Accordingly,we are forwarding the attached NPDES discharge permit. This permit is issued pursuant to the
requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North
Carolina and the U.S.Environmental Protection Agency dated May9, 1994 (or as subsequently amended).
This final permit includes no major changes from the draft permit sent to you on September 28,2005.
If any parts,measurement frequencies or sampling requirements contained in this permit are unacceptable to
you,you have the right to an adjudicatory hearing upon written request within thirty(30) days following receipt of
this letter. This request must be in the form of a written petition,conforming to Chapter 150B of the North Carolina
General Statutes,and filed with the Office of Administrative Hearings (6714 MfirService Center,Raleigh,North
Carolina 27699-6714). Unless such demand is made,this decision shall be final and binding.
Please note that this permit is not transferable except after notice to the Division. The Division may require
modification or revocation and reissuance of the permit. This permit does not affect the legal requirements to obtain
other permits which maybe required bythe Division of Water Quality or permits required bythe Division of Land

A. (2.) CHRONIC TOXICITY PERMIT LIMIT (QRTRLY)
The effluent discharge shall at no time exhibit observable inhibition of reproduction or significant mortality to
Ceriodaphnia dubia at an effluent concentration of 90%.
The permit holder shall perform at a minimum, quarterly monitoring using test procedures outlined in the "North
Carolina Ceriodaphnia Chronic Effluent Bioassay Procedure," Revised February 1998, or subsequent versions or
"North Carolina Phase II Chronic Whole Effluent Toxicity Test Procedure"(Revised-February 1998) or subsequent
versions. The tests will be performed during the months of January,April, July, and October. Effluent sampling for
this testing shall be performed at the NPDES permitted fmal effluent discharge below all treatment processes.
If the test procedure performed as the first test of any single quarter results in a failure or ChV below the permit
limit, then multiple-concentration testing shall be performed at a minimum, in each of the two following months as
described in"North Carolina Phase II Chronic Whole Effluent Toxicity Test Procedure"(Revised-February 1998)or
subsequent versions.
The chronic value for multiple concentration tests will be determined using the geometric mean of the highest
concentration having no detectable impairment of reproduction or survival and the lowest concentration that does
have a detectable impairment of reproduction or survival. The definition of"detectable impairment," collection
methods, exposure regimes, and further statistical methods are specified in the "North Carolina Phase II Chronic
Whole Effluent Toxicity Test Procedure"(Revised-February 1998)or subsequent versions.
All toxicity testing results required as part of this permit condition will be entered on the Effluent Discharge
Monitoring Form(MR-1) for the months in which tests were performed, using the parameter code TGP3B for the
pass/fail results and THP3B for the Chronic Value. Additionally, DWQ Form AT-3 (original) is to be sent to the
following address:

Completed Aquatic Toxicity Test Forms shall be filed with the Environmental Sciences Branch no later than 30 days
after the end of the reporting period for which the report is made.
Test data shall be complete, accurate, include all supporting chemical/physical measurements and all
concentration/response data, and be certified by laboratory supervisor and ORC or approved designate signature.
Total residual chlorine of the effluent toxicity sample must be measured and reported if chlorine is employed for
disinfection of the waste stream
Should there be no discharge of flow from the facility during a month in which toxicity monitoring is required, the
permittee will complete the information located at the top of the aquatic toxicity (AT) test form indicating the
facility name,permit number,pipe number, county,and the month/year of the report with the notation of"No Flow"
in the comment area of the form. The report shall be submitted to the Environmental Sciences Branch at the address
cited above.
Should the permittee fail to monitor during a month in which toxicity monitoring is required, monitoring will be
required during the following month.
Should any test data from this monitoring requirement or tests performed by the North Carolina Division of Water
Quality indicate potential impacts to the receiving stream, this permit may be re-opened and modified to include
alternate monitoring requirements or limits.
NOTE: Failure to achieve test conditions as specified in the cited document, such as minimum control organism
survival, minimum control organism reproduction, and appropriate environmental controls, shall constitute an
invalid test and will require immediate follow-up testing to be completed no later than the last day of the month
following the month of the initial monitoring.

