Dear Mr. Conner:
The Wilmington Regional Office received the Stormwater Management Permit Application for Wallace Conner Outparcels
on July 15, 1998, with final information on October 19, 1998. Staff review of the plans and specifications has determined
that the project, as proposed, will comply with the Stormwater Regulations set forth in Title 15A NCAC 2H.1000. We are
forwarding Permit No. SW8 980716 dated December 9, 1998, for the construction of Wallace Conner Outparcels.
This permit shall be effective from the date of issuance until December 9, 2008, and shall be subject to the conditions and
limitations as specified therein. Please pay special attention to the Operation and Maintenance requirements in this permit.
Failure to establish an adequate system for operation and maintenance of the stormwater management system will result in
future compliance problems.
If any parts, requirements, or limitations contained in this permit are unacceptable, you have the right to request an
adjudicatory hearing upon written request within thirty (30) days following receipt of this permit. This request must be in
the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office
of Administrative Hearings, P.O. Drawer 27447, Raleigh, NC 27611-7447. Unless such demands are made this permit shall
be final and binding.

construction, operation and maintenance of a detention pond in compliance with the provisions of 15A NCAC 2H .1000
(hereafter referred to as the "stormwater rules') and the approved stormwater management plans and specifications and other
supporting data as attached and on file with and approved by the Division of Water Quality and considered a part of this
permit.
This permit shall be effective from the date of issuance until December 9, 2008 and shall be subject to the following specified
conditions and limitations:
I. DESIGN STANDARDS
1. This permit is effective only with respect to the nature and volume of stormwater described in the application and
other supporting data.
2. This stormwater system has been approved for the management of stormwater runoff as described on page 3 of this
permit, the Project Data Sheet. The stormwater control has been designed to handle the runoff from 210,886 square
feet of impervious area.
3. Approved plans and specifications for this project are incorporated by reference and are enforceable parts of the
permit.
4. The tract will be limited to the amount of built -upon area indicated on page 3 of this permit, and per approved plans.

H. SCHEDULE OF COMPLIANCE
The stormwater management system shall be constructed in it's entirety, vegetated and operational for its intended
use prior to the construction of any built -upon surface except roads.
2. During construction, erosion shall be kept to a minimum and any eroded areas of the system will be repaired
immediately.
All connections into the stormwater system from the outparcels shall be made into the forebay of the pond, such that
short-circuiting of the system does not occur.
The permittee shall at all times provide the operation and maintenance necessary to assure the permitted stormwater
system functions at optimum efficiency. The approved Operation and Maintenance Plan must be followed in its
entirety and maintenance must occur at the scheduled intervals including, but not limited to:
a. Semiannual scheduled inspections (every 6 months).
b. Sediment removal.
C. Mowing and revegetation of side slopes.
d. Immediate repair of eroded areas.
e. Maintenance of side slopes in accordance with approved plans and specifications.
f. Debris removal and unclogging of outlet structure, orifice device and catch basins and piping.
g. Access to the outlet structure must be available at all times.
5. Records of maintenance activities must be kept and made available upon request to authorized personnel of DWQ.
The records will indicate the date, activity, name of person performing the work and what actions were taken.
6. Decorative spray fountains will not be allowed in the pond.
7. The facilities shall be constructed as shown on the approved plans. This permit shall become voidable unless the
facilities are constructed in accordance with the conditions of this permit, the approved plans and specifications, and
other supporting data.
8. Upon completion of construction, prior to issuance of a Certificate of Occupancy, and prior to operation of this
permitted facility, a certification must be received from an appropriate designer for the system installed certifying
that the permitted facility has been installed in accordance with this permit, the approved plans and specifications,
and other supporting documentation. Any deviations from the approved plans and specifications must be noted on
the Certification.
9. A copy of the approved plans and specifications shall be maintained on file by the Permittee for a minimum of ten
years from the date of the completion of construction.
10. Prior to the sale of any portion of the property, an access/maintenance easement to the stormwater facilities shall be
granted in favor of the permittee.
11. The permittee is responsible for verifying that the proposed built -upon area does not exceed the allowable built -upon
area.
12. If the stormwater system was used as an Erosion Control device, it must be restored to design condition prior to
operation as a stormwater treatment device, and prior to occupancy of the facility.

