Description of projects area and activity: The applicant, Charlotte -Mecklenburg Storm Water Services and Wildlands Engineering, Inc has requested a Department of the Army authorization to discharge dredged and/or fill material into waters of the U.S. in conjunction with the Charlotte -Mecklenburg Storm Water Services UMBI — Long Creek Corridor Stream and Wetland Mitigation Site (Bank). Project activity will involve the aquatic restoration of 2,292 linear feet (If) of stream channel and wetland restoration of 14.07 acres of wetland. Implementation of the proposed restoration and enhancement activities will result in the discharge of fill material into 0.596 acres of wetland (0.518 acres temporary impact and 0.078 acres permanent) and 3,426 linear feet of stream channel (3,258 LF permanent impacts and 168 LF temporary impacts), in conjunction with the mechanized land clearing, excavation, and stream relocation activities for the Bank. Refer to the below Table 1 for a detailed summary of impacts. Any violation of the attached conditions or deviation from your submitted plans may subject the permittee to a stop work order, a restoration order, a Class I administrative penalty, and/or appropriate legal action. This verification will remain valid until the expiration date identified below unless the nationwide authorization is modified, suspended or revoked. If, prior to the expiration date identified below, the nationwide permit authorization is reissued and/or modified, this verification will remain valid until the expiration date identified below, provided it complies with all requirements of the modified nationwide permit. If the nationwide permit authorization expires or is suspended, revoked, or is modified, such that the activity would no longer comply with the terms and conditions of the nationwide permit, activities which have commenced (i.e., are under construction) or are under contract to commence in reliance upon the nationwide permit, will remain authorized provided the activity is completed within twelve months of the date of the nationwide permit's expiration, modification or revocation, unless discretionary authority has been exercised on a case -by -case basis to modify, suspend or revoke the authorization. Activities subject to Section 404 (as indicated above) may also require an individual Section 401 Water Quality Certification. You should contact the NC Division of Water Quality (telephone 919-807- 6300) to determine Section 401 requirements. For activities occurring within the twenty coastal counties subject to regulation under the Coastal Area Management Act (CAMA), prior to beginning work you must contact the N.C. Division of Coastal Management in Morehead City, NC, at (252) 808-2808. Per the request by the Permittee, this authorization is provided for construction activities that will be undertaken concurrently with the Long Creek Greenway Phase 2 Project, which is not for mitigation credit, prior to finalization of the Long Creek Water Quality Improvement Project Site Specific Mitigation Plan (SSMP). Accordingly, this authorization does not imply approval of the Draft SSMP and all activities undertaken as part of this authorization are done so at the Permittee's risk. Further, this permit authorization does not imply suitability of this project for compensatory wetland mitigation for any particular project. The use of any portion of this site as compensatory mitigation for a particular project will be determined during our public interest review and 404 (b) (1) Guidelines analysis during the permit review process. 2. If work within suitable habitat for Schweinitz's sunflower extends beyond the expiration of the botanical survey (August 26, 2023), additional surveys will be required and must be conducted during the seasonal window. 3. This Nationwide Permit verification does not imply suitability of this property for compensatory mitigation for any particular project. The use of any portion of this site as compensatory mitigation for a particular project will be determined during the permit review process for that project. Table 1.
