Guidelines for Access: The staff of the Regional Office is dedicated to making public recordsin our
custody readily available to the public for review and copying. We also have the responsibility to the public
to safeguard these records and to carry out our day-to-day program obligations. Please read carefully the
following before signing the form.
1: Due to the large public demand.for Np. access, we request that you>call'at least a day in
advance to schedule'an appointment for file review so you can be accommodated.
Appointments are scheduled between 9 00 a.m. and ' 00 p.m. Viewing time ends at 4 45
p.m. Anyone arriving without an appointment may view the files to the extent that time and
staff supervision are available.
2. You must specify files you want to review by facility name or incident number, as
appropriate. The number of files that you may review at one appointment will be limited to
five..
3. You may make copies of a file when the copier is not in use by the staff and if time permits.
There is no charge for 25 or less copies cost per copy after the initial 25 is 2.5 per copy
Payment is to be made by check, money order, or cash in the administrative offices.
4. Files must be kept in the order you received them. Files may not be taken from the office.
No briefcases, large totes etc. are permitted in the file review area To remove, alter,
deface, mutilate, or destroy material in public files is a misdemeanor for which you can be
fined up to $500.00..
5. In accordance with GS 25-3-512, a $25.00 processing fee will be charged and collected for
checks on which payment has been refused.
6. The customer must present a photo ID, sign -in, and receive a visitor sticker prior to
reviewing files.

In regards to Stormwater Project No. SW8970428, we have the intentions to make the
following adjustments to become compliant.
-Remove trees and excess weed growth
-Re-grade the area on the NW of the pond so that it drains to the designated area
-Distribution piping will be replaced
-Equipment will not be allowed in the basin
-Drains will be cleaned out
-Inlet structure was checked and is still level, but the drains will be cleaned out
-The erosion/washout area will be fixed back to specifications
-Area will be graded to drain better
The work will be scheduled and completed within the first weeks of April. Please

Please find attached a copy of the completed form entitled "Stormwater Compliance Inspection
Report". The report summarizes the findings of a recent inspection of the project's stormwater
controls conducted on March 17, 2008 to determine compliance with Stormwater Permit
Number SW8970428 issued on July 28, 1997.
The required actions that are necessary to bring this site into compliance are noted under the
Comments section of the report. Please inform this Office in writing within fifteen (15) days of
the specific actions that will be undertaken and the time frame that will be required to correct
the deficiencies. Failure to provide the requested information, when required, may initiate

Disturbing Permit.
Dear Sir:
This letter constitutes Notice of Violation of Section 7-5(A), Section 7-7(4), Section 7-18(A),
Section 7-18(J), Section 7-21(A)(I), and Section 7-21(A)(3) of the New Hanover County's Soil
Erosion and Sedimentation Control Ordinance.
Section 7-5(A) Plan Required states:
No person shall initiate any land -disturbing activity which uncovers more than one acre
without having anrerosion control plan approved by the County. 1j
Section 7-7(4) Prior Plan Approval states:
No person shall initiate any land -disturbing activity on a tract if more than one acre is to be
uncovered unless, thirty or more days prior to initiating the activity, an erosion and
sedimentation control plan for such activity is filed with and approved by the County. 7