13. Deed restrictions must be recorded prior to the sale of any outparcel shown on the approved plans to ensure that
future owners are made aware of the built -upon area limitations.
14. The following statements must be recorded in the deed restrictions:
To ensure continued compliance with the NC Division of Water Quality Stormwater Management Permit
Regulations, 15A NCAC 2H.1000, outparcel(s) and future areas as shown on the approved plans are limited
to * square feet of built -upon area, inclusive of that portion of the right-of-way between the front lot
line and the edge of the pavement, structures, pavement, walkways of brick, stone, slate, but not including
wood decking or the water surface of swimming pools,"

15. A copy of the recorded deed restrictions must be submitted to the DWQ within 30 days of the date of the recording.
The recorded copy must be signed by the permittee, dated, stamped with the deed book number and page, and bear
the stamp of the Register of Deeds.
16. The following items will require a modification to the permit:
a. Any revision to the approved plans, regardless of size.
b. Project name change.
C. Transfer of ownership.
d. Redesign or addition to the approved amount of built -upon area.
e. Further subdivision of the project area.
f. Filling in, altering, or piping of any vegetative conveyance shown on the approved plan.
In addition, the Director may determine that other revisions to the project should require a modification to the permit.
17. The Director may notify the permittee when the permitted site does not meet one or more of the minimum
requirements of the permit. Within the time frame specified in the notice, the permittee shall submit a written time
schedule to the Director for modifying the site to meet minimum requirements. The permittee shall provide copies
of revised plans and certification in writing to the Director that the changes have been made.

III. GENERAL CONDITIONS
This permit is not transferable. In the event there is a desire for the facilities to change ownership, or there is a name
change of the Permittee, a formal permit request must be submitted to the Division of Water Quality accompanied
by an application fee, documentation from the parties involved, and other supporting materials as may be appropriate.
The approval of this request will be considered on its merits and may or may not be approved.
2. Failure to abide by the conditions and limitations contained in this permit may subject the Permittee to enforcement
action by the Division of Water Quality, in accordance with North Carolina General Statute 143-215.6A to 143-
215.6C.
3. The issuance of this permit does not preclude the Permittee from complying with any and all statutes, rules,
regulations, or ordinances which may be imposed by other government agencies (local, state, and federal) which have
jurisdiction.
4. In the event that the facilities fail to perform satisfactorily, including the creation of nuisance conditions, the
Permittee shall take immediate corrective action, including those as may be required by this Division, such as the
construction of additional or replacement stormwater management systems.
5. The permittee grants DENR Staff permission to enter the property for the purpose of inspecting all components of
the permitted stormwater management facility.
6. The permit may be modified, revoked and reissued or terminated for cause. The filing of a request for a permit
modification, revocation and reissuance or termination does not stay any permit condition.

Dear Mr. Conner:
You have our approval, in Accordance with the attached conditions and those listed below, to place fill material in an
additional 0.2943 acres of wetlands (total fill of 0.9791 acres of wetlands) for the purpose of developing a shopping renter at
Newport Food Lion, as you described in your application dated October 12, 1998. After reviewing your application, we have
decided that this fill is covered by General Water Quality Certification Number 3108. This certification allows you to use
Nationwide PermiL Number 26 when the Corps or Engineers iss7es it. In addition, you should get any other federal, state or local
permits before you go ahead with your pmjmt including (but not limited to) Sediment and Erosion Control, Coastal Stonnwata.
Nan -Discharge and Water Supply Water shed regulations. This approval will expir when the accompanying 404 or CAMA
permit expires sinless otherwise specified in the General Certification.
This approval is orlly valid fat the purpose and design &.3t you described in your application except as modified below. If
you change your project, you must notify us and you may be required to send us a new application . If the property is sold, the
new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all
conditions. If total wetland fills for Chit project (now or in the funtre) exceed one acre, compensatory mitigation maybe required
as described in 15A NCAC 2H .0306 (h) (6) and (Ti. For this approval to be valid, you must follow the conditions listed in the
attached certification and any additional condidons listed below.
1. Deed notifications or similar mechanisms shall be placed an all lots with remaining jurisdicdonal wetlands
and waters or areas within 50 feet of all streams and ponds to notify the suite in order to assure compliance for
funtre wetland and/or water impact These mechanisms shall be put in place within 30 days of the date of ads
letter or the issuance of the 404 Permit (whichever is later).
2. An additional condition is that a final, written stomhwarer plan including a wet detention buin must be
approved by DWQ before wetland (or stream) impacts occur.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act
within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition, which conforms to Chapter
150B of the North Carolina General Statutes to the Office of Administtativc Hearings, P.O. Box 27447, Raleigh, N.C. 27611-
7447. This certification and its conditions am final and binding unless you ask for a hearing.

