On March 4, 2015, I cond�tcted an onsite review afinf'ormation prov�ded by ECS
Caa�alinas, LLP (EC�) regardi�g the presence/absence of waters and/or wetlands of tlie
US anc� federatly listed species an the borrow/waste sites related to DOT P�•aject U-
2524C. Also presant duz•ing the review were Biil Snell (Asst. Resident Engineer) with
NCDOT and Brian Harvey (P�oject Manager, Vecellio and Grogan, Inc.). The ze�art
references s�tes Iacated on t�e south side o�Fiemir�g Road neaa• the intersection of
Lewiston Road, specifically, A�•ea No. 3 within NCDOT Parcel 1. An unnamed tributary
to Hoisepen Creek and a�onc� are located aiong the soUtheastern portion of #he pareel.
The contractor is �o sufficiently flag a minimut� 50 ft buffer from the �eadwatexs of the
stream and both sides of the strearn as agr�ed upon and located during tl�e onsite
investiga#ion. No clearing, grubbing, flIir�g ar a�y type of bottom disiurbing activity is to
take pIace withu� ihe flagged buffer. In addition, there shal� be no cfl;�centrated flow a�
starmwaier enteriaig ti�e buffe� ed area. Diffi�se flow must be obtained prior ta any run-off
reaching tke buffered area.
All work shoutd be perfozmed according to the z•e-submit�ed pians and draw�ngs
r�ceived by this affice via e-mail on March 4, 2015. Tf you have any questions or

Gree�sboro, Guilford County, North Garolina. The site is [dentifed as Gui!(ord County Parcel
Identit[cafion Numbers 7836358936, 7836357597, 7838460148, and 7836356J88, a�d a parc�l of
iand focafed on the adjacenf property south of Fleming Road, w�ich does not ha�e an associated
parcel number. The northern portian of the site contains cleared land, which formerly operated
as a Land C�earing anci lnert Debris (LCIp) landfill. The southern porEior� of the site contains
undeveioped, woodad land. F'ortions of fhe site contain dense understory vegefation. The sifes
are being proposed as waste areas for a nearby NC DOT proJect.

• The USGS Topographic Map (Figure 2) depicfs an unnamed #ribulary of Horsepen Creek
focated along tt�e southeastern site bounclary. A drainage swale is d�picted on fhe
souihwestern portion of ihe sife. A secor�d unnamed frib«tary is depicted on ihe norfhern
portion of the site; however, the fopographic map indica#es fhaf the northern portion of the
site has been filled (L.CID fandfili). The subjecE site is sifuatec! approximateiy 900 feet abo�e
mean sea leve� on fhe eastem portion of the site to approximafely 844 feet a6ove mean sea
level on the nartheastern and southeas#ern portions of ihe site. Fleming Raad is located
along a ridgeline that acls as a surface water drainage divide. Surface drainage appears to
flow north and south taward the unnam�d tributaries of Horsepen Creek.
• The USDA Soil Sur�ey of Guilford County {�igure 3) indicates thak soils on fhe site have
beert mapped as the following: Ap�fing sandy loam (Ap8); the Cecil sandy loar� series (CcB
and CcC); #he Cecil sandy ciay loam series (Ce82, CeC2); Madisan sandy Eoart� (MaE); and
ti�e Mad�son clay loam series (Mc82, McC2, McD2). The soils depicfed on the Guilford
County Soil Survey are nof listed on ihe F-lydric SoiEs Eis# for Guilford County.
a ECS reviewed the US�WS -- �1W1 Map of the site (Figure �4}. The map depicts a freshwaler
pond on the eastern porEion of the site.
• ECS reviewed the �EMA-�IRM Map Service Center website (Figure 5). The site is depic#ed
on the FEMA-FlRM Panel 3770783600J. The map indicates ihak the siEe is located in zone
X, which ars areas deterrr�ined io be oufside #he 0.2% annua� chance fEoodplain.
• ihe sub�ecf site is Ioeated within the Piedr�oni Physiographlc Province. The soils
encountered in tt�is area are the residual produot of in-place cherrtical weathering of rock
presently underiying the site andlor histaric depositional e�ents. In general, shallaw
unconfi�ed groundwater movernen# wifhin the overlying soils is contro]!ed largefy by
#opographlc gradie�ts. How�v�r, as #he graundwater percolates downward, it becomes
controlled by lhe subsurface geologic conditions. 7hus, the directlon nf groundwaier
mavement fn the de�per a�uiiers may not be consistent with the reflec#Ing iopography.
Surfac� wafers primariiy recharge shallow aquifers by i�filEratian along higher elevations.
Once in ihe shallow aquifer, the groundrvater typfcally discharges into streams or oiher
surface wafer bodies ai fawer efevatfons. 7he depth of lhe st�aElow water fable is transienf
and oan vary with seasonal ffuctuakions in precipitation. Groundwater mo�ement in 1he
shallow aquifer is generally trom higher to lower elevafions. As such, sha!!ow groundwafer is
expected to ilow generalfy to the nor#h and south beneath the site toward unnamed
tributarEes af Horsepen Creelc.
Site Reconnaissance
Mr. David �. Vafentine of �CS conducted the s�te reconnaissa�ce on November 6, 209q.
During reconnaissance, the site was observed for evidence of streams, ponds and wexfands.
Wetlands were naE idenli�ed on-site.
Slreams and a pond are �ocated adjacant ta the southeask site boundary. The streams (SA and
SB) have defned beds and banks, rnoderaEe sinuosity and cantained flowing water af ihe tirne
of our visit. Based on our obsgrvatlons, khe slreams would be considered jurisdictional by the

