WITNESSETH, that Grantor, for a valuable consideration paid by Grantee, the receipt of which
is hereby acknowledged, has and by these presents does grant, bargain, sell and convey unto the
Grantee in fee simple, all that certain lot or parcel of land situated in the City of Charlotte,
submitted electronically by "National ucc, Inc."
in compliance with North Carolina statutes governing recordable documents
and the terms of the submitter agreement with the Mecklenburg county Register of Deeds.
Mecklenburg County, North Carolina and more particularly described on Exhibit A attached
hereto and incorporated herein by reference (the "Property").
The Property hereinabove described is a portion of that property acquired by Grantor by
instruments recorded in Book 23335, Page 596-602 of the Mecklenburg County, North Carolina
Public Registry (the "Registry').
All or a portion of the property herein conveyed does not include the primary residence of a
Grantor.
TO HAVE AND TO HOLD the aforesaid lot or parcel of land and all privileges and
appurtenances thereto belonging to the Grantee in fee simple.
And the Grantor covenants with the Grantee, that Grantor has done nothing to impair such title
as Grantor received, and Grantor will warrant and defend the title against the lawful claims of all
persons claiming by, under or through Grantor, except for the exceptions hereinafter stated.
Title to the property is subject to the following exceptions:
See Exhibit B, attached hereto and incorporated herein by this reference.

LeEal Description
Lying and being in the City of Charlotte, Mecklenburg County, North Carolina and being
more particularly described as follows:
TRACT 1:
BEGINNING at a point in the center line of Westinghouse Boulevard, said point being a comer
of the property of Diamond Shamrock Chemical Co. and in the center of a railroad right of way,
the coordinates as established from the North Carolina, Plane Coordinate System being
508,896.826 N. and 1,413,286.974 E.; running thence with the center line of Westinghouse
Boulevard N. 87-29-32 W. 600 feet to a point; thence N 0-50-53 E. 1507. 72 feet to an iron stake
in the center of a railroad right of way, coordinates 510,430.635 N. and 1,412,708.862 E.;
running thence with the arc of a curve to the right having a radius of 1910.8 feet, a distance of
1384.97 feet in a southerly direction with the center of the railroad right of way to an iron stake;
thence continuing with the center of said railroad right of way S. 3-34-13 E. 300 feet to the point
or place of beginning, containing 14.626 acres, as shown on boundary survey for American
Aniline Products, Inc., dated May 19, 1971, by Spratt-Seaver, Inc., reference to which is hereby
made.
TRACT 2;
To locate the point of Beginning, start at an iron in the centerline of Westinghouse Boulevard,
being the southwesterly corner of that t4.626 acre tract conveyed by American Color &
Chemical Corporation to CIBA-GEIGY Corporation by Deed dated June 16, 1982 and recorded
in Book 4548 at Page 87 in the Mecklenburg County, North Carolina Public Registry, and runs
N. 0-50-53 B. 359.62 feet along the westerly line of said 14.626 acre tract to an iron, the point of
Beginning; and runs from said point of Beginning N. 89-09-07 W. 38.81 feet to an iron; thence
N. 0-50-53 E. 512.51 feet to an iron; thence N. 89-56-23 E. 38.81 feet to an iron in the westerly
boundary of said 14.626 acre tract; thence running with the westerly boundary of said 14.626
acre tract S. 0-50-53 W. 513.13 feet to the point or place of Beginning and being shown on a
boundary and physical survey for CIBA-GEIGY Corporation prepared by M. B. Seaver,
Registered Surveyor, dated June 18, 1982 and revised July 8, 1982.

Grantee to use such property in the current manner owned or used by Grantor or(b) do not materially
impair the value of such property.
3. Zoning, building, subdivision or other similar requirements or restrictions not materially violated by
the current use of such Property.
4. Any title encumbrances, exceptions, and other matters of record affecting the Property that,
individually or in the aggregate, (a)have not had, and are not reasonably expected to have, a material
and adverse effect on the ability of Grantee to use such property in the current manner owned or used
by Grantor or(b) do not materially impair the value of such property.
5. Mechanics', carriers', workmen's, repairmen's or other like encumbrances arising or incurred in the
ordinary course of business that are not yet due and payable.
