PROJECT SUMMARY: The applicant is proposing to perform maintenance dredging within the existing boat basin and access channel; construction of new bulkheading and retaining wall; open water breakwater and redevelopment of marina docking facility. ~- Mason Landing Yacht Club, LLC C/o Steve Saieed Page Two PROJECT DESCRIPTION: The project is located at 1927 Turner Nursery Road, adjacent to the AIWW /Middle Sound, near Wilmington, in New Hanover County. To locate the property from Market Street (NC Highwayl7), turn onto Middle Sound Loop Road and continue east past Ogden Elementary School approximately 2 miles. Turn left on Mason Landing Road and travel approximately 0.1 miles. Turn right onto Turner Nursery Road and the property of interest will be located on the left. The property encompasses approximately 9.97 acres and was the former location of Johnson's Marina, which has recently been sold. The residential and commercial buildings have been demolished along with the paved parking areas, driveways and foundations. There is an existing gravel road located on the southwestern end of the property that leads to a paved peninsula (concrete pier) located on the most southeastern end of the property. The peninsula has been historically used as trailer parking for the associated boatramp located on the northern side of peninsula. The application states the existing marina previously contained approximately 60 wet slips comprised of floating docks and finger piers, which have been removed. Steel and wooden bulkheads stabilize portions of the interior section of the marina basin. There is also an existing highground wooden retaining wall that stabilizes the highground area between the gravel access road and the location of the old metal building (See Sheet 1 of 9). The upland area averages approximately 16' above mean sea level (MSL) and includes approximately 1,430 linear feet of shoreline along the man-made basin and the AIWW. High ground vegetation consists of mixed hardwoods. There is a small pocket of §404 Type Wetlands (approximately 840 sq. ft.) located on the northern end of the property. There is also another area of §404 Type Wetlands (approximately 15,746 sq. ft.) located on the western end of the property. Coastal Wetlands exist on the south side of the peninsula and consist primarily of Smooth Cordgrass Marsh (Spartina altern~ora). Other mixed species of Coastal Wetlands include: Glasswort (Salicornia sp.), Sea Lavender (Limonium sp.) and Salt Meadow Grass (Spartina patens). Transitioning to §404 Type Wetlands including: Marsh Elder (Iva frutescens), Wax Myrtle (Myrica cerifera L.), Sea Oxeye (Borrichia frutescens) and Common Reed (Phragmites australis). Small pockets of volunteered Coastal Wetlands also exist along the north and south side of the existing basin also consisting primarily of Smooth Cordgrass (Spartina alterniflora). An area of marsh, approximately 300' in width, borders the northern side of the access channel to the basin, which primarily consists of Smooth Cordgrass (Spartina altern~ora). CAMA Major permit #67-07 was issued to Mason Landing Yacht Club, LLC c/o Steve Saieed, authorizing the construction of a 25-lot residential subdivision, including but not limited to the roads, sidewalks, utilities, marina clubhouse, pool and associated infrastructure. The permittee was recently issued a Major Modification to CAMA Major permit # 67-07 on 8/20/07 through the CAMA Express Permitting Program for maintenance dredging within the existing boat basin, access canal and entrance channel. However, CAMA Major Permit # 67-07 did not authorize incorporation of the isolated, volunteered pockets of Coastal Wetlands, consisting primarily of Smooth Cordgrass (Spartina alterniflora) located on the northern and southern ends of the marina basin (See Sheet 1 of 9). CAMA Major permit #67-07 is due to expire on 12/31/2010. The applicant has recently initiated maintenance excavation and currently under construction for the upland portion of the project. The applicant and adjacent riparian property owner recently received a joint CAMA General Permit No. 47450 for a new bulkhead along the shared northern portion of the property. Location of this bulkhead is located landward of the existing steel and deteriorated asbestos bulkheading. The waters of the AIWW in the vicinity of the project area are classified "SA-ORW" by the Division of Water Quality. The area immediately adjacent to the project site is NOT designated as a PrimaryNursery Area (PNA) by the Division of Marine Fisheries, and according to maps provided by Shellfish Sanitation, the area adjacent to the project site is CLOSED to the harvesting of shellfish. Mason Landing Yacht Club, LLC C/o Steve Saieed Page Three PROPOSED PROJECT: The applicant is proposing modification to CAMA Major permit #67-07 to perform maintenance dredging within the existing boat basin and access channel; construction of new bulkheading, retaining wall and open water breakwater; and redevelopment of marina docking facility. The proposed maintenance dredging within the existing marina basin, access canal and entrance channel would be to a depth greater than was originally permitted through LAMA Major permits # 193-74 and #29-83. According to the application and site drawings, approximately 4,000 cubic yards of material would be excavated by mechanical means using a bucket and barge type dredge. The boat basin, 425' in length by an average of 130' in width, would be dredged from the existing