This General Certification is issued in conformity with the
requirements of Section 401, Public Laws 92-500 and 95-217 of the
United states and subject to the North Carolina Division of Water
Quality Regulations in 15A NCAC 2H, Section .0500 and 15A NCAC 23
.0200 for the discharge of fill material to waters and adjacent
wetland areas which are above the headwaters or to wetland areas that
are not a part of the surface tributary system to interstate waters or
navigable waters of the United States (i.e., isolated wetlands) as
described in 33 CFR 330 Appendix A (B) (26) of the Corps of Engineers
regulations (i.e., Nationwide Permit No. 26). This Certification
rep -aces water Quality Certification Nsmber 2671 issued on January 21,
y992, This WQC is rescinded when the Corps of Engineers reauthorizes
Nationwide 26 or when deemed appropriate by the Director of DWQ.
The State of North Carolina certifies that the specified category

Planning and Design Manual' or the "North Carolina Surface
Mining Manual" (available from the Division of Land
Resources in the DERNR Regional or Central Offices) must be
utilized to prevent exceedances of the appropriate turbidity
water quality standard (50 NTUs in streams and rivers not
designated as trout waters by DWQ; 25 NTUs in all saltwater
classes, and all lakes and reservoirs; 20 NTUS in trout
waters);
7. All sediment and erosion control measures placed in wetlands
and waters shall be removed and the natural grade restored
after the Division of Land Resources has released the
project;
8. Additional site -specific conditions may be added to projects
with greater than one-third acre impact to wetlands or 150
linear feet of streams which are proposed under this
Certification in order to ensure compliance with all
applicable water quality and effluent standards;
9. Measures shall be taken to prevent live or fresh concrete
from coming into contact with waters of the state until the
concrete has hardened;
i0. If an environmental document is required, this Certification
is not valid until a FONSI or ROD is issued by the State
Clearinghouse;
11. Concurrence from DWQ that this certification applies to an
individual project shall expire on 13 December 1999 to
coincide with the expiration date of Nationwide Permit 26.
Non-compliance with or violation of the conditions herein set
North by a specific fill project shall result in revocation of this
certification for the project and may also result in criminal and/or
civil penalties.
The Director of the North Carolina Division of Water Quality may
reuuire submission of a formal application for individual
certification for any project in this category of activity, if it is
determined that the project is likely to have a significant adverse
effect upon water quality or degrade the waters so that existing uses
of the wetla-.d.or downstream waters are precluded.
Public hearings may be held for specific applications or group of
applicatiors prior to a Certification decision if deemed in the
public's best interest by the Director of the North Carolina Division
of Environmental Management.

This letter is a summary of our responses to your review letter dated 9/21 /98 for the above referenced
project. We have addressed each of your review items as follows:
1. We have added on page #4 of the application form the square footage of built upon area that
each lot will be permitted to have. We have also added on page #4 the statement requiring
that each lot must provide its own system of drainage into the forebay portion of the pond.
2. We have provided a surface area which is 31% greater than the minimum requirement and a
storage volume that is 26% greater than the minimum requirement as a justification for not
having the minimum 3:1 length to width ratio for the pond.
3. We have stated on our plan and on the wet basin supplement from that a portable pump
would be used if a need to completely drain the pond would ever occur.
4. A permit has been submitted for the 404/401 wetlands fill area as shown on this plan (total
of 0.9791 acre) for entire project). A copy of this permit will be forwarded to your office
when it has been obtained.
5. The easement area (0.5734 acres) has been designated on the revised plan. This easement
area will be recorded prior to selling any of the out parcels.
6. We have used a pond depth of 7. S as allowed by state pond sizing charts.
7. We have corrected the drainage time calculations to reflect the drawdown time using a 2"
diameter drain as is shown on the revised plan.
8. The permanent pool elevation is shown as elevation 33.5 and the temporary pool elevation
is 35.5. The storage volume shown is based on these two elevations.
9. We have reworked the outlet detail to clearly show the top of the 12" tee to be at elevation
35.5 and we have noted this elevation on the outlet structure detail.
10. We have provided the surface area at the storage elevation (elevation 35.50). This surface
area is 13,529 square feet.
11. We have added the forebay to the pond cross section view. We have noted all design
elevations and side slopes on this cross section view.
12. We have provided Mr. Conners address on the revised application form.
Please advise if there is other information that is needed in order to have this proposed retention pond
plan approved.

