Staff review of the plans and specifications has determined that the project, as proposed, will comply with the Stormwater Regulations set forth in Title 15A NCAC 2H.1000. We are forwarding Permit No. SW8 970834 dated January 26, 1998, for the construction of Pirates Cove Townhomes. This permit shall be effective from the date of issuance until January 26, 2008, and shall be subject to the conditions and limitations as specified therein. Please pay special attention to the Operation and Maintenance requirements in this permit. Failure to establish an adequate system for operation and maintenance of the stormwater management system will result in future compliance problems. If any parts, requirements, or limitations contained in this permit are unacceptable, you have the right to request an adjudicatory hearing upon written request within thirty (30) days following receipt of this permit. This request must be in the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of Administrative Hearings, P.O. Drawer 27447, Raleigh, NC 27611-7447. Unless such demands are made this permit shall be final and binding. DESIGN STANDARDS This permit is effective only with respect to the nature and volume of stormwater described in the application and other supporting data. 2. This stormwater system has been approved for the management of stormwater runoff as described on page 3 of this permit, the Project Data Sheet. The stormwater control has been designed to handle the runoff from 251,949 square feet of impervious area. 3. Approved plans and specifications for this project are incorporated by reference and are enforceable parts of the permit_ 4. The permittee is responsible for verifying that the proposed built -upon area does not exceed the allowable built - upon area. 6. The following items will require a modification to the permit: a. Any revision to the approved plans, regardless of size. b. Project name change. C. Transfer of ownership. d. Redesign or addition to the approved amount of built -upon area. e. Further subdivision of the project area. f. Filling in, altering, or piping of any vegetative conveyance shown on the approved plan. In addition, the Director may determine that other revisions to the project should require a modification to the permit. 7. The Director may notify the permittee when the permitted site does not meet one or more of the minimum requirements of the permit. Within the time frame specified in the notice, the permittee shall submit a written time schedule to the Director for modifying the site to meet minimum requirements. The permittee shall provide copies of revised plans and certification in writing to the Director that the changes have been made. II. SCHEDULE OF COMPLIANCE The permittee will comply with the following schedule for construction and maintenance of the stormwater management system: a. The stormwater management system shall be constructed in it's entirety, vegetated and operational for it's intended use prior to the construction of any built -upon surface except roads. b. During construction, erosion shall be kept to a minimum and any eroded areas of the system will be repaired immediately. 2. The permittee shall at all times provide the operation and maintenance necessary to assure the permitted stormwater system functions at optimum efficiency. The approved Operation and Maintenance Plan must be followed in its entirety and maintenance must occur at the scheduled intervals including, but not limited to: a. Semiannual scheduled inspections (every 6 months). b. Sediment removal. C. Mowing and revegetation of side slopes. d. Immediate repair of eroded areas. e. Maintenance of side slopes in accordance with approved plans and specifications. f. Debris removal and unclogging of outlet structure, orifice device and catch basins and piping. g. Access to the outlet structure must be available at all times. 3. Records of maintenance activities must be kept and made available upon request to authorized personnel of DWQ. The records will indicate the date, activity, name of person performing the work and what actions were taken. 4. This permit shall become voidable unless the facilities are constructed in accordance with the conditions of this permit, the approved plans and specifications, and other supporting data. 4 State Stormwater Management Systems Permit No. SWR 970834 5. Upon completion of construction, prior to issuance of a Certificate of Occupancy, and prior to operation of this permitted facility, a certification must be received from an appropriate designer for the system installed certifying that the permitted facility has been installed in accordance with this permit, the approved plans and specifications, and other supporting documentation. Any deviations from the approved plans and specifications must be noted on the Certification. 6. A copy of the approved plans and specifications shall be maintained on file by the Permittee for a minimum of ten years from the date of the completion of construction. 