depths ranging from -0' to -6.0'@ Mean Low Water (MLW) to a final project depth of -6.0' @ MLW. The dredged footprint of the access canal and entrance channel, 600' in length by an average of 80' in width, would be dredged from the existing depths ranging from -2.0' to a final project depth -6.0' @MLW contours within the access channel, and taper off to the depth of the adjoining federally maintained channel (approximately -9.0 to -10.5' MLW). Also, as mentioned previously, this maintenance excavation event would incorporate pockets of isolated, volunteered Coastal Wetlands consisting primarily of Smooth Cordgrass (Spartina alterniflora). The application also proposes maintenance excavation within the channel located on the northern side of the access channel, which leads into the adjacent riparian property owner to the north docking facility (Shell Property). Dimensions would be 68' in length by 21' in width would be dredged from the existing depths ranging from -2.0' @MLW to a final project depth -6.0' @MLW. These dimensions would be located outside the recently authorized maintenance excavation through CAMA Major permit #67-07; however, these dimensions would be located within the historical dredging limits associated with CAMA Major permits # 193-74 and #29-83. Further, the proposed dredging activities would remain within the same footprint as originally permitted, however as previously mentioned, the entire boat basin and access channel would be deepened from the originally permitted -5.0' contour to -6.0' contour (relative to MLW). The application states that these dimensions also include excavation of a section of the most waterward end of the existing highground concrete pier, which currently is located within the USACOE AIWW right-of--way. According to the application package, the proposed dredging activities would be located a minimum of 10' from any areas of Coastal Wetlands, not including the isolated, volunteered Coastal Wetlands aforementioned. Spoil material generated from the dredging activities would be off-loaded at the head of the boat basin, and then transported and spread throughout the high ground portion of the property. Please refer to Sheet 6 of 9 for a detailed description of the spoil disposal area and Sheet 3 of 9 for a detailed description of the proposed dredging activities. The applicant proposes to stabilize the marina basin and access channel with new bulkheading and retaining walls. The new bulkhead would run approximately 1,675 linear feet throughout the marina basin, access channel and waterward of the concrete pier. Sections of the new bulkheading would be within the alignment authorized under CAMA General permit No. 47450, which did not authorize incorporation areas of the isolated, volunteered Coastal Wetlands located on the northern portion of the basin. The application states the new alignment would average less than 10' waterward of MHW. The new bulkheading along the concrete pier would incorporate and close off the use of the existing boatramp at this location. The application states that a retaining wall (Keystone wall) would tie into the authorized bulkhead located on the northern side of the basin. The Keystone wall would be located partially on the applicant's property and then turn entirely along the shoreline of the adjacent property owner to the north (Shell property). The application states that Keystone wall location on the applicant's property is designed to stabilize and preserve a large live oak tree and other mature trees and shrubs that stabilize a bluff on the shared shoreline. The property owners have agreed in writing for the location of the bulkheading (See agreement dated December 21, 2006). The application also proposes the construction of platforms, measuring 24' in length by 12' and 5' in length by 4' in width, adjacent to the existing private pier and residence of the property owner to the north (Shell property). The applicant also proposes to stabilize the southwestern portion of the property with a highground retaining wall. The retaining wall would run along the gravel road and 25' access easement that leads to the parking area on the concrete pier. The retaining wall would terminate adjacent to the authorized marina clubhouse located at the terminal end of the basin (See Sheet 3 of 9). Mason Landing Yacht Club, LLC C/o Steve Saieed Page Four The applicant proposes to redevelop the marina docking facility with new floating docks, finger piers and mooring pilings to accommodate 57 vessels. A floating dock would be installed on the northern side of the marina basin, measuring 258' in length by 6' in width. Eight (8) finger piers, measuring 30' in length by 3.5' in width, would extend perpendicularly towards the basin from the floating dock, approximately 30' apart. A floating dock would be installed on the terminal end of the basin waterward of the authorized marina clubhouse, measuring 113' in length by 10' in width. This dock would then lead onto a floating dock located on the southern side of the marina basin, measuring 426' in length by 6' in width. Seven (7) finger piers, measuring 35' in length by 3.5' in width, would extend perpendicularly from the floating dock towards the basin, approximately 36' apart. An additional four (4) finger piers, measuring 40' in length by 4.5' in width, would extend approximately 40' apart from the same floating dock. The floating dock would then lead onto a floating dock, measuring 345' in length by 6' in width, also along the southern side of the access channel. Nine (9) finger piers, measuring 40' in length by 4.5' in width, would extend perpendicularly towards the channel from this floating dock, approximately 40' apart. Two (2) of these finger piers would be approximately 20' apart that would accommodate slips number 1 and 2. 