On June 19, 2013, the Wilmington Regional Office received a request to revise the approved plans for
Stormwater Management Permit Number SW8 970921. The revisions include the construction of
above ground pipe support slabs on the existing gravel surfaces. It has been determined that a formal
permit modification is not required for the proposed changes. We are forwarding you an approved
copy of the revised plans for your files. Please add the attached plans to the previously approved plan
set.
On August 5, 2009, the Governor signed Session Law 2009-406. This law impacts any development
approval issued by the Division of Water Quality under Article 21 of Chapter 143 of the General
Statutes, which is current and valid at any point between January 1, 2008, and December 31, 2010.
The law extends the effective period of any stormwater permit that is set to expire during this time
frame to three (3) years from its current expiration date. On August 2, 2010, the Governor signed
Session Law 2010-177 which grants an extra year for a total of four (4) years extension.
Accordingly, Stormwater Permit # SW8 970921, which was set to expire on November 6, 2018, is now
in effect until November 6, 2022. Please resubmit the renewal application and fee at least 180 days
prior to November 6, 2022, which would be May 6, 2022. A copy of the Renewal Application can be
obtained from the following website: http://portal.ncdenr.org/web/wq/ws/su/statesw/forms_docs.
Please be aware that all terms and conditions of the permit issued on November 6, 2008, remain
in full force and effect. Please also understand that the approval of this revision to the approved
plans for the subject State Stormwater Permit is done on a case -by -case basis. Any other
changes to this project must be approved through this Office prior to construction. The issuance of
this plan revision does not preclude the permittee from complying with all other applicable
statutes, rules, regulations or ordinances which may have jurisdiction over the proposed activity,
and obtaining a permit or approval prior to construction.

Dear Ms. Nelson,
INVISTA S.Ar.l. is submitting a plan revision to permit SW8 970921 for State
Stormwater for expansion process project located within a portion of its property
at 4600 Highway 421 North in Wilmington, North Carolina. The total site area of
the INVISTA property is approximately 1,175 acres. However, the total disturbed
area for this portion of the work is approximately 600 square feet and there is no
net increase in built upon area. The plan revision consists of the construction of
above ground pipe support slabs on existing gravel surfaces. The overall process
expansion project will construct multiple improvements throughout the facility.
However, the LOC-12 area is within the project boundary for permit SW8
970921. Other areas indicated are being permitted as a redevelopment exclusion
submitted for express permitting on June 6.
Support document drawings include a cover page, site plan drawing for the entire
project development, and the original construction drawing clouded to show the
slab construction. The other areas shown on the site plan, LOC-1 thru 11 and 13-
15 our outside the project boundary of permit SW8 970921.

Please find attached a renewal permit application for permit SW 8 970921. The permit was
originally issued May 5, 1999. This permit covers a wastewater treatment plant expansion. The
details from the original application and maintenance plan remain the same with the exception
that INVISTA has sold some of the land it owned thus reducing the total property and build -
upon area. We have not experienced any issues with stormwater flows; thus have not provided
any additional documents beyond those originally submitted.
