On January 5, 2023, the Division requested additional information in order to continue our review and received responses from your consultant on March 3, 2023, and March 6, 2023. Upon review of the response the Division has determined that your application is still incomplete and cannot be processed at this time. The application is on -hold until all of the following information is received: The response to request 2 in the Division's January 5, 2023 request for additional information was not fully addressed. The updated memo provides modeled velocity cross -sections for given discharge events across the bypass channel, however, no data were provided for the wave feature, adjacent streambank, or the downstream reach. Please provide predicted velocities associated with the wave feature and adjacent streambank both at the wave feature and downstream. 2. Based on the narrative description of the mud play area, it appears the feature could be relocated away from the unnamed tributary thereby avoiding any degradation of the stream channel and streambanks. Please revise the plans to relocate the mud play area to another area of the site or explain why relocation is not feasible/practicable. 3. Please provide a hydraulics study/analysis that demonstrates the culverts proposed for the temporary low-water stream crossing during Phases 3 and 4 can adequately convey flow under which work will be conducted, which appears to be approximately 3,500 cfs per the High Water Guidance for In -Stream Construction document. The analysis should include additional details regarding the temporary low-water stream crossing including number and size of proposed culverts. The plans included with the initial submittal depicted construction access to the cofferdam associated with the bypass channel from the left -descending streambank. The revised plans received March 3 and 6, 2023, depict construction of the cofferdam associated with the bypass channel solely from the right -descending bank via a temporary low-water stream crossing that spans approximately two thirds the width of the French Broad River. Based on the response to the Corps' comments, the Division understands that the Town of Woodfin has not secured an access agreement with Norfolk Southern to access the river -left side of the project. The Division is extremely concerned with the feasibility/constructability of the wave and bypass channel without access to the left -descending bank of the French Broad River. A portion of the project is planned to tie-in to the left -descending bank apparently within the Norfolk Southern easement. In addition, it appears that erosion and sediment control measures are proposed within the easement. Please explain how the Town of Woodfin plans to construct a portion of the bypass channel in the Norfolk Southern easement without their authorization. 5. The Division has been unable to find any details for the downstream boat ramp in either the initial submittal or the additional information received March 3, 2023, or March 6, 2023. Please provide construction details for the downstream boat ramp or note the sheet on which the details were provided in a previous submittal. 6. Please provide an estimated construction timeline for each in -river phase. Pursuant to Title 15A NCAC 02H .0502(e), the applicant shall furnish all of the above requested information for the proper consideration of the application. Please respond in writing within 30 calendar days of receipt of this letter by sending one (1) copy of all of the above requested information to the 401 & Buffer Permitting Branch, 1617 Mail Service Center, Raleigh, NC 27699-1617 OR by submitting all of the above requested information through this link: https://edocs.deg.nc.gov/Forms/Supplemental-Information-Form (note the DWR# requested on the link is referenced above). If all of the requested information is not received within 30 calendar days of receipt of this letter, the Division will be unable to approve the application and it will be denied as incomplete.