28 mooring pilings would be installed between these finger piers to accommodate these slips. The application states the proposed redeveloped marina docking facility would accommodate at total of 57 vessels (See Sheet 2 of 9). The applicant proposes to install a vinyl breakwater to protect the outer portions of the docking facility from wave actions associated with the AIWW. The breakwater would be located at the entrance of the access channel with dimensions of 100' in length by approximately 10' in width. The application states the breakwater would be designed with 1" gaps per linear foot or equivalent to allow for water passage. The application also states the breakwater height would be constructed 1' above MHW with reflectors on treated posts every forth post for navigational concerns and would not extend beyond the concrete pier located to the south of the proposed location (See Sheet 2 of 9 and Sheet 9 of 9). 10. ANTICIl'ATED IMPACTS: The proposed boat basin, access canal and entrance channel maintenance dredging would impact approximately 104,678 sq. ft. of previously dredged shallow bottom area, deepening the basin and access canal from -5.0' to -6.0 MLW, which would result in the removal of approximately 4,000 cubic yards of material within Estuarine Waters and Public Trust Areas as maintenance excavation. As proposed, it appears that the dredging activities would impact approximately 580 sq. ft. of Coastal Wetlands, consisting primarily of Smooth Cordgrass (Spartina alterniflora). Approximately 300,000 sq. ft. of highground area would be disturbed for the spoil site area preparation and placement of material. Increases in turbidity should be expected during the dredging period however, no long term or adverse impacts are anticipated. The proposed docking structures (floating docks, finger piers and mooring pilings) would incorporate approximately 10,692 sq. ft. of Estuarine Waters and Public Trust Area, however, much of this area was usurped by the previous marina facility. The application states that the proposed structures would be located within the previous marina's original footprint and would have a similar use. The proposed breakwater would incorporate approximately 800 sq. ft. of Estuarine Waters and Public Trust Area. The new bulkhead would incorporate approximately 8,798 sq. ft. of Estuarine Waters and Public Trust Area and approximately 175,950 sq. ft. of highground for associated backfill and anchor system. The proposed highground retaining wall and Keystone wall would disturb approximately 128,000 of highground for associated backfill and anchor system. The Keystone wall would incorporate approximately 125 sq. ft. of Coastal Wetlands, consisting primarily of Smooth Cordgrass (Spartina alterniflora). The proposed platforms associated with the docking facility on the adjacent riparian property to the north would disturb approximately 308 sq. ft. of highground. The plans indicate that no more than 200 sq. ft. would be located within the Coastal Shoreline 30' buffer. Approximately 4,000 sq. ft. of Estuarine Waters and Public Trust Area would be created by the removal of the waterward end of the concrete pier. Submitted by: Robb Mairs Date: October 12, 2007 Office: Wilmington Project Narrative Major Modification to Permit #: 67-07 Mason Landing Yacht Club Wilmington, New Hanover County, North Carolina Mason Landing Yacht Club, LLC, Applicant This Major Modification proposes the redevelopment of the subject marina. The marina, formally known as Johnson Marine, is located partially within an inland basin and partially in the open waters of the Intracoastal Waterway in Wilmington, New Hanover County, North Carolina. The proposed work includes the replacement of the docking structures, partial removal of portions of the existing concrete peninsula including the portion within the USACE Atlantic Intracoastal Waterway Right-of--Way, new bulkhead and retaining wall construction, repair of existing bulkhead, a breakwater, and dredging. There were 60 slips existing in the marina, these structures will be removed and there are a total of 57 slips proposed. The existing boat ramp is proposed to be removed. The proposed keystone wall does incorporate approximately 125 square feet of sparsely vegetated coastal wetlands. The keystone wall is proposed in this location to preserve a large live oak tree and other mature trees and shrubs that would otherwise have to be removed to allow for bulkhead placement at the mean high water line located at the base of the existing escarpment. The proposed breakwater will not impede navigation due to its proposed location in relation to the existing concrete peninsula. The breakwater will have a maximum height of 1' above MHW with the exception of posts with reflectors located on every 4`h piling. See sheet 9 of 9 for a typical detail. Previous permits for the site include Major Permit # 67-07, GP # 47450, and a Major Modification to permit # 67-07 was issued on August 20, 2007. Stormwater Permit No. SW806720 and Grading Permit # 74B-06 have also been issued for the site. The Major Permit authorized all of the upland development for the site located within the 575' AEC.
