We are also transmitting this report to you electronically. The report follows the format of earlier reports and includes a narrative section with background and program progress reports along with spreadsheets detailing the IBT amount calculation. For calendar year 2007, we experienced an actual maximum day IBT of 17.22 mgd based on September billing data and as of December 31, 2007, had additional outstanding IBT commitments of 3.56 mgd. The summation of these amounts would indicate a 2007 IBT amount of 20.78 mgd which is less than 63% of our authorized amount. Please let me know if you have any questions. Gullet, PE Deputy Director Page 2 of 6 Charlotte-Mecklenburg Utilities Annual Report on Interbasin Transfer Calendar Year 2007 Charlotte Mecklenburg Utilities (Utilities) operates the water and wastewater systems that serve Charlotte, Cornelius, Davidson, Huntersville, Mint Hill, Matthews, Pineville, and much of the unincorporated areas of Mecklenburg County. This system is divided between two river basins designated by NC General Statutes for regulation of interbasin transfer (IBT) of water. The western portion of the system is within the Catawba River basin and the eastern portion is within the Rocky River basin. Water transferred from the Catawba River basin to the Rocky River basin that is not returned to the Catawba is regulated IBT. The North Carolina Environmental Management Commission (EMC) approved Charlotte Mecklenburg Utilities’ petition to increase the amount of water transferred from the Catawba basin to the Rocky River basin and an IBT Certificate was issued on March 14, 2002. The Certificate authorizes Utilities to transfer up to 33 million gallons per day (mgd) from the Catawba River basin to the Rocky River basin. Water for distribution to Utilities’ customers is withdrawn from the Catawba River basin at two locations. An intake at Lake Norman sends water to the Lee S. Dukes Water Treatment Plant. A second intake at Mountain Island Lake sends water to the Walter M. Franklin Water Treatment Plant and to the Vest Water Treatment Plant. Potable water from these three plants is delivered through an interconnected distribution system to retail customers throughout Utilities’ service area in Mecklenburg County, in small areas of Iredell, Cabarrus, and Union Counties, and to other municipal systems including York County, S.C. Lancaster County (S.C.)Water and Sewer District, and Union County. Utilities treats wastewater at five advanced wastewater treatment plants (WWTP’s) which discharge into small streams in Mecklenburg County. Four of the streams are tributary to the Catawba River basin and one (Mallard Creek) is tributary to the Rocky River basin. Utilities also conveys wastewater generated in portions of Mecklenburg to the Rocky River Regional Wastewater Treatment Plant (RRRWWTP) operated by the Water and Sewer Authority of Cabarrus County (WSACC). The RRRWWTP discharges treated effluent to the Rocky River. Utilities can transfer treated potable water to the City of Concord through three metered connections to their water system. All of Concord’s service area is within the Rocky River basin, so any water purchased by them becomes an IBT. Water service is only provided as an emergency back-up to Concord’s routine supply which is Lake Howell and several smaller reservoirs. All of these reservoirs are within the Rocky River basin. Wastewater from Concord is treated at the RRRWWTP. Utilities’ agreement with Concord is that water will be supplied to them subject to availability and subject to regulatory constraints including IBT and Federal Energy Regulatory Commission (FERC) limitations. Page 3 of 6 Concord received an IBT Certificate in January 2007, for the transfer of up to 10 mgd from the Catawba River basin to the Rocky River basin. NC DWR advised Utilities that water sold to Concord should not be applied to Utilities’ IBT amount. Concord did not purchase any potable water from Utilities in calendar year 2007, so the IBT amounts reported do not include sales to Concord. The IBT Certificate requires Utilities to report maximum daily IBT amounts annually to the North Carolina Division of Water Resources until such time as the transfer amount exceeds 80% of the authorized amount. Once that amount is exceeded, Utilities is required to report monthly. To date, Charlotte-Mecklenburg Utilities has not exceeded 80% of the authorized IBT amount. Table 1 below summarizes actual IBT amounts for calendar years 2002 through 2007 (all calculated using the new methodology approved by N.C. DWR in June of 2006). The table considers the daily amounts of water transferred from the Catawba basin to customers within the Rocky River basin that is not returned to the Catawba basin. The data indicates that the maximum amount of IBT for year 2007 occurred in September, and was 17.22 mgd, or 52% of the authorized maximum day value of 33 mgd. The average IBT for 2007 was 9.96 mgd, which is about 30% of the authorized maximum day value. In addition to the amount of actual IBT reported in Table 1, Utilities has committed to provide additional IBT to development that has been proposed but not yet activated in the Rocky River basin. As of December 31, 2007, 1.39 mgd was committed to permitted donated projects (subdivisions) that had not been activated and 2.17 mgd was committed to master meter connections (generally commercial or multi-family developments) that had not been activated, both based on maximum day estimates. This brings the total of the actual and outstanding IBT in 2007 to 20.78 mgd, or 63% of the authorized maximum day value. Table 1. Actual IBT Summary Calendar Year Avg. Annual IBT (mgd) Max. This summary follows: The watershed management approaches of the Surface Water Improvement and Management (SWIM) Program continued to be implemented during calendar year 2007. Page 