Oreskovich, Director Dare County Water Department 600 Mustian Street Kill Devil Hills, North Carolina 27948 Subject: NPDES Permit Issuance Stumpy Point Reverse Osmosis Discharge Permit No. NC0086932 Dare County Dear Mr. Oreskovich: In accordance with the application for discharge permit, the Division is forwarding herewith the subject NPDES permit for reverse osmosis reject wastewater. This permit is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the U.S. Environmental Protection Agency dated May 9, 1994. The Division of Water Quality received significant comments from the Division of Marine Fisheries (DMF) regarding the potential impact of the discharge into Stumpy Point Bay. The DMF had requests for more extensive monitoring to determine the potential impact to the ecosystem. Based on their concerns and comments, as well as the Division of Water Quality's concerns that limits can be consistently met, the permit has been modified as follows: • The predicted salinity of the discharge is a concern in this area. Predicted effluent values are lower than current values in the area and may have an adverse effect on aquatic life. Because there is uncertainty in predicting the full extent of this type of discharge, instream monitoring for salinity at various areas in the Bay is required. Special Condition A.4. has been inserted into the permit indicating the instream monitoring locations and frequencies. Dare County may request that the Division re-evaluate the instream monitoring requirements after 2 years of data has been collected. • A settleable solids limit has been added to the permit. Should the county demonstrate that there are not settleable solids in the effluent, after one year of data has been collected, the county may request that monitoring for this parameter be reduced or eliminated from the permit. • An additional comment submitted by the DMF pertained to a holding basin or lagoon, sized to hold all effluent flow "until such times that dilution is maximized and impacts are minimized." At this time, the Division of Water Quality is unsure of how long those times would be and when they would be, so this condition has not been added to the permit. However, should the limits not be consistently met, the Division may require that a holding lagoon or other type of treatment be installed at the plant. • The DMF has requested that they be copied on, at minimum, all instream monitoring data. EFFLUENT LIMITATIONS AND MONITORING REQUIREMENTS During the period beginning on the effective date of the permit and lasting until expiration, the Permittee is authorized to discharge from outfall(s) serial number 001- Reverse Osmosis Reject Water. If the turbidity exceeds this level due to natural background conditions, the discharge level cannot cause any increase in the turbidity of the receiving water. 3 The pH shall not be less than 6.8 standard units or greater than 8.5 standard units. 4 Upon sampling for 12 months, the Permittee may request a review of reasonable potential for monitoring and effluent limitations. 5 Acute Toxicity Monitoring (Mysid) 24hr P/F @ 90%, Quarterly: January, April, See Special Condition A(2). THERE SHALL BE NO DISCHARGE OF FLOATING SOLIDS OR VISIBLE FOAM IN OTHER THAN TRACE AMOUNTS. Stumpy Point Reverse Osmosis Discharge NPDES No. NC0086932 A (2). ACUTE TOXICITY PASS/FAIL MONITORING (QRTRLY) The permittee shall conduct acute toxicity tests on a quarterly basis using protocols defined in the North Carolina Procedure Document entitled "Pass/Fail Methodology For Determining Acute Toxicity In A Single Effluent Concentration" (Revised-July, 1992 or subsequent versions). The monitoring shall be performed as a Mysidopsis bahia 24 hour static test. The effluent concentration defined as treatment two in the procedure document will be 90%. Effluent samples for self-monitoring purposes must be obtained during representative effluent discharge below all waste treatment. The tests will be performed during the months of January, April, July, and October. All toxicity testing results required as part of this permit condition will be entered on the Effluent Discharge Monitoring Form (MR-1) for the month in which it was performed, using the parameter code TGE3E. Additionally, DWQ Form AT-2 (original) is to be sent to the following address: Attention: Environmental Sciences Branch North Carolina Division of Water Quality 1621 Mail Service Center Raleigh, N.C. 27699-1 62 1 Test data shall be complete and accurate and include all supporting chemical/physical measurements performed in association with the toxicity tests, as well as all dose/response data. Total residual chlorine of the effluent toxicity sample must be measured and reported if chlorine is employed for disinfection of the waste stream. Should there be no discharge of flow from the facility during a month in which toxicity monitoring is required, the permittee will complete the information located at the top of the aquatic toxicity (AT) test form indicating the facility name, permit number, pipe number, county, and the month/year of the report with the notation of"No Flow" in the comment area of the form. The report shall be submitted to the Environmental Sciences Branch at the address cited above. Should the permittee fail to monitor during a month in which toxicity monitoring is required, then monthly monitoring will begin immediately until such time that a valid test is submitted. Upon submission of a valid test, this monthly test requirement will revert to quarterly in the months specified above. Should any test data from this monitoring requirement or tests performed by the North Carolina Division of Water Quality indicate potential impacts to the receiving stream, this permit may be re-opened and modified to include alternate monitoring requirements or limits. NOTE: Failure to achieve test conditions as specified in the cited document, such as minimum control organism survival and appropriate environmental controls, shall constitute an invalid test and will require immediate follow-up testing to be completed no later than the last day of the month following the month of the initial monitoring. A (3). DISCHARGE SPECIAL CONDITION The effluent diffuser must be designed to prevent surface turbulence and bottom scour. Should the location of the discharge cause visible turbulence within Stumpy Point Bay, the Division may require that the discharge be relocated. INSTREAM MONITORING REQUIREMENTS The following parameter shall be monitored within Stumpy Point Bay (at the locations indicated) 2/month year round. Here's what we are proposing to try to expedite and resolve their concerns (could you please inform your client) : 1) NH3-N monitoring will be required (why are the levels elevated in the groundwater/well tests? - or what is typical) . 