(0.08 acres) (E) Primary Nursery Area: Yes (F) Water Classification: SA; HQW Open: No PROJECT SUMMARY: The applicant proposes a major modification to State Permit No. 109-21 to construct a new bulkhead landward of coastal wetlands on the newly acquired lot (108 SW 1 Oth), to demolish and reconfigure an existing docking facility with the addition of a boathouse, retain an existing docking facility, add two additional access piers, resulting in an increase of 3 additional slips for a total of 7 slips along Davis Canal. PROJECT DESCRIPTION The proposed project is located at 107/109 SW 91h Street and also 108 SW 1 0th Street, which are neighboring lots at the Davis Canal in Oak Island, Brunswick County. The property at 107 and 109 SW 91h was formerly two parcels and were combined into one larger lot. Please note: The applicant was issued major permit 109-21 in 2021 to reconfigure one of the existing docking facilities on the SW 91h property and increase the slip count to 6 total slips, however this work has not been performed. Since the issuance of that permit, the applicant has acquired an additional neighboring property, at 108 SW 1 Oth street, and wishes to incorporate that property into this current proposal. The applicant is seeking a major modification of permit 109-21 to incorporate the new property, add additional accesses and slips, and construct a new bulkhead. The project site is vegetated primarily with grasses, shrubs, and mature trees. The high ground portion is elevated approximately 7'-17' above the normal high water (NHW) level. The property at SW 91h street has approximately 120 LF of shoreline, which is stabilized by an existing bulkhead. There are coastal wetlands (Spartina alterniflora) within the riparian corridor of the applicant's property between the canal and existing bulkhead (approximately 12%16' in width). The newly acquired property at 108 SW 10'h street has an additional 60 LF of shoreline and is not currently stabilized. The applicant's property is situated on Davis Canal, bordered by residential properties to the west and north, and SW 9th Street (town property) borders to the east. The width of the canal measures approximately 100' feet at the proposed project site. Existing structures on the project site include a single family residence and two separate private two slip docking facilities (4 slips total). . The applicant plans to demolish, reconstruct, and reconfigure the westernmost docking facility. The applicant plans to retain the easternmost docking facility as -is, with no proposed changes. The existing eastern docking facility consists of an access pier (4' x 3') extending from the bulkhead, and transitions to a fixed platform (12' x 12'). From the southern edge of the fixed platform, a gangway extends waterward to an existing floating dock (8' x 16') that is oriented parallel with the shoreline. To the west of the floating dock, there is an existing boat lift (12'xl2'). Currently, the eastern docking facility serves as two slips (See Location Map page 2 of 4). The waters of the canal system are classified SA by the Division of Water Quality and ARE designated as a Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries. They are CLOSED to the harvest of shellfish. Based on visual observations made by DCM staff during the March 2021 site visit, there appears to be NO Submerged Aquatic Vegetation (SAV) in the surrounding waters. The water depths range from -3.0 @ NLW on the landward side of the proposed features to -5' @ NLW on the waterward end of the proposed features. PROPOSED PROJECT The applicant proposes a major modification to State Permit No. 109-21 to construct a new bulkhead landward of coastal wetlands on the newly acquired lot (108 SW loth), to demolish and reconfigure an existing docking facility with the addition of a boathouse, retain an existing docking facility, add two additional access piers, resulting in an increase of 3 additional slips for a total of 7 slips along Davis Canal. The easternmost docking facility, described in the section above, will be retained as -is, with the existing features serving as slips 1 & 2 (see Location Map Page 2 of 5). Approximately 35' to the west, the applicant is proposing to construct a fixed finger pier (3'wide x 40'long) extending to the south from the bulkhead. To the immediate East and West of the proposed fixed finger pier, the applicant is proposing a construct a boat lift (13' x 13') on each side, serving as slip #3 and slip #4 (See Location Map page 2 of 4). Approximately 40' to the west of the previous finger pier, the applicant is proposing to construct a fixed access finger pier (4' x 40'), extending to the