4 of 6 Efforts focused on McDowell Creek in the north and Goose Creek in the south, which were the 2 watersheds identified for restoration as a result of the prioritization completed for the 22 watersheds in Mecklenburg County during 2006. McDowell Creek drains to Mountain Island Lake, which is the primary drinking water supply for Charlotte-Mecklenburg. Significant land development in this watershed has resulted in an increase in non-point source pollutant loads. Therefore, this watershed has been assigned a high priority for restoration. Goose Creek is home to a federally listed endangered species of freshwater mussel called the Carolina Heelsplitter. The primary threat to the survival of the Heelsplitter is storm water runoff from land development activities; therefore, this watershed has been given a high priority for restoration. During calendar year 2007, the following work was completed in the McDowell Creek watershed: 1. Continued to update and refine the McDowell Creek Watershed Management Plan for the purpose of restoring degraded water quality conditions. 2. Grant application for $750,000 submitted to the N.C. Clean Water Management Trust Fund for a planned stream restoration project in the McDowell Creek Watershed in an area that is ranked as a high priority in the Watershed Management Plan. Mecklenburg County will provide $2,550,000 toward this project, which will include the construction of a greenway along the creek. The total project cost is $3,300,000. 3. Mecklenburg County partnered with the Sierra Club and over 100 volunteers to plant 900 trees along the banks of McDowell Creek over approximately 3 acres. This area was targeted in the Watershed Management Plan as a high priority for restoration of the buffer corridor. 4. Mecklenburg County established a partnership with the Town of Cornelius to conduct two stream restoration projects in the Town’s jurisdiction in the headwaters of McDowell Creek. These stream sections are among the most highly degraded in the watershed and have the highest priority for restoration in the Watershed Management Plan. Preliminary designs for the stream restoration projects are underway. 5. During 2007, design work was completed for the installation of 10 rain gardens into a 60 acre parking lot in the Northcross Shopping Center in Huntersville, which is located in the headwaters of McDowell Creek in a high priority area for the generation of non- point source pollutants. The project was completed in May 2008. In addition to the Northcross Shopping Center project, Mecklenburg County partnered with other private businesses in Huntersville to add a total of 16 rain gardens and wetlands at Carolinas Medical Center-Northcross, Northcross Commons, NorthPointe Executive Business Park, and in the Monteith Park residential subdivision. Known as the McDowell Best Management Practices project, the five sites are all located in the same general location in the headwaters of McDowell Creek. The cost of building the rain gardens and Page 5 of 6 wetlands at the five locations was $1.9 million dollars. Nearly $800,000 of this money came from Storm Water fees paid by Mecklenburg County residents. The remaining $1.1 million was funded through grants from the North Carolina Clean Water Management Trust Fund and North Carolina Division of Environment and Natural Resources. Land was donated by American Asset Corporation, Carolinas HealthCare Systems, Northcross Properties LLC, NorthPointe Realty Corporation, Saussy Burbank, and Sentinel Real Estate Corporation, thanks to partnerships with Harris Teeter, Kohl's, and Lowe's. This is the first of many very large projects planned in the McDowell Creek Watershed. 6. Mecklenburg County is in the planning process for a partnership with the Sierra Club for a Water Quality Summit to be held in 2008 in the headwaters of the McDowell Creek Watershed. The summit will target residents in the area and will focus on buffer plantings, stream cleanups and other activities for restoring water quality conditions in McDowell Creek through the implementation of the Watershed Management Plan. During calendar year 2007, the following work was completed in the Goose Creek watershed: 1. Extensive water quality monitoring was completed and a Water Quality Recovery Program for reducing fecal coliform bacteria levels was developed based off the results of this monitoring. This Water Quality Recovery Program is being rolled into a more comprehensive Watershed Management Plan that focuses on restoring overall water quality conditions in the creek. Condition 2 of Utilities’ IBT certificate requires a report on the stakeholder process to investigate water quantity control from single-family development and water quality control for all development until that process is completed. The condition suggests that the feasibility of single- family detention should be considered along with any needed ordinance revisions. This report follows: In June 2007, post-construction storm water ordinances went into effect in Mecklenburg County and the Towns of Cornelius, Davidson, Huntersville, Matthews, Mint Hill and Pineville. Extensive effort went into training staff and the development community regarding the actions necessary to ensure compliance with these ordinances. In addition, an Administrative Manual, a BMP Design Manual and website were developed to assist in compliance. The ordinances were adopted by the jurisdictions following the completion of a stakeholders’ process that ran from April 2004 through September 2005. The ordinances include a requirement to remove 85% Total Suspended Solids from the first inch of runoff for commercial and residential projects, and an additional 70% Total Phosphorus removal from the first inch of runoff if the project is located in either the Yadkin or Upper Catawba USGS 8-digit hydrologic unit