2) Salinity values are a concern (freshwater influence in this area and values are currently fairly low) and instream monitoring will be required for this parameter and possibly others(do the permittees currenity have access to or own a boat?) . Also, could you please again give me your RO concentrate estimates for salinity and how you arrived at them? 3) Adding the requirement of a holding tank/equalization basin prior to discharge to provide some opportunity for settling and a more continuous/even flow. What size basin would you estimate? Also, the plans and specs that I received recently for Tyrrell Co. - is the proposed discharge point the same? (I have not yet opened the plans) . I'm still planning to submit this for issuance prior to March 15, but need these items commented on prior to issuance. Please keep in mind that the limits given in the permit are based on water quality standards for saltwaters. We gave no benefit of dilution (the standards are reflected as limits in the permit) for any metal parameters that could be limited. So no matter what the predicted effluent level was-they still received a limit. The same holds true for Tyrrell Co. Ammonia is very temperature and pH dependent (and we have no state WQ standard for it, although we do have freshwater criteria). Their raw water data for Tyrrell Co. was fairly low. I'll look more closely at the federal document on ammonia (although I think EPA was revising ammonia criteria upward). Thanks. In November 2000, we drilled a production well on the treatment plant site that is one of two that will be used for the project. Attached please find the Severn Trent Laboratory analysis of that water. It differs slightly from our original test well that was located about one mile away. Mr. Ian Watson,who is the Dare County consulting engineer for process design, has stated that the pressure filters will not be needed since the iron and turbidity is lower than the original test well. This will reduce our discharge volume by about 4,000 gallons per day (gpd)and also the iron components associated with a pressure filter backwash. Mr.LWatson has also stated that the concentrate stream of(20.5 gpm or 29,520 gpd) will L of elements approximately 2.75 times the feedwater concentration. I have prepared a table for you that contains the projected discharge concentration of the elements analyzed in our raw water. Also attached is Mr. Watson's process flow table. I have highlighted the concentrate/discharge column. In the original permit application, copper and zinc were erroneously circled as additives to the waste stream. Please ignore that delineation. The process waste stream does not contain additives containing copper or zinc. Please accept this correspondence as our response comments regarding the draft permit. Upon receipt,we immediately reviewed the draft Permit with special interest on the"Effluent Limitations and Monitoring Requirements". We are unfamiliar with the recently drilled Stumpy Point production well's quality for the ten"daily maximum discharge limitations"required in the permit. Not knowing what the analyses for those ten contaminants would be,we sent off a sample of the well water the very next day for analyses of the last eight of these ten contaminants listed in the permit. We will not be able to analyze the discharge water for these parameters until the plant is running and the treatment process creates the discharge water. This weighs heavily on our ability to acknowledge and agree with the permit limitations in that we cannot assure you at this time that we will be able to make these"daily maximums"you are requiring. Acknowledging and agreeing to these limits can immediately put us in a position for a violation once the plant begins processing water. We can,though, calculate as best possible the concentration of these contaminants in the discharge from a sample of the raw well water supplied to the RO units for treatment. Based on the design product recovery of the RO process,the concentration of the discharge will be roughly 2.75 times the concentration of the contaminants in the raw well water. The DMF had requests for more extensive monitoring to determine the potential impact to the ecosystem. Based on their concerns and comments, as well as the Division of Water Quality's concerns that limits can be consistently met, the permit has been modified as follows: • The predicted salinity of the discharge is a concern in this area. Predicted effluent values are lower than current values in the area and may have an adverse effect on aquatic life. Because the full extent of this type of discharge cannot be assessed, instream monitoring for salinity at various areas in the Bay is recommended. Special Condition A.4. has been inserted into the permit indicating the instream monitoring locations and frequencies. Dare County may request that the Division re-evaluate the instream monitoring requirements after 2 years of data has been collected. • A settleable solids limit has been added to the permit. Should the county demonstrate that there are not settleable solids in the effluent, after one year of data has been collected, the county may request that monitoring for this parameter be reduced or eliminated from the permit. • An additional comment submitted by the DMF pertained to a holding basin or lagoon, sized to hold all effluent flow "until such times that dilution is maximized and impacts are minimized." At this time, the Division of Water Quality is unsure of how long those times would be and when they would be, so this condition has not been added to the permit. However, the Division does have continued concerns that this wastewater may not consistently