areas within ihe site were evaluafecf for wetlands. Snils in #hese areas were bright and app�ared
well drained, indicating the presence of uplands.
Figure 6 shows the approxirnate locations af the streams and pond. Figure 6 is based on ECS`
fteld nofes and shouEd only be used for preliminary planning purposes. ECS reeommends
caordination with ihe USAC� and f��e NCDWR to verify the jurESdictional watersfwe!land
boundari�s on the siEe ancf to cfassif}I flow regim�s (ir�termittent rrs, perennial) for lhe sfrearns at
tite sites.
Generaf Dfsc�ssEon
Sectior� 4Q4 of the Clean Water Aot regulates the discharge of dredge and fi11 materials into
waters of fhe United States (fakes, rivars, ponds, streams, elc.), ittcluding wetlands. Wafers of
#he United States include the territarial seas, navigable coastal and inland !altes, rivers and
sfreams, intermittet�t slreams, and wetlands. Activities tftat coul8 be regulated under Sec#ian
�04 include fhe placeme�t of fill for construction of roadways; residantial, commerclal or
induslrial structures; and the cansfruction of wafer retention ponds alang tributaries. 7he EPA
and the iJSAC� joinUy adminfster the Section �409 program. Sectian 401 of the Ciean Water Ack
grants each sfate ti�e au#hority to approv�, condition, or deny Federal �ertn�ts tf�af could resulf in
a cfischarge to Stale waters.
Streams are regulated by ihe USACE and the NCpWFt. Permits will be requlrad prior io
impacting wetlands or open waters, inel�ding poncfs, lakes and perenniaf ar interrnitieni
strearns. Mitigatiar� and starmwater managemenf plans will be a condiiian of permits issued for
the site. Buffers may be ret�uired adjacent to sfreams and wafer bodies.
For impacfs fo one-half acre or more of weiiands or fo mare than 3Dp iinear feet af strearn
c�annel, an Indi�idua! permit (IP) may be required. An fP requires a habikak analysis, aftemative
site analysis, projec# justification, plans to avoid and minimize impaets, ancf a proposed
mitigation plan. Depending on it�e habitat anaiysis and the extent of impacts, and
Environmenial impact Statement may be requlred by the USAC�. An IP allaws for a public
camm�nt period and may require 4 fv 78 months to obtain depending on conditions arising
during the USACE review and p�blic camrrient period.
Watershed ClassificatEon
According #o the NC[]�NR-�WR, the siEe is located in the Cape Fear R��er Basin. Suriace
waters flow to Horsepen Creek, which fias been desi�nated as Water Supply Wa#ers (WS-!II),
Nutrienf S�nsitiv� Waters (NS1/�. Water Supply Waters may requfre 30-100 font v�getafed
buffers depending on on de�elopment der�sity. ECS recommends consuitation wiEh a civil
engineer to determine it mandatory vegetative huffers andlor regufated de�eioprnent
(impervious surFaces) selbacks are required adJacenf #o surface waiers as a result of
stormwater rec�uirernents. fn addilion, �CS recommends Ehaf erosion conlrol measures and best
managem�nt practfces be installed and imp�emenfed on-site prior io earth moving activities.

