Division personnel have reviewed and approved your application for renewal of the subject permit.
Accordingly, we are forwarding the attached NPDES discharge permit. This permit is issued pursuant to the
requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North
Carolina and the U.S. Environmental Protection Agency dated May 9, 1994 (or as subsequently amended).
If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable to
you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of
this letter. This request must be in the form of a written petition, conforming to Chapter 150B of the North
Carolina General Statutes, and filed with the Office of Administrative Hearings (6714 Mail Service Center, Raleigh,
North Carolina 27699-6714). Unless such demand is made, this decision shall be final and binding.
Please note that this permit is not transferable except after notice to the Division. The Division may require
modification or revocation and reissuance of the permit. This permit does not affect the legal requirements to obtain
other permits which may be required by the Division of Water Quality or permits required by the Division of Land
Resources, the Coastal Area Management Act or any other Federal or Local governmental permit that may be
required.

Charles, We do not need to consider any discharges to Cane Creek in Buncombe
County. It does not serve as a source of public water supply in North
Carolina.

Charles - Your draft looks OK. I agree that 700 ug/1 is too high for trout
waters, even if its only 1500 ft or so to where it changes to Class C. I also
think that 17 ug/l is too low, but I don't know what options we have here.
DMRs for Fairview show a fully functioning tablet dechlorination system
generating TRC ranging from 20 ug/1 to 130 mg/l. Maybe a year will give them
enough time to make the system changes needed to comply.
As you know, this is the same school system that has asked us to review the 17
ug/l limit for Cane Creek Elementary School facility which discharges to Cane
Creek after it becomes a Class C stream. According to the operator, the
tablet declorination system approved in the ATC cannot consistently meet the
limit. We may want to consider changing this limit to what they can meet when
we reissue that permit. 700 ug/1 is too high for any stream. Max
Charles Weaver wrote:

Dear Ms. Jackson:
The following is in reference to your request for a narrative description of the sludge management
plan for the subject wastewater treatment facilities.
There are no sludge handling treatment units on -site, or is the sludge discharge to the receiving
waters.
RPB Systems Inc., our contracted wastewater operator, contracts the pumping of excess solids as
indicated by the increasing MLSS (mixed liquor suspended solids). The ORC or on -site operator
makes this assessment based on MLSS lab results. As the MLSS increases beyond the
recommended concentration, solids are wasted from the activated sludge system. The contract
hauler takes the waste activated sludge to a local municipality, which accepts such wastes, or to
another wastewater treatment plant that has experienced an upset and is in need of reseeding.

C. Describe receiving stream features and pertinent downstream
uses: Agriculture, Wildlife - Cane Creek is classified as a
WS stream since it is within the 10 mile arc for the formerly
proposed intake on the French Broad River (FBR) by the
Asheville -Buncombe Water Authority (ABWA). Upon
reclassification of the Mills River and the FBR (at
confluence in Henderson County) to WS class (currently being
processed for recommendation to EMC), WS classification for
the lower FBR (and tributaries) will be withdrawn accordingly
to correspondence from the ABWA.
PART II - DESCRIPTION OF DISCHARGE AND TREATMENT WORKS
