Dear Sirs:
A letter of request for an Authorization to Construct was received August 1, 2003 by
the Division. Final plans and specifications for the subject project have been reviewed and
found to be satisfactory contingent upon the conditions and terms stated in this document.
The Town of Marshall is still constrained by the terms and conditions of the current
NPDES permit number NC0021733. This Authorization to Construct (ATC) is hereby granted
for the construction, installation and modification of a new ultraviolet disinfection system and
all necessary appurtenances complete with UV modules, power distribution data center, UV
detection system, module -cleaning system, automatic level controls and eye shields
consisting of the following:

{1 } two (2) vertical UV disinfection modules (designed to provide adequate disinfection at
peak hourly flow with one bank out of service
{2} power distribution center, control panel and interconnecting cables to modules
{3} UV intensity monitoring system(s) .
{4} UV eye shields
{5} module cleaning station liner
{6} automatic energy conservation flow pacing system
{7} static effluent level control device
{8} module lifting beam hoist (120 volt, 1 phase, 60 Hz)
{9} in -channel cleaning system
{10} waterproof stainless steel door for entry into the UV vault
{11 } blower for the air scrubber system
{12} foundations, concrete channels, conduits, handrails and stairs
{13} main electrical power source
{14} control wiring and installation for remote signals
{15} piping, channel drains and valves
{16} walkway grating
{17} channel isolation gates (as necessary)
In addition, reliability requirements for UV disinfection systems consist of the following:
{1 } standby power (per 15 NCAC 2H .0100 Rules, Procedures for Implementation)
{2} ability to notify the ORC (operator in responsible charge) of lamp / unit failures (use an
autodialer, since the ORC is not present at all times, and audible and visible alarms)
{3} automatic controls to alternate to backup units in case of failure
The Division of Water Quality's Asheville Regional Office, telephone number 828-251-
6208, shall be notified at least forty-eight (48) hours in advance of operation of the installed
facilities so that an in -place inspection can be made. Such notification to the DWQ Regional
Supervisor or DWQ county contact shall be made during normal office hours from 8:00 am
until 5:00 pm on Monday through Friday, excluding State Holidays.
Upon completion of construction, installation and modification and prior to operation of
this permitted facility, a certification must be received from a professional engineer certifying
that the permitted facility has been installed in accordance with this Authorization to
Construct and the approved plans and specifications. Mail the Certification to the NCDENR-
DWQ, NPDES Unit, 1617 Mail Service Center, Raleigh, NC 27699-1617.
Failure to abide by the requirements contained in this Authorization to Construct may
subject the Permittee to an enforcement action by the Division of Water Quality in accord-
ance with North Carolina General Statutes 143-215.6A to 143-215.6C.

The issuance of this Authorization to Construct does not preclude the Permittee from
complying with any and all statutes, rules, regulations or ordinances which may be imposed
by other government agencies (local, state and federal) which have jurisdiction.