7. Prior to the sale of any portion of the property, an access/maintenance easement to the stormwater facilities shall be granted in favor of the permittee if access to the stormwater facilities will be restricted by the sale of any portion of the property. M. GENERAL CONDITIONS This permit is not transferable. In the event there is a desire for the facilities to change ownership, or there is a name change of the Permittee, a formal permit request must be submitted to the Division of Water Quality accompanied by an application fee, documentation from the parties involved, and other supporting materials as may be appropriate. The approval of this request will be considered on its merits and may or may not be approved. 2. Failure to abide by the conditions and limitations contained in this permit may subject the Permittee to enforcement action by the Division of Water Quality, in accordance with North Carolina General Statute 143-215.6A to 143- 215.6C. 3. The issuance of this permit does not preclude the Permittee from complying with any and all statutes, rules, regulations, or ordinances which may be imposed by other government agencies (local, state, and federal) which have jurisdiction. 4. In the event that the facilities fail to perform satisfactorily, including the creation of nuisance conditions, the Permittee shall take immediate corrective action, including those as may be required by this Division, such as the construction of additional or replacement stormwater management systems. 5. The penmittee grants DENR Staff permission to enter the property for the purpose of inspecting all components of the permitted stormwater management facility. 6. The permit may be modified, revoked and reissued or terminated for cause. The filing of a request for a permit modification, revocation and reissuance or termination does not stay any permit condition. Permit issued this the 26th day of January, 1998. The drawdown will exceed 2 1/2 days and be less than 3 days. McLean Engineering 106 Manatee Street Cape Carteret, NC 28584 Subject: Dear Mr. McLean: NCDENR NORTH CAROLINA DEPARTMENT OF ENVIRONMENT AND NATURAL RESOURCES REQUEST FOR ADDITIONAL INFORMATION Stormwater Project No. SW8 970834 Pirates Cove Townhomes Onslow County The Wilmington Regional Office received previously requested information for the Stormwater Management Permit Application for Pirates Cove Townhomes on October 9, 1997. A preliminary review of that information has determined that the application is not complete. The following information is needed to continue the stormwater review: 1. As discussed in our meeting, please note on the plans that all roof drains must be directed into the paved areas, or provide swales at the rear of the buildings to pick up this water. 2. The typical building footprints on the plans are neither dimensioned nor noted with the covered decks, uncovered decks, and concrete areas. 3. Please revise the Pond Section Det4il as follows: a. Note the width of the vegetated shelf, and the begin and end elevations. b. Provide a trash rack for the 36" overflow riser. C. The detail of the orifice in the calculations indicates a 6" 90' elbow, but the riser detail on the plans indicates only a 2.5" hole in the riser. If .you choose to use the 2.5" hole in the riser, as currently depicted, then you need to specify a trash rack that can extend over the orifice. d. Include the forebay in the section detail. e. The impervious area breakdown does not add up to the 259,939 square feet you show. All you did was revise the total. Please indicate the correct breakdown to reach the new total. 5. The orifice size is based on the actual volume provided in the pond between the permanent pool and the design pool. Since you have set the overflow at 31.75, the storage volume is in excess of 41,046 cubic feet. Please reevaluate the orifice size using the volume provided. Please note that this request for additional information is in response to a preliminary review. The requested information should be received by this Office prior to December 13, 1997, or the application will be returned as incomplete. The return of a project will necessitate resubmittal of all required items, including the application fee. The chloride content was sampled 1/2 mile as the crow flies, and concentration was found to be 18.7 ppm (See enclosed letter to Rick Shiver dated Sept. 3, 1997) 2. I've been advised by Charles Rawls, the "accessory use" has been defined as "playground" and we have only grassed areas, hence no impervious areas. 3. A signed Pond Maintenance Plan has been attached hereto. 4. Charles Rawls, RLS is the surveyor on this project and he has affirmed that there are NO 404 wetlands on this tract. 5. We have detailed the cross -sectional areas which were requested, ie, the bottom, top, 6:1 shelf, 3:1 slopes, 2:1 slopes, forebay, etc. 6. The outlet structure detail is also included herein. The apparatus is a pipe elbow, 6 inches diameter, field fit and fabricated for installation. 