Aqua North Carolina, Inc. (Aqua) provides the following response to the above -referenced Notice of
Violation and Intent to Assess Civil Penalty, which was issued regarding missing October 2022 Non -
Discharge Monitoring Report (NDMR) and Non -Discharge Analysis Report (NDARI) on November 3011,
2022.
Aqua's Response:
This specific NDMR was mailed the 291h of November to NCDEQ before electronic submitting was
available along with all other Aqua non -discharge facility reports. Aqua has attached a copy of that
NDMR for your records but suggests that NCDEQ staff mishandled the mail. As such, Aqua
recommends that NCDEQ thoroughly consider any application of civil penalty assessments.