meet the limits presented in the permit. Should the limits not be consistently met, the Division may require that a holding lagoon or other type of treatment be installed at the plant. • The DMF has requested that they be copied on, at minimum, all instream monitoring data. The county will tap into the deep Yorktown aquifer. The proposed plant will ultimately discharge approximately 43,200 gpd to be discharged to Stumpy Point Bay. Data was collected a mile from the proposed wells and a predictive model was used to determine the potential parameters of concern and their concentrations. Due to the elevated chloride levels, the engineer states that land application is nota feasible option (plus, loading rates would be restrictive). Connection to a P.OTW is not feasible due to the distance. Discharge appears to be the most economically feasible, environmentally sound alternative as long as limits are are attained. The outfall is proposed to be installed 100 ft. from shoreline with a diffuser attachment. The engineer states that the outfall/discharge will not cause surface turbulence o.r bottom scouring. This RO facility proposes no treatment of the reject water; most other existing ROs have no treatment. The Division does have concerns about the ability to consistently achieve limits imposed in the permit. Due to the limited discharge options and the need for potable water in the county, discharge appears to be the only option at this time. Please find attached an Engineering Alternatives Analysis (EAA) for the above referenced project as requested. 2. In January 1998, a test well was drilled for this project. The test well was drilled approximately 8,000 feet from the present plant site location. Appendix D of the Preliminary Engineering Report(PER) contained in the EAA contains maps which illustrate the location of the test well site and the present RO plant site at the intersection of N.C. Highway 264 and SR1100. Appendix E of the PER contains the test well data including the driller's log and water quality analysis. Two water bearing stratas were found in the test well. Based on a review of the parameters, the RO plant design was based on obtaining the water source from the deeper aquifer at 260 feet. This test well data was utilized with computerized modeling for RO plant design to determine the concentrate parameters. Wilson HUA No.: DR0004—Permits December 4, 2000 Page 2 The discharge flows are based on 38,880 gallons per day from the RO concentrate and 4,320 gallons per day from the iron removal filters. There are two iron removal filters that backwash once a day each. Each filter will backwash at a rate of 75 gallons per minute for approximately 30 minutes for each filter. This water will be blended with the RO concentrate water. Water to backwash the iron filters will be treated water; therefore, the backwash water from the filters will primarily consist of iron removed during the treatment process. 3. As seen in the raw water quality data, the raw water quality for copper is 0.98 ppb and 0.28 ppm for zinc. These quantities are concentrated approximately 2.6 times in the discharge concentrate stream. The projected concentrate parameters included with the NPDES application indicate a copper concentration of 2.6 ppm. This was a typographical error in the application and should be 2.6 ppb. This is slightly under the North Carolina's action level water quality standards for copper which is 3 ppb. The discharge parameter for zinc is 80 ppb which is also slightly under the maximum allowable which is 86 ppb. The projected pH for the concentrate discharge as listed in the NPDES permit application is between 8.5-9.0. The raw water quality data determined pH to be 8.68. This is slightly above the action level of 8.5. It is pointed out that Dare County is in the process of drilling a test well on the proposed plant site which will be used for the final production well. We have been informed that the results for both copper and zinc are below the detection limits of 0.02 ppb and 0.02 ppm, respectively. The new pH level is 8.12 which is in the acceptable range. 4. The water depth throughout Stumpy Point Bay is 3 feet. There is a dredge channel of depth 7 feet for boaters from Lake Worth into the Pamlico Sound; however,this channel is approximately 5,000 feet from the discharge location. Based on our past experience with the Cape Hatteras RO plant, the discharge header design will not present a problem with surface water turbulence or bottom scouring with a depth of 3 feet. Susan A. I have dicussed thedischarge points with the engineering firm prior to the submittal and it appears they did not believe me. There is no alternatives to discharge at these locations in my opinion. They're both from Hobbs, Upchurch & Associates (HUA). Mark provided spec limits for both plants earlier; however, the applications don't match the specs he provided to HUA. • The Tyrrell County application is for an R.O. plant, at a different location (further downstream, apparently) from the spec request. The spec request was for a conventional WTP. The specs Mark prepared are probably no help for this application. • The Dare County application is for a plant with much higher reject flow than the specs allow. As the Dare County site discharges to an SA water, I don't know if the specs Mark prepared can be changed. According to Eric Weatherly of HUA, Dare County needs a "response" from us by July 7th or they lose $4 million in grant funds to build the facility. (The grant was awarded on March 11th and no application was submitted to us until the end of May, but that's a separate issue). At Eric's behest, I talked to Tony Chen in Public Water Supply. Tony says that we only need to agree (or disagree) in general terms to the request in order for his folks to either award a construction permit or deny it. We don't need to provide a(draft or final) NPDES permit,just an indication of whether or not one will be issued. I told him I didn't know if we could do that, given the lateness of the submission from HUA and the departure from the spec limits that were provided. There is grant money tied to the Tyrrell County request also, but no "deadline" has been communicated to me by the applicant or HUA.
