Upon review of the Pre-Construction Notification application for the subject tract, the development appears to disturb
more than 1 acre of land, which would require Sediment and Erosion Control Plan and State Stormwater Permit review
and potential permits. Internal discussion with the Division of Energy, Mineral and Land Resources staff, indicate neither
Sediment and Erosion Control or State Stormwater application has not be submitted. In order to satisfy condition 12 of
the attached Water Quality Certification 3890, a stormwater management plan requirements must be met. If you have
