Dear Mr. Benjamin:
Reference is made to the Biological and Conference Opinions, dated June 19, 2014, in
regards to formal Section 7 consultation for the Village of Bald Head Island's shoreline
stabilization proposal, specifically the construction of a 1,900 foot terminal groin in waters of the
United States, at the mouth of the Cape Fear River, on Bald Head Island, Brunswick County,
North Carolina. The proposed project has been assigned Action ID #SAW -2012-00040.
The Rufa red knot was listed as a threatened species on December 11, 2014, after the
completion of the Biological and Conference Opinions for the above described project. In
accordance with 50 CFR 402. 10, the Corps requests the conference opinion for the Rufa red knot
be adopted as the biological opinion and that no further Section 7 consultation is necessary,
unless required by 50 CFR 402.16. The Corps believes that there have been no significant
changes in the action or in the information used during the conference that would alter the
content of the opinion.

Reference your application for renewal of a Department of the Army permit (DA), issued
January 25, 1995, for armoring of existing wooden groins, for property located north of Bald
Head Island, Brunswick County, North Carolina. This permit was last amended in February,
2011 to authorize the replacement of the four wooden groins and their armoring with riprap.
Your proposal has been reviewed and found to be consistent with the provisions and
objectives of the CAMA-Corps Programmatic Permit process (copy attached) for major
development in an area of Environmental Concern and excavation and/or filling that receive
authorization from the State of Nortb Carolina pursuant to NCGS 113A-118 and 113-229.
Therefore, you may commence construction activity in strict accordance with applicable State
authorization, or the approved plan. Failure to comply with the State authorization or conditions
of the Federal permit could result in civil and/or administrative penalties.
If any change in your work is required because of unforeseen or altered conditions or for
any other reason, plans revised to show the change must be sent promptly to this office and the
North Carolina Division of Coastal Management prior to performing any such change or
alteration. Such action is necessary as revised plans must be reviewed and the authorization
modified. Your Department of the Army permit will expire on December 31, 2016.
