Dear Mr. Stovall:
On July 21, 2010, the Wilmington Regional Office received a request for transfer ownership of
Stormwater Management Permit Number SW8 980708 issued on November 21, 2000. This site was
inspected on August 5, 2010. Please reference the "Compliance Inspection Report" attached. All
deficiencies noted in the inspection report have been addressed and the site is currently in compliance
with the terms and conditions of this renewed state stormwater permit. As indicated on the
Name/Ownership Change form, you have acknowledged receipt of a copy of the permit, which includes
the application and supplement forms, a copy of the approved plans and a copy of the required
Operation and Maintenance agreement from the previous Permittee. By acknowledging receipt of the
permit, and by signing the Name/Ownership Transfer form, you have accepted the responsibility for
complying with the terms and conditions outlined in this permit. If you need additional copies of the
permit, or copies of the approved plans, please contact the Division of Water Quality in the Wilmington
Regional Office at the phone number below. Please add the attached Renewal / Transfer page as the
new cover page for the permit.
On August 5, 2009, the Governor signed Session Law 2009-406. This law extends any stormwater
permit that is current and valid at any point between January 1, 2008 and December 31, 2010 for a
period of three (3) years from its current expiration date. Accordingly, Stormwater Permit # SW8 980708,
which will expire on November 21, 2010, is now in effect until November 21, 2013. Please reference the
attached Renewal / Transfer page of the permit. The plans previously approved on November 21, 2000,
in accordance with the regulations set forth in Title 15A NCAC 2H.1000 effective September 1, 1995,
remain in full force and effect.
Please pay special attention to the Operation and Maintenance requirements in this permit. Failure to
establish an adequate system for operation and maintenance of the stormwater management system will
result in future compliance problems. Please be aware that the project's built -upon area and stormwater
controls must be built and maintained in compliance with the permit documents and the approved plans.
Any modifications to this project must be submitted to the Division of Water Quality and approved prior to
construction. The issuance of this approval does not preclude you from complying with all other
applicable statutes, rules, regulations or ordinances, which may have jurisdiction over the proposed
activity, and obtaining a permit or approval prior to construction.

Please be advised that you are required to comply with the terms, conditions and limitations of
your Stormwater Management Permit under Title 15A North Carolina Administrative Code 2H
.1003 and North Carolina General Statute 143-214.7, including operation and maintenance of
your permitted stormwater system.

name/ownership form must be submitted to DWQ within 30 calendar days detailing the change.

If any parts, requirements, or limitations contained in this permit are unacceptable, you have the
right to request an adjudicatory hearing upon written request within thirty (30) days following
receipt of this permit. This request must be in the form of a written petition, conforming to
Chapter 150E of the North Carolina General Statutes, and filed with the Office of Administrative
Hearings, P.O. Drawer 27447, Raleigh, NC 27611-7447. Unless such demands are made this
permit shall be final and binding.

provisions of 15A NCAC 2H .1000, effective September 1, 1995 (hereafter referred to as the
"stormwater rules') and the approved stormwater management plans and specifications and
other supporting data as attached and on file with and approved by the Division of Water Quality
and considered a part of this permit.
The permit is hereby renewed subject to the following addendums, clarifications, conditions and
limitations:
The original permit conditions contained in the permit issued on November 21, 2000
remain in full force and effect, except as amended herein. (An additional copy of this
original permit can be obtained from the Division of Water Quality, Wilmington
Regional Office.)
2. This permit shall be effective from the date of issuance until November 21, 2013.
3. The Permittee shall submit a permit renewal application request at least 180 days
prior to the expiration date of this permit. The renewal request must include the
applicable documentation and the processing fee.
4. If the use of permeable pavement is desired, this permit must be modified to add the
permeable pavement conditions.

This e-mail is to acknowledge our conversation per phone this morning. I confirm that the swale to the south of your
property (southern swale) is located in a drainage easement and is designed to bypass flow around your stormwater
pond. The main flow is directed into another swale that runs north from the pond outlet pipe (under a road) near the
back of your property.
We have directed the adjacent property owner, represented by Randy Crouch, to construct a swale at the back of the
O'Leary's parking lot to route a relatively small amount of stormwater into the drainage easement south of your
property.

III. REQUIRED ITEMS
This application package will not be accepted by the Division of Water Quality unless all of the
applicable required items listed below are included with the submittal.
1. This completed and signed form.
2. Legal documentation of the transfer of ownership. (For Permit Transfers Complete Current Permittee
and Proposed Permittee Sections)
3. A copy of the recorded deed restrictions, if required by the permit.
4. The designer's certification, if required by the permit and if not already submitted to DWQ.
5. If the Proposed Permittee is a corporation, LLC or General Partnership, provide documentation from
the Secretary of State office, which supports the named president, vice president, member, manager
or General Partner.
6. The $40.00 processing fee. If this is an initial transfer from the original permittee to the property owner
or other responsible party such as an HOA, the processing fee is not required. Subsequent ownership
transfers will require the $40.00 processing fee.

appropriate Regional Office of the North Carolina Department of Environment and Natural

copy of the lease agreement or pending property sales contract has been provided with the

$25,000 per day, pursuant to NCGS 143-215.6.

of the retention pond. Cleaned out all sediment and cattails back down to the original
constructed elevation of the forbay.

Dear Mr. Pusey,
I am writing in response to your letter on Permit q SW8 980708. For your future mailings, please note
that this property was purchased from Nancy Horton in 2000 and is now owned by Stovhort, Inc. The
mailing address is 6921 Market Street, Wilmington, NC 28411. Please see our plans below to rectify
your concerns.
1. Signed Engineer Certification for the storm water system has been requested and will be sent to
you as soon as he can go back through his 10 year old files.
2. There are three manhole covers on the south side of the property, two are next to the pond and
are not covered.
3. Please see number 2.
4. The overgrowths of vegetation and cattails have been eliminated from the pond and fore bay.
5. The fore bay and pond have been cleaned out and restored to design depths.
6. Pond outlet pipe and bypass pipe have been cleared of trees and bushes.
7. The roof drains will be fixed within the next two weeks.
8. All buckets and other trash from the drainage easement behind the retail building have been
removed.
9. The sediment in the driveway has been cleaned up and should no longer be getting into the
drop inlets. Driveway was swept and pressure washed.
