PROJECT SUMMARY: The proposed project is for 142 cubic yards of earthen fill to be placed over 404 wetlands within the retaining wall area authorized by CAMA Minor Permit (WO-21-55) for a single- family residence. 9. NARRATIVE DESCRIPTION: The proposed retaining wall and associated backfill at 719 Cannonsgate Drive, Newport, Carteret County, was authorized by Carteret County under CAMA Minor Permit No. Wo-21- 55 for a retaining wall and associated earthen backfill in the estuarine shoreline/ORW AEC and was issued on 01/04/2022. Based upon a survey (dated 03/11/2022 by another company) the wetlands delineation was substantially more than 5 years old and is from the recorded deed map book. Subsequently the building permits were also issued for this project and work progressed on the vinyl retaining wall and associated backfill. The old wetlands line used in the 03/11/22 survey showed the line 30' waterward of the proposed single-family residence and also showed the then proposed retaining wall located immediately landward of the wetlands line. Work had been completed on the vinyl retaining wall and backfilling was underway when the U.S. Army Corps of Engineers Regulatory Specialist observed the work being done within 404 wetlands during August of 2022. Work stopped and the owner contracted with Tidewater Associates to obtain the necessary permits to complete the backfilling. A new survey was done by Tidewater Associates to map the wetlands line as delineated by the Corps representative. The updated wetland delineation is 30' more landward from the old wetlands line that was used in the CAMA Minor permitting. This delineation places the newly constructed retaining wall and partial backfill within non -coastal wetlands. Hence, a CAMA Major Permit is required. The property is located adjacent to Bogue Sound at 719 Cannonsgate Drive in Newport, Carteret County. 719 Cannonsgate Drive proper is 12,978 sf. The property is within the Cannonsgate Subdivision. There are no other structures developed on this property except for the upland vinyl retaining wall. Cannonsgate Subdivision properties are served by a community wastewater treatment facility. The retaining wall was approved by the HOA Architectural Committee, permitted by Carteret County Local CAMA Permit Officer, and the County Building Inspections Department and construction began in March of 2022. The Adjacent riparian properties to the east and west of 719 Cannonsgate Drive are currently undeveloped. The average elevation of the high ground within the Estuarine Shoreline is 5' above the normal high water (NHW) and consists mostly of grass, sand, and woody shoreline vegetation. This waterfront property is 40' in width. There is 42 linear feet of shoreline along Bogue Sound on this property. The project area is an average of 140' landward of NHW of Bogue Sound. The tidal amplitude for this area is approximately 2 foot relative to NLW/MLW. There is a fringe of coastal wetland marsh consisting mostly of Spartina alterniflora and Juncus roemerianus along the immediate shoreline that blends into a woody transitional zone consisting of primarily of yaupon and wax myrtle shrubs as the elevation changes toward the upland area. The Division of Water Resources Classifies this area as HWQ/ORW/SA Waters and is open to Field Investigation Report: Pirate Ventures, LLC DCM Major Permit Page 12 shellfish harvesting. The waters contiguous to this property are not classified as a Primary Nursery Area and submerged aquatic vegetation habitat could be within the vicinity of the property in Bogue Sound. There is a defined Federal Channel offshore to the project area. 10. PROJECT DESCRIPTION: The applicant proposes to complete backfilling the retaining wall previously authorized. The existing retaining wall totals 97 linear feet, including the return walls. The retaining wall and associated backfill is the minimum amount necessary to construct the proposed single-family residence that would meet the minimum square feet of living space and still meet the minimum building setbacks required by HOA covenants. Finishing the project would require placing approximately 142 cubic yards of clean earthen fill material within the 1300 sf area of the existing retained area footprint. Of the 1,300sf area, 655sf were delineated as 404 wetlands. The applicant intends to stabilize the fill area with vegetative cover of sod upon completion. 