7. The permanent pool dimensions are shown on the plan. 8. The calculations reflect 259,939 square feet total impervious area as as calculated by Charles Rawls, RLS. 9. The minimum depth of the pond will be 5.0 feet. 10. Calculations for the drawdown are included on another sheet attached hereto. 11. All backslopes above the permanent water level are 3:1 maximum. 12. The runoff from the entrance road has been altered to capture the runoff as requested. 13. There are no swales (only those in the immediate vicinity of the yard inlet). 14. A preliminary review of that information has determined that the application is not complete. The following information is needed to continue the stormwater review: ✓ 1. This project drains to SA waters. Please provide the results of a chlorides test taken at a point in the receiving waters that is 1/2 mile as the crow flies from the proposed discharge point. The sample must be taken after 3 days without rain. Assuming that the sample comes back at less than 500 ppm, the remaining items to be addressed follow. 2. What type of pavement does the area labelled "Accessory Use" at the end of cul-de-sac have? Please remember that any area used for parking or subject to vehicular traffic is considered impervious. The calculations use 248,069 square feet in determining the pond size, the application lists 253,148 square feet, and my calculation indicates 255,000 (including "Accessory Use" area). Please check your calculations and revise accordingly. 9. If you must work backwards to see if the available surface area in the pond will meet the required surface area, please choose a depth from the chart of either 3.5 or 4, not 3.8. 10. Most engineers calculate both the 2 and 5 day drawdown orifice sizes and choose a readily available stock size in between such as 1.25", 1.5", 1.75" etc. Specifying a 2.66" orifice seems a little unnecessary when a stock size of 2.5" would do the job just fine. Additionally, the head used in the orifice calculation is an average head measured from the design pool elevation to the center line of the proposed orifice. 11. The road detail indicates cut/fill slopes of 2:1. The regulations require all vegetated slopes to be 3:1 or flatter. Please revise. 12. It appears that runoff from over 9,000 square feet of entrance road is allowed to leave the site untreated. Please pick up this runoff and get it to the pond. 13. Where are the graded swales that are referred to on the application that pick up runoff? The grading plan does not indicate any swales. 14. Delineate, label and dimension the permanent pool Please note that this request for additional information is in response to a preliminary review. The requested information should be received by this Office prior to October 11, 1997, or the application will be returned as incomplete. The return of a project will necessitate resubmittal of all required items, including the application fee. Erosion Control Details August 12, 1997 Pirates Cove Swansboro Township, Onslow County, North Carolina NARRATIVE: This property is approximately 11 acres, located on SR 1509, directly across the Queens Creek Road from the new Swansboro High School in Onslow County. Access to the property is via a 50 foot wide R/W as shown on enclosed maps. The project is within the City Limits of Swansboro and therefore within the Swansboro Planning Board jurisdiction. The owner of the tract is: Pirates Cove, LCC % L.E.McNeill 601 Peletier Loop Road Swansboro, North Carolina 28584 Phone No. 919-393-8058 All of the tract will be disturbed, approximately 10.5 acres. Since the tract has a 1% grade naturally, significant fill is required to provide proper drainage. A check is enclosed herein for two hundred thirty dollars ($ 230.00). The development plans include construction of a street system as shown on the attached maps. The entrance road is 50 feet wide. The usual DOT requirements will be met with regard to horizontal and vertical alignment. Application has been made for an entrance permit from SR 1509. The flood map indicate all of the property is in a Zone C. (See FIRM Map No. 370340-0360 C (Dated 07-02-87) Onslow County, N.C.). Adjacent Property: The property is located southwest of the new Food Lion on NC 24 near the SR 1509/NC 24 intersection. All other adjacent property in the vicinity is residential or agricultural use. Soil Conditions: This property is shown on an enclosed sheet of the Onslow County Soils Map ( USDA ). It is predominately Onslow Soils ( loamy fine sand ), characterized by nearly level, moderately well drained soil. Part of the tract under consideration is classified as Rains ( fine sandy loam ). These areas are nearly level poorly drained soils on uplands. Development Notes: The owner intends to clear the site, add fill as required to meet design grades, excavate the detention pond, construct streets, building pads, and associated site work to effect the drainage plan. Application for a driveway connection has been made to the Department of Transportation. There is a requirement for 60 lineal feet of 18 inch diameter reinforced concrete pipe in the gutter line at the entrance to the property. Planned Sedimentation and Erosion Control Practices 1. 