Dear Mr. Cole:
At your request I conducted an on -site determination in review drainage features located on the subject property
fen applicability no the Neese Buff Rules(15A NCAC 2B.0233). Thepropertyislocaredontheeastsideof
Street Peny Road (SR 1440), south of Vancel om. The feature is labeled as "WaRO-07-139a' on the anachad
map initialed by me on August 16, 2007
The Divbioo of Water Quality (DWQ) has determined that the portion of the feature that is highlighted
in pink on the atmched map is Exam ot from the Neese Buffer Rules. The portions of the feature that are
circled and highlighted in blue on %e mucbed map are Snidest to the Neese Buffer Rules. This feature
should be identified on any future plans for this property. The owns (or finure owners) should notify the DWQ
(and other relevant agencies) of this decision in any future correspondences concerning this property. This
determination pertains in the subject property only. This on -site determination shop expire five (5) years from
the date of this letter.
Landowners or affected pmries Nat dispute a determination made by the DWQ or Delegated Local Authority
that a surf water exists aWthat it is subject in the buffer rule may repuert a deemination by the Director. A
request for a determination by the Director shall be referred to the Director in wining do Cyndi Kmoly, DWQ
Wedandsol01 Unit, 2321 Crabtree Blvd., Releigfy NC 27604-2260. Individuals then dispute a determination by
the DWQ or Delegated Local Authority that "exempts" a surface water from the buff role may ask for an
adjudicatory hearing. You must act within 60 days of the date that you receive this lever. Applicants are
hereby notified that the 60day smmtnry appeal time does not stun until the affecud party (including
dow ream and adjacav landowners) is notified of this decision. DWQ recomennums that the applicant
conduct this ratification in order to he certain that third party appeals are made in a timely manner.