Congress passed the Endangered S�ecies Act (�SA) in 1973. The purpose of the ESA is to
prolect and recover imperiled species and the �cosystEms upon whict� they de�end. If is
administered by ihe U.S. �ish and WrldEife SeNice (�WSj and the Corr�merce peparfinenYs
f�ational Marine Fisi�eries Service (NMFS). TI�� FWS has primary res�onsibility for terrestr[al
and freshwafer organisms, while the res�ansibiiifies of NMFS are mainly marine wildlife.
Under the �SA, species may be listed as either endangered ar threatened. "�ndangered"
means a species is in clanger af �xfinctian ihroughout all or a significant portion of its range.
"ThreaEened" tr�eans a s�ecles is likaly fo �ecome endangered within the foreseeable fufure. All
species of plants and animals, except pesf €nsects, are efigible for listing as endangered or
threatened. For ihe purposes of the ESA, Congress defined species to include subspecies,
varieties, and, for ver#ebrales, distinct population seg�ne�fs.
�CS review�d the United Stafes Fish ancf Wildlife Setvice (l1SFWS) �ndanger�d Species
[lalabase to i��ntify fecEeTafly protec#ed fhreatened and endangerecf species in Guilford Cour�ty,
North Caroii�a. Threatened ar endangered vertebrafe animals, fnvartebrafe anlmals, r�on-
vascufar plants and licher�s were not idenEified on the list. The foflowir�g feclera�ly protected
Threatened and �ndangered �asculsr plant was identified to occur fn Guiiford Counly, Narlh
Caralina:

Description: Sma11 whorlsd pogonia has a greenish-wY�ite stem that grows befirreen 3-- i3
Inches (7.� - 33 centimefers} tall. It gels its commor� name from the five or six grayis�-gresn
leaves that are displayed i� a singie whorl around the stem. When Ehe ieaves are well
developed, a s�ngle flawer or sarr�etimes a flnwer pair rises from ihe center of the circle of
leaves. 1'he flowers are yelEowish-green with a greenish-wt�ite �ip. Each fEower has three se�als
of equal fenglh ti�at spread outwarci. The flowers are scenlfess, iack nectar, and are primarily
seff-pollinating. It produces fruit whlch ripens in ti�e fall. The seeds conta(n very iitiie #ood
reserves and t�erefore need to fall an sail canfaining mycorrhizal fungi In order for the seed to
germinate and seedlings to become esfabllshed. An over-wintering vegetative bud may form in
lak� August or September. Occas9onally small whor�ed pagania will reproduc�: vegetatively,
without lhe use of seeds.
Habiiat; Small whorEed pogonia can be iimEted hy shade. The species seems io requir� sma[i
ligh# gaps, or canapy breaks, and generally grows in areas wil� sparse to moderafe ground
co�er. Ton many olher plants in an area can be harmful to #his plant. TMis orchid typically grows

forest canopy SElGII as a road or a stream. It grows in mixed-d�ciduous or t�ixed-
deciduous/coniferous forests tt�at ar� generally in secand- or fhir�-growth successianaf stages.
The soils in wi�ich !t lives are usually acidlc, moist, and have vary few nutrients.
Conclusians; The northern portior� of the site contains cleared land, wi�ich formerfy operafed
as a LCfD landfill. The saulhern portion of the site contains undeveloped, wooded land. �arEions
of the site contain dense understory vegetation, ihe wooded areas conslst of mafure and
immature hardwood and pine trees, approxirnataly 10 to 30 years in age. Based an our
know�edge and sife observations, ihe cleared lat�d nn the norfhern portion of the site and it�e
dense vegetation common throughout the southern porlian of ihe site does nat pravide suitable
habitat for the Stnall wi�oried pogonia.
GONC�USIONS
Wetiar�d Determination
ECS has condc�cted a wetland determfnation for ihe site. Two unnamed tributaries of Horsepen
Creek and a pond are locafed afong the southeastern porlion of the site. Streams are regulated
by ti�e EJSAC� and the iVCaWR. PermiEs wil! be required prior #o impacling perennial or
intermittent streams. �CS recarnrriends coordinatior� wilh ihe USACE and the NC[7WR to verify
the jurisdictior�al waferslwetlant! boundaries on the sit� and #o classify streams at the site.
Preliminarv Threaterted and �ndanqered Sp�cies �eterminat#on
�CS conducted a prellntinary threaEensd and endangerecf species determination. Based on our
findings, the Sma11 whorled pogor�ia is lisfed as a thr�afened species !n Guiliord County. Based
on our knowledge and sfEe abservaiions, fhe clea�ed fand on the northern portion of #he site and
the dense vegefation common throughout 1he sautherr� portion of the site daes not provide
suitable habifat for the Smafl whoried pagonia.