11. ANTICIPATED IMPACTS: There would be minimal impacts to coastal waters, coastal wetlands, and the estuarine shoreline as fill would be confined to the retaining wall footprint was previously authorized through CAMA Minor Permitting. The retaining wall is approximately 105' landward of coastal wetlands. The fill area would be vegetated immediately and does not impact or cutoff any hydrologic flow or connection. The waters contiguous to this property are not classified as a Primary Nursery Area and submerged aquatic vegetation habitat could be within the vicinity of the property in Bogue Sound. This area is open to shellfish harvest and is classified as SA/HQW/ORW. There is a defined Federal Channel offshore of the project area. Development: The applicant proposes to complete the retaining wall backfilling project, The existing retaining wall totals 97 linear feet, including the return walls. The retaining wall and associated backfill was the minimum amount necessary to be able to construct the proposed single-family residence that would meet the minimum square feet of living space and still meet the minimum building setbacks required by HOA covenants and would allow safe construction, ingress and egress of the home. The ownerlapplicant reports it would not be possible to construct the residence that has been designed and approved to be constructed on this property without the location of the existing and permitted retaining wall. Finishing the project would require placing approximately 142 cy of clean earthen fill material within the 1,300 square feet area of the existing retained area footprint. Of the 1,300 square feet area, 655 square were delineated as probable wetlands of the United States, or federal jurisdiction, primarily within the southwest corner of the retained footprint (SAW-2022-0273). The applicant intends to stabilize the fill area with a vegetative cover of sod upon completion. The remaining work could be completed in less than a week, weather permitting. The Applicant has also, through previous permitted authorizations, expended substantial time and money into this project. The project would also allow the property to be safely and effectively stabilized and would provide opportunities for good operational practices controlling runoff and erosion control. All backfill material would come from an upland source, Appropriate sedimentation and erosion control devices, measures or structures would be implemented to ensure sediment runoff does not enter adjacent wetlands, waterbodies and properties. Anticipated Impacts: The proposed project would not adversely impact coastal waters, coastal wetlands, or the coastal shoreline. All fill material would be retained within the confines of the retaining wall footprint and the filled area stabilized with a sod cover immediately upon completion. The proposed retaining wall completion project would not involve impervious surface beyond the width of the retaining wall cap. The proposed house design, when reaching that phase, is within or below its impervious allocation as per State Stormwater Project ID No. SW8 050516. No excavated or fill material will be placed outside of the alignment of the retained fill area as indicated on the workplan drawing(s). All disturbed areas would be stabilized with a vegetative cover immediately upon completion. The project does not impact or cutoff any hydrologic flow or connection. The existing retained area with fill that was previously placed through a CAMA Minor Permit authorization has filled 655 square feet, or .015 acre of non -coastal wetland, or probable wetland of the United States. If removal of the retaining wall and earthen fill would be required, even greater adverse impacts would likely result. Removal or even redesign would require additional impacts beyond the existing retained area footprint since removal of the wall would require the use mechanized equipment. The heavy equipment would have to operate beyond the existing footprint to remove the wall, which would likely cause greater harm to a much larger area of wetland. The project area would also be at greater risk of stormwater erosion, scouring, and runoff into the adjacent wetland area. The nearly perpendicular design of the wall to the wetland area minimized the impact area. A sloped area of earthen fill that would not extend into the wetland area would not provide the same practical or ecological benefit as vertical retention in this unique case. On this property, to provide the minimum building area, the sloped areas would need to be steep, a slope of 6:12 or steeper, which could inadvertently be the cause of runoff and sedimentation into adjacent wetlands, resulting in a larger impact area. Since the existing retaining wall and fill were permitted to be placed in its current location, total avoidance in this particular case, for obvious reasons, would not be practical and cause unnecessary economic and logistical hardship on the owner. However, allowing the existing wall and fill to remain would be the least environmentally damaging practical alternative, thus preventing and reducing the risk of further impacts and would avoid potential for adverse effects to the aquatic environment.