The Wilmington Regional Office received a Stormwater Management Permit Application for Wallace
J. Conner Property on July 15, 1998. A preliminary review of that information has determined that the
application is not complete. The following information is needed to continue the stormwater review:
1. Please complete and return Page 4, item #1 concerning the amount of built -upon area each
outparcel is limited to. The calculations indicate that 90% will be used. Please also add a
statement to page 4 that each outparcel must provide it's own collection system ditches or
piping to the forebay of the pond. Connection into any other part of the pond is not permitted.
2. Lack of space is not sufficient justification to allow a pond with less than a 3:1 L:W ratio.
Additional surface area and storage volume on the order of 25 % or more would be sufficient
justification.
3. Due to the coast's flat topography, it is acceptable to state that a portable pump will be used
its the emergency drain.
4. Please provide a copy of the 404/401 wetlands fill permit for the wetlands to be displaced by
the proposed pond. Stormwater treatment devices cannot be located in wetlands.
5. Please indicate the easement area on the plans. The permit will require that the easement be
recorded prior to selling any of the outparcels.
6. State pond sizing charts allow depths up to 7.5', so don't worry about the 6' requirement.

7. The calculations indicate that the orifice is 2.5", but the plans only show a 2" orifice. Please
correct and send revised plans or calculations. A 2.5" orifice would be too large for the
volume held between 33.5 and 35.5. See #8 below.
S. The application and plan details indicate that the temporary pool elevation is 35.5,, but your
storage volume calculations are based on elevation 37. If 35.5 is the storage elevation, ie.,
the elevation that the runoff accumulates to prior to discharge over the tee section, then the
storage calculations must use 35.5 to determine the volume provided in the pond. If 37 is the
storage elevation, please revise the plan details.
9. Your outlet detail is very confusing. The way it is drawn, it looks like the 12" tee section
extends all the way to the top of the trash rack, ie., elevation 37, not 35.5. Please clarify.
10. Please provide the surface area at the storage elevation.
11. Please add the forebay to the section view of the pond. Ideally, the section view is where you
show the forebay bottom elevations, slopes, vegetated shelf, bottom, permanent pool and
design pool elevations.
12. Please provide Mr. Conner's mailing address. Addresses in care of are not permitted.
Please note that this request for additional information is in response to a preliminary review. The
requested information should be received by this Office prior to October 21, 1998, or the application will
be returned as incomplete. The return of a project will necessitate resubmittal of all required items, including

ATTACHMENTA
1. Deed Restriction Language
The following statements must be recorded for all low density projects and for all projects that involve the
subdivision and selling of lots or outparcels:
1. No more than _ square feet of any lot, including that portion of the right-of-way between the
edge of pavement and the front lot line, shall be covered -by impervious structures including
asphalt, gravel, concrete, brick, stone, slate or similar material but not including wood decking or
the surface of swimming pools. This covenant is intended to insure continued compliance with the
stormwater permit issued by the State of North Carolina. The covenant may not be changed or
deleted without the consent of the State.
2. No one may fill in, pipe, or alter any roadside swale except as necessary to provide a minimum
driveway crossing.
NOTE: If lot sizes vary significantly, the owner/ developer must provide an attachment listing each lot
number, size and the allowable built -upon area for each lot.
For commercial projects that have outparcels or future development the following statements must also be
recorded:
3. The connection from the outparcel or future area into the stormwater system must be made into the
forebay such that short --circuiting of the system does not occur.
4. All built -upon area from the outparcel or future development must be directed into the permitted
stormwater control system.
5. Built -upon area in excess of the permitted amount will require a permit modification prior to
construction.
For curb outlet systems, the following statement in addition to items 1 and 2 above must be recorded:
6. No one may pipe, fill in or alter any designated 100 foot long grassed swale used to meet the
requirements of NCAC 2H .1008(g).