code watersheds. Water quantity elements include controlling Page 6 of 6 the entire post development volume generated by the 1-year 24-hour storm and releasing between 48 and 120 hours, for both residential and commercial developments. In addition all projects must provide peak control for the 10-year 6-hour and 25-year 6-hour storm events, although peak control may be waived for certain projects if a downstream analysis shows no adverse impacts from the development. Implementation of the ordinances has gone very well since their adoption. The adoption and implementation of the post-construction storm water ordinances concludes the processes described in Condition 2. Future annual IBT reports will refer to Condition 2 as having been completed in 2007. Condition 3 of the IBT Certificate removes the Goose Creek subbasin from the area to be served by the IBT, and imposes a moratorium on the installation of new IBT water lines (water lines crossing the ridgeline) into Goose Creek subbasin until the impacts of additional growth on the endangered species are fully evaluated. In 2005, the Southern Environmental Law Center (SELC) requested a Declaratory Ruling from the N.C. Environmental Management Commission relative to Utilities' compliance with this condition. While the EMC declined to issue a Declaratory Ruling, it did direct DWR staff to develop recommendations about IBT measurement and interpretation of Condition 3. Staff’s response (issued June 29, 2006) concluded that Utilities has complied with Condition 3, but confirmed NC DWR’s January 20, 2006, direction to Utilities to impose a moratorium on new water services in the Goose Creek subbasin when total IBT allocations (actual plus committed) to the Rocky River basin reached the grandfathered amount. Utilities suspended acceptance of applications for new water services in the Goose Creek subbasin until the committed IBT amount could be determined. In 2006 and 2007, after the committed IBT amount was determined, interested third parties in the Goose Creek basin requested that NC DWR reconsider the interpretation of the new water services moratorium. The request was for NC DWR to allow the portion of the grandfathered IBT amount that was unused and uncommitted at the time the moratorium was imposed to be used within the Goose Creek basin. NC DWR agreed to the request. As a result, a relatively small amount of water was made available in the Goose Creek basin. With concurrence from NC DWR, Utilities used previous requests to allow proposed developments access to this water in the order the requests had been received. Regarding resolution of the impacts of additional growth on the endangered species, NC Division of Water Quality (DWQ) has proposed a site specific management plan for the Goose Creek basin. The plan proposes to use buffers and other techniques to protect the endangered species from the impacts of growth. It is anticipated that the site specific plan will be approved by the NC EMC in 2008. In anticipation that Mint Hill’s adoption of a post construction stormwater control ordinance and DWQ’s proposed site specific management plan would resolve the issues related to this condition, NC DWR informed the NC EMC on September 12, 2007, that DWR planned to develop an environmental assessment (EA) document to provide a basis for the EMC to consider a modification of condition 3 of Utilities’ IBT Certificate. Utilities and DWR staff developed a plan for how the EA would be developed and processed. As of December 31, 2007, Utilities was preparing to initiate development of the EA according to that Page 7 of 6 plan.As of December 31, 2007, the moratorium on installation of new water mains into theGoose Creek subbasin remained in place. Condition 4 of the IBT Certificate provides that the Environmental Management Commission may reopen the Certificate under certain circumstances. This did not occur in 2007. Condition 5 of the IBT Certificate requires Utilities to develop a compliance and monitoring plan for reporting maximum daily transfer amounts, compliance with certificate conditions, progress on mitigation measures, and drought management activities. Utilities’ monitoring plan and reporting format were approved in June of 2006 by NCDWR and continued to be used for 2007. Due to below average rainfall and above average temperatures, weather conditions in 2007 required the implementation of drought management activities. Based on triggers established in the Low Inflow Protocol (LIP) document adopted by the members of the Catawba-Wateree Drought Management Advisory Group, Utilities (along with other water users required to comply with the LIP) followed water conservation measures outlined in the LIP document. In early August 2007, Utilities’ water customers were asked to voluntarily reduce their water consumption. After several additional weeks with minimal rainfall and above average water consumption, on August 28th the Catawba-Wateree River Basin went into mandatory water restrictions under Stage 2 of the LIP (limiting outdoor water use to 2 days per week). Following another month of hot, dry days, Charlotte-Mecklenburg customers entered into Stage 3 water restrictions on September 26, 2007, (restricting almost all outdoor water use); Stage 3 restrictions continued to be enforced throughout the rest of 2007. Recent calculations show that these water conservation measures were successful in reducing water consumption; residential customers reduced their water use more than 30 percent as compared to their average unrestricted use spanning 2000-2006. In summary, Utilities is in full compliance with IBT authorizations and compliance conditions. The amount of water transferred from the Catawba River basin to the Rocky River basin in 2007 is significantly less than the authorized amount. 2007 IBT Summary Amount Comment Max.
