for restoration or enhancement. To sum it up, you would need to
provide a map of the restoration area and the area is equal the required area of mitigation (times 1.5) or
enhancement is 3 times greater that the area the required area mitigated. The vegetation plan must include 2
native hardwoods planted at a certain density. The mitigation is preserved in a conservation easement and
then annual reports must be provided for multiple years afterward 15A NCAC 02B .0242 ( I can provide the
whole language if you would like to read as well). So, with that being said, I have included a list of mitigation
banks below. You can choose a bank and they will provide you with a statement of availability letter which
means you have reserved credits for mitigation. Once you receive the approval letter you pay for these credits
before starting work. I am not exactly sure of the cost, but it is a much preferred method over restoration or
enhancement by the Division.