Section 7-18(A) Erosion and Sedimentation Control Plans states:
An erosion control plan shall be prepared for all land -disturbing activities subject to this
ordinance whenever the proposed activity is to be undertaken on a tract comprising more than one
acre, if more than one acre is to be uncovered.
Section 7-18(J) Erosion and Sedimentation Control Plans states:
Any person engaged in land -disturbing activity who fails to file a plan in accordance with
provisions of an approved plan shall be deemed in violation of the ordinance.
Section 7-21(A)(1) Civil Penalties states:
Any person who violates any of the provisions of this ordinance, or rules or orders adopted
or issued pursuant to this ordinance, or who initiates or continues a land -disturbing activity
for which an erosion control plan is required except in accordance with the terms, conditions,
and provisions of an approved plan, shall be subject to a civil penalty of not more than
$500.00. No penalty shall be assessed until the person alleged to be in violation has been
notified of the violation by registered or certified mail, return receipt requested, or other
means reasonably calculated to give actual notice. The notice shall describe the violation with
reasonable particularity, specify a reasonable time period within which the violation must be
corrected , and warn that failure to correct the violation within the time period will result in
the assessment of a civil penalty or other enforcement action. If, after the allotted time period
has expired, the violator has not completed corrective action, a civil penalty may be assessed
from the date of receipt of the Notice of Violation However, no time period for compliance
need be given for failure to submit an erosion control plan for approval or for obstructing,
hampering or interfering with an authorized representative while in the process of carrying
out his official duties. Each day of continuing violation shall constitute a separate violation
Section 7-21(3) Civil Penalties states:
Any person who fails to submit an erosion control plan for approval as required by this
ordinance shall be subject to a single, noncontinuing civil penalty of not more than one
thousand dollars ($1,000). Any person who is subject to a civil penalty under this subdivision
may be subject to additional civil penalties for violation of any other provision of this
ordinance, or rules of orders adopted or issued pursuant to this ordinance.
Corrective measure(s) needed Submit the appropriate information requested in the May 12, 1997
letter to your engineer (attached) so a Land -Disturbing Permit can be approved.
Time to CompW Two weeks (14 days) from receipt of this Notice.

Your failure to take the above noted corrective action within the above time period will result

Hanover County's Soil Erosion and Sedimentation Control Ordinance.

Dear Mr. Murrell:
On April 30, 1997, a Stormwater Permit Application was submitted to the Wilmington Regional
Office for the project known as Hanover Towing Addition. On May 16, 1997, staff performed an inspection
at the site to verify soils information provided by your Engineer with the application.
The project has been found in violation of 15A NCAC 2H.1000 and NCGS 143-215.1. The
violations found are:
1. Failure to apply for and receive the stormwater permit prior to construction. The permit
application was submitted to this Office on April 30, 1997, and is still under review. The
gravel parking area and infiltration basin are currently under construction.
To correct these violations you must :
1. Provide a written 'Plan of Action" which outlines the actions you will take to correct the
violations and a time frame for completion of those actions, on or before June 19, 1997.
2. Respond to the May 7, 1997 request for additional information. Any necessary revisions to
the design plans (including the addition of a spreader mechanism) in order to comply with the
regulations must be completed prior to the issuance of a permit.

Failure to provide the "Plan of Action" by June 19, 1997, or to correct the violations by the date
designated in the "Plan of Action", are considered violations of 15A NCAC 2H.1000, and may result in the
initiation of enforcement action which may include recommendations for the assessment of civil and criminal
penalties, pursuant to NCGS 143-215.6A.
The New Hanover County Building Inspector has indicated his willingness to withhold the Certificate
of Occupancy for this project until this matter is satisfactorily resolved. Satisfactory resolution will include
obtaining the stormwater permit, and providing the Engineer's Certification prior to the C of O being issued.

COMMENTS: (each NO answer should have a comment)
1.Your permit expired on June 28, 2007. This office has received your renewal request and will soon be under review.
2. Trees and excessive weed growth is not allowed in the infiltration area. Any trees should be removed.
3. All drainage should be kept on your site and directed to the inlet structure. It appears that an area on the northwest
corner of the basin is allowing flow to drain to the neighboring property. This area should be re -graded to the proper
elevations as contained in your permit.
4. The distribution piping has broken and split apart. This should be replaced and returned to design specifications.
5. It appears that heavy equipment has been driving in the basin based on the tracks that were evident on the inspection
date. You should refrain from driving on the site which can cause compacting of the basin.
6. The basin must be maintained at the proper elevations to allow proper distribution of the stormwater across the basin.
7. The inlet structure appeared to be crooked which would allow more flow to go to one side of the basin than the other. This
should be checked and returned to design specifications if needed. Also check to see if line is plugged.