south from the bulkhead. To the immediate east of this proposed finger pier, the applicant is proposing to construct a floating dock (8' x 16') oriented parallel with the shoreline, serving as slip # 5. To the immediate west of this proposed finger pier, the applicant is proposing to construct a fixed covered boathouse (roof dripline 27' x 28') which would contain two proposed boatlifts (13' x 13'), Greene Docking Expansion and Bulkhead Major Modification February 9, 2023 Page 3 serving as slips 6 &7. On the newly acquired property at 108 SW loth street, the applicant is proposing to install 60 LF of vinyl bulkhead, located landward of the Coastal Wetlands, which would tie into the existing bulkhead at the SW 91h property. Approximately 19' from the southeastern property corner of 108 SW 1 Oth, the applicant is proposing to extend a fixed access pier, extending to the south from the proposed bulkhead, then turning east, and back south to flank the proposed boathouse, for a total of 53' in length (See Location Map 2 of 4). No portion of the proposed constructed features will extend into the adjacent riparian corridor setback of the neighbor to the west. The existing easternmost docking facility (to be retained as is) is located in the setback for the eastern neighbor however no new work is being proposed there. The application states that existing water depths in the vicinity of the proposed constructed features would range from approximately -3.0' to -5. P @ NLW. Water depths were verified by DCM staff. As proposed, the constructed features would be located within the established pier head line and within '/4 of the width of the waterbody. 10. ANTICIPATED IMPACTS The proposed docking facility would incorporate approximately 1631 sq. ft. of Estuarine Waters and Public Trust Area, and shade 219 SF of Coastal Wetlands. The docking facility would remain consistent with the pier head line, and be consistent with the '/4 width of the waterbody. The proposed docking facility would not encroach into the 15-foot riparian corridor setback of the western property owner. The proposed bulkhead would disturb 1800 SF of upland area within the Estuarine Shoreline. Minor increases in turbidity should be expected during piling installation. The square footage of the proposed docking facility is calculated as follows: Shoreline length =180 ft. x 8 sq. ft. = 1440 sq. ft. allowable. Wilmington NC 28405 RE: (Project Narrative) 107/109 SW 91h Street Oak Island, NC 28465 The Owner of 107/109 SW 9th Street & 108 SW 1011 Street on Oak Island NC, would like to submit a major modification for a project they permitted through previously approved major permit dated May 6th 2021. The reason for the modification is due to the acquisition of the adjacent lot (108 SW 101h Street/Lot 10) since the initial permit, which provided them additional shoreline in order to include covered boat lifts at their property in place of a covered sitting area approved by the recent major permit. Previously 107/109 SW 91 Street lots were separate lots. As such there are two separate docking facilities onsite, they have since been combined. For the purpose of discussion, the existing docking facilities can be described as western docking facility and eastern docking facility. As part of the proposed work the western docking facility is proposed to be demolished and removed. The eastern docking facility is proposed to remain. The eastern facility consists of two boat slips (slip 1 and slip 2) as listed on the site plan. Slips 3 & 4 consists of proposed boat lifts. Slips 3 & 4 will be accessed by the proposed 3' wide pier. Slip 5 consists of a floater installed parallel to the channel next to 4' wide pier, which will be accessed from 4' wide pier. Slips 6 & 7 consists of proposed covered boat lifts, which will be accessed from the 4' wide pier on the east and the neighboring 6' wide pier on the west. Covered boat lifts will be 27'x28' from edge of dripline to edge of dripline. A bulkhead was already installed on 107/109 SW 9" Street prior to owners purchasing those two lots. Owners would like to extend 60 linear feet of bulkhead on the 108 SW 10" Street lot. The project is located in PNA. Sea Dog has confirmed that water depth of greater than 2' at low tide will be achieved for proposed structures. The lots have approximately 180 linear feet of water frontage. Setback waivers are not needed for either neighboring property. Sea Dog Marine Construction has conducted a detailed site visit to confirm the site plan attached with this narrative. Construction will take place on the water by barge. The barge will be spudded in place during construction at the project site.
