This permit modification is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the U.S. Environmental Protection Agency dated October 15, 2007 (or as subsequently amended). This permit modification authorizes the Town of Fuquay-Varina to add an additional 400,000 gallon sludge storage tank to the Terrible Creek wastewater treatment facility. This tank will be located at the abandoned Kenneth Branch wastewater treatment facility. If any parts, measurement frequencies or sampling requirements contained in this modification are unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this letter. This request must be in the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of Administrative Hearings (6714 Mail Service Center, Raleigh, North Carolina 27699-6714). Unless such demand is made, this permit shall be final and binding. Please take notice that this permit is not transferable. This permit does not affect the legal requirements to obtain other permits which may be required by the Division of Water Quality or permits required by the Division of Land Resources, Coastal Area Management Act, or any other Federal or Local governmental permits which may be required. As of this permit issuance, any previously issued permit bearing this number is no longer effective. Therefore, the exclusive authority to operate and discharge from this facility arises under the permit conditions, requirements, terms, and provisions included herein. The Town of Fuquay-Varina is hereby authorized to: 1. Continue operation of an existing 1.0 MGD wastewater treatment system, located at the Terrible Creek Wastewater Treatment Plant off NCSR 2751 (Hilltop Road) east of Fuquay-Varina in Wake County. The facility includes the following components: • Influent pump station • Mechanical bar screen • Solids cutter • Flow sputter box • Equalization basin • Dual surge tanks • Biological reactor • Dual aeration basins • Three clarifiers • Three sludge holding tanks — (1 located offsite: Kenneth Branch) • Three tertiary filters • Totalizing flow meter • LTV disinfection • Post aeration • Stand-by power 2. After receiving an Authorization to Construct from the Division for each phase of expansion and submission of an approved engineer's certification for each construction phase, construct and operate a waste treatment facility with an ultimate design capacity of 6.0 MGD. 3. The modification consists of adding an additional 400,000 gallons of sludge storage capacity for the Terrible Creek wastewater treatment facility. The proposed storage consists of an existing tank which was manufactured by Aqua Store Tank Systems and related aeration appurtenances. The tank is constructed of metal panels bolted together with a side wall height of nineteen feet and a concrete foundation with an inside diameter of sixty-two feet. Sludge mixing/digestion is achieved using two blower assemblies with an air header assembly located on the tank floor. The storage tank is located at the abandoned Kenneth Branch wastewater treatment facility, (see map attachment A). It is our intention to utilize the tank at Kenneth Branch for emergency storage, when our land application sites are unsuitable to apply sludge on due to inclement weather conditions and/or unsuitable soil conditions. Sludge stored in the tank at Kenneth Branch will not be dewatered in such a way as to allow any supernatant to enter the sewer collection system that is tributary to Harnett County. The thickened sludge is periodically removed for land application by a contract sludge hauler. The sludge is applied to permitted land application sites by the contract sludge hauler, SYNAGRO. The sludge is Class B, as determined by 40 CFR 503.32 (b) (2) (density of fecal coliform), and 40 CFR 503.33 (b) (4) (specific oxygen uptake rate). As a result of inclement weather, sludge may be transported to the sludge storage tank located at the abandoned Kenneth Branch wastewater treatment facility. Sludge stored in the tank at Kenneth Branch will not be dewatered in such a way as to allow any supernatant to enter the sewer collection system that is tributary Harnett County.