SUMMARY
Brenntag Southeast, Inc. has applied for renewal of NPDES permit to discharge remediated groundwater
into a storm drain located in Durham County. The only viable option,other than discharge to surface water,
is to discharge to the City of Durham. However,the City of Durham is unwilling to accept the remediated
groundwater. Leaving the only other economically viable option as discharge to surface water.
The facility is requesting a permitted flow of 0.0144MGD. Groundwater sampling events from 1996 to

# - Major Modification for the permit was issued on 03/19/2004 and monitoring for these parameters was
removed based on the fact that these constituents were not found at detectable levels in the effluent for at
least past 12 months.
In addition to solvent contamination groundwater samples indicate contamination from petroleum sources,
therefore the conditions of the general permit for groundwater remediation systems have been incorporated
into this permit. The general permit assumes zero dilution in developing the permit limits and monitoring
requirements. Assuming zero dilution is appropriate for this site since discharge is to a zero flow stream.
A vacuum-enhanced recovery system will be used to pump groundwater from 10 extraction wells at a
maximum rate of 10 gpm per well. This equates to 0.0144 MGD.
The discharge will be to an unnamed tributary to Third Fork Creek Though the unnamed tributary is not
listed as impaired, according to the state's 303(d) list, Third Fork Creek is listed as impaired. The cause of
impairment is uncertain but urbanization is suspected.
TOXICITY TESTING:

This facility has failed three chronic toxicity tests during the previous 4.5 years. The subsequent tests have
passed.

COMPLIANCE SUMMARY:
DMRs have been reviewed for the period January 2001 through August 2005. The facility has a mixed
compliance record. The following Notices of Violation were issued: 12/06/02 - to; 11/25/02 - to;
9/16/02 - to; 9/23/02 - to; 9/04/02 - to; 06/20/02 - to; 12/21/01 - to; 11/06/01 - TSS,
tetrachloethene, 1,1 dichloroethene.
PROPOSED CHANGES:
• MonitoringFr xis: The monitoring for carbon disulfide and phenol have been eliminated based on
DMRs review(non-detect for 20 months). The monitoring frequency for vinyl chloride and xylenes has
been reduced to quarterly based on DMRs review(non-detect for 20 months).
• Linin: Based on DMRs review (non-detect for 20 months) limits for benzene, bis (2-ethylhexyl)
phtalaet, 1,1 - dichloroethene, tetrachloroethene, trichloroethene, and toluene have been eliminated.
Monitoring frequency for these parameters have been reduced to quarterly due to the elimination of the
limits.

application for the continued discharge of effluent from a groundwater remediation us.com
system at the Brenntag Southeast facility(formerly Southchem) in Durham, North
Carolina. Treated groundwater from the remediation system is discharged to an on- Our ref:
site storm sewer that, in turn,discharges to a drainage ditch located along the NC000368.0015
southern boundary of the site. This drainage ditch conveys surface water to an
unnamed tributary of Third Fork Creek. Other items enclosed with this letter in
support of the NPDES permit renewal application include: a copy of the March 2005
Discharge Monitoring Report(Attachment A) which summarizes the most recent
analytical data for the system effluent;a USGS topographic map of the project area
that depicts the location of the system outfall (Figure 1); and a site map that depicts
the route of the treated water to the discharge point(Figure 2).
Sludge is neither generated nor discharged by the groundwater remediation system;
therefore,a sludge management plan has not been included with this application.
Any solids(i.e. silt, iron and manganese precipitate)generated during the
groundwater extraction and/or treatment process are filtered from the treatment
stream using bag filters and granular activated carbon units. The treated effluent is
sampled on a monthly basis for total suspended solids in compliance with the
monitoring requirements for the site(see Attachment A).