2. 3. 4. 5. Construction Entrance: A typical construction entrance shall be constructed at the entrance to the property as detailed. Silt Fence: This measure is planned for the entire perimeter. The contractor shall exercise caution to ensure proper installation. No site fence is to be installed in ditch lines or at pipe outlets, etc. Temporary Sediment Basin: The wet detention basin will be over excavated to provide for 19,800 cubic yards of storage for temporary sediment. Yard Inlet Protection: There shall be rock/filter devices installed to ensure silt is restricted from entry to the pipe system (See plans). Block and Gravel Inlet Protection: At each catch basin and drop inlet, sediment will be restricted by the use of block and gravel devices prior to vegetation stabilization at the site. File: PiratesCover.S&E CONSTRUCTION SEQUENCE 1. Obtain Sedimentation and Erosion Control Plan Approval before any other land disturbing activities begin. 2. Install construction entrance and pipe at SR 1509 (see detail). 3. Begin clearing operations in roadways, remove vegetation, pile and burn debris if permitted (haul to approved disposal site if burning is prohibited). 4. Install any sediment control measures where practical as construction progresses. Pay particular attention to silt fences (first measure). 5. Excavate detention pond/sediment basin as detailed, exercising care to store material for drying in an .area (which is protected by silt fence or swales), while not allowing sediments into adjacent areas. 6. Grubbing and grading shall be done carefully only if the project is protected so any sediment runoff stays on site. 7. Install utilities (water, sewer, electrical lines, telephone, cable) Install protection devices to retain silt from interior of all pipes. 8. Careful coordination is required to install all transmission pipes while other work may be progressing. 9. Haul additional fill material to site for building pads etc. 10. Fine grade streets, parking areas and building pads. 11. Apply seed, fertilizer and mulch (mulch all slopes of 4:1 or greater). 12. Install marl street base (6" minimum compacted depth of CABC). 13. Install I-2 asphalt paving on streets and parking. 14. Dress all bare areas, remove any remaining root mat etc, and reseed as necessary to provide vegetative ground cover. NOTE: Any area brought to final grade shall be seeded or sodded upon completion. SEEDING SPECIFICATIONS Chisel topsoil and scarify if necessary to prepare seed bed. Rip the entire area at least 4 inches deep. Remove all rootmat, debris or foreign material, leaving surface reasonably smooth and uniform. Apply agricultural lime, (in absence of soil test, 3,000 lbs per acre) fertilizer (10-10-10at a rate of 500 - 1,000 lbs/acre) and mix with soil. Apply seed on freshly prepared bed and cover seed slightly with cultipacker or other seeding equipment. Mulch immediately w/ wheat straw or hay (at a rate of 4,000 lbs per acre). Crimp mulch with anchoring equipment or with disk set generally straight. Inspect all seeded areas and make necessary repairs or reseeding within the planting period. Inspect annually and drain the basin to remove accumulated sediments. 7. DEED RESTRICTION REQUIRENIENTS The following statements must be included for all low density projects, and for all subdivisions: No more than N.111 square feet of any lot, including that portion of the right-of-way between the edge of pavement and the front lot line, shall be covered by impervious structures, including asphalt, gravel, concrete, brick, stone, slate or similar material, not including wood decking or the water surface of swimming pools. ?his covenant is intended to ensure continued compliance with the stormtivater permit issued by the State of North Carolina. The covenant may not be changed or deleted without the consent of the State. No one may fill in or pipe any roadside or lot -line swale, except as necessary to provide a minimum driveway crossing. For curb outlet system projects, no one may pipe, fill in, or alter any lot line s►vale used to meet North Carolina Stormwater Management Permit requirements. NOTE If lot sizes vary significantly, the owner/developer must provide an attachment listing each lot number, size, and the allowable built -upon area for each lot. V. DEED RESTRICTIONS AND PROTECTIVE COVENANTS Deed restrictions and protective covenants are required to be recorded for all low density projects and all subdivisions prior to the sale of any lot. Please see Attachment A for the specific items that must be recorded for the type of project applied for.
