Interim Director Subject: State Stormwater Management Permit No. SW8 960705 Marine Chevrolet High Density Protect Onslow County Dear Mr. Alford: Effective August 1, 2013, the State Stormwater program was transferred from the Division of Water Quality (DWQ) to the Division of Energy, Mineral and Land Resources (DEMLR). All previous references to DWQ will remain in older stormwater permits issued prior to August 1, 2013 until they are modified. Please note that this permit references DEMLR as the Division responsible for issuance of the permit. The Wilmington Regional Office received a complete, modified State Stormwater Management Permit Application for the subject project on April 2, 2018. Staff review of the plans and specifications has determined that the project, as proposed, will comply with the Stormwater Regulations set forth in Title 15A NCAC 2I-1.1000. We are forwarding modified Permit No. SW8 960705 dated April 3, 2018, for the construction, operation and maintenance of the stormwater control measures (SCMs), built -upon areas, as well as the stormwater collection system and/or vegetated conveyance system associated with the subject project. Please add the attached plans to the previously approved plan set. Please replace the previous application (SWU-101), supplements, and operation and maintenance agreements with the attached modified versions. Please note that the modified, updated, and re -issued permit does not impose new or different terms; it merely restates some of the previous terms to provide you with a better understanding of your obligations under the permit. This permit shall be effective from the date of issuance until May 9, 2022 and shall be subject to the conditions and limitations as specified therein, and does not supersede any other agency permit that may be required. Please pay special attention to the permit conditions regarding the operation and maintenance of the SCMs, stormwater collection system, and/or vegetated conveyances; the limitation of built -upon area; modification of the project.; the procedures for changing ownership of and/or transferring the permit; and the need to renew the permit. Failure to comply with these requirements will result in future compliance problems. Please refer to Attachment 1 for a detailed description of the current proposed major modification and a list of all the past permits approved during the effective period of the permit. If any parts, requirements, or limitations contained in this permit are unacceptable, you have the right to request an adjudicatory hearing by filing a written petition with the Office of Administrative Hearings (OAI f). The written petition must conform to Chapter 150B of the North Carolina General Statutes and must be filed with the OAH within thirty (30) days of receipt of this permit. The stormwater runoff from the site within Drainage Area 2 will be routed to the offsite wet pond operated and maintained by the City of Jacksonville (the "Master Permittee") under the terms and conditions set forth in the latest version of Stormwater Management Permit No. SW8 950417 (the "Master Permit"). This permit shall be effective from the date of issuance until May 9, 2022, and shall be subject to the following specified conditions and limitations: I. DESIGN STANDARDS 1. This permit is effective only with respect to the nature and volume of stormwater described in the application and other supporting data. 2. The tract will be limited to a total of 418,247 square feet of built -upon area and per the approved plans and specifications. The project and drainage areas will be limited to the amounts of built -upon area indicated in Sections 1.3, 1.4 and 1.8. 3. The onsite wet pond (Drainage Area 1) has been approved for the management of stormwater runoff as described in Section 1.8 of this permit. This stormwater control has been designed to handle the runoff from 327,381 square feet of impervious area. 4. The runoff within Drainage Area 2 has been approved to be discharged into an offsite stormwater system, a wet detention pond, permitted under the latest version of the Master Permit. The built -upon area allocated to this development by the Master Permit, is 90,866 square feet. This project proposes 86,793 square feet. The amount available for future development is 4,073 square feet. This drainage area is limited to the amount of built -upon area indicated in this permit and the approved plans and specifications. The project must maintain a built -upon area less than or equal to the amount permitted under the Master Permit. A total built -upon area in excess of the maximum allowed amount will require a modification to the Master Permit prior to construction and/or the construction of additional stormwater control measures. The proposed onsite wet pond must be operated with a vegetated filter All stormwater collection and treatment systems must be located in either dedicated common areas or recorded easements. The final plats for the project will be recorded showing all such required easements, in accordance with the approved plans. The runoff from all built -upon area within the permitted drainage areas of this project must be directed into the permitted stormwater control system. This permit is issued contingent on the construction of the permitted off -site stormwater system being complete and in compliance with the latest version of the Master Permit, issued to the Master Permittee, and as subsequently modified, transferred, or renewed. Prior to the construction of any built -upon area associated with this permit, the Master Permittee shall have constructed, operated, maintained, and certified the off -site stormwater system in compliance with the Master Permit. 3. During construction, erosion shall be kept to a minimum and any eroded areas of the system will be repaired immediately. If the stormwater system was used as an Erosion Control device, it must be restored to design condition prior to operation as a stormwater treatment device, and prior to occupancy of the facility. 4. The permittee shall at all times provide the operation and maintenance necessary to assure the permitted stormwater system functions at optimum efficiency. The approved Operation and Maintenance Plan must be followed in its entirety and maintenance must occur at the scheduled intervals including, but not limited to: a. Semiannual scheduled inspections (every 6 months). b. Sediment removal. C. Mowing and revegetation of slopes and the vegetated filter. d. Immediate repair of eroded areas. e. Maintenance of all slopes in accordance with approved plans and specifications. f. Debris removal and unclogging of outlet structure, orifice device, flow spreader, catch basins and piping. q. Access to the outlet structure must be available at all times. Records of maintenance activities must be kept and made available upon request to authorized personnel of the Division. The records will indicate the date, activity, name of person performing the work and what actions were taken. Page 4 of 8 State Stormwater Management Systems Permit No. SW8 960705 6. Upon completion of construction, prior to issuance of a Certificate of Occupancy, and prior to operation of this permitted facility, a certification must be received from an appropriate designer for the system installed certifying that the permitted facility has been installed in accordance with this permit, the approved plans and specifications, and other supporting documentation. Any deviations from the approved plans and specifications must be noted on the Certification. A modification may be required for those deviations. 7. Decorative spray fountains will not be allowed in the stormwater treatment system until calculations are provided documenting the permeant pool volume is greater than 30,000 cubic feet. The facilities shall be constructed, operated and maintained in accordance with the provisions of this permit, the approved plans and specifications, and the supporting documents attached to this permit and on file with the Division Access to the stormwater facilities shall be maintained via appropriate easements at all times. 10. The permittee shall submit to the Director and shall have received approval for revised plans, specifications, and calculations prior to construction, for any modification to the approved plans, including, but not limited to, those listed below: a. Any revision to any item shown on the approved plans, including the stormwater management measures, built -upon area, details, etc. b. Project name change. c. Transfer of ownership. d. Redesign or addition to the approved amount of built -upon area or to the drainage area. e. Further subdivision, acquisition, lease or sale of all or part of the project area. The project area is defined as all property owned by the permittee, for which Sedimentation and Erosion Control Plan approval or a CAMA Major permit was sought. f. Filling in, altering, or piping of any vegetative conveyance shown on the approved plan. 11. The permittee shall submit final site layout and grading plans for any permitted future areas shown on the approved plans, prior to construction. 12. The Director may notify the permittee when the permitted site does not meet one or more of the minimum requirements of the permit. Within the time frame specified in the notice, the permittee shall submit a written time schedule to the Director for modifying the site to meet minimum requirements. The permittee shall provide copies of revised plans and certification in writing to the Director that the changes have been made. Ill. GENERAL CONDITIONS Any individual or entity found to be in noncompliance with the provisions of a stormwater management permit or the requirements of the stormwater rules is subject to enforcement procedures as set forth in NCGS 143 Article 21. 2. The issuance of this permit does not preclude the Permittee from complying with any and all statutes, rules, regulations, or ordinances, which may be imposed by other government agencies (local, state, and federal) having jurisdiction. 3. In the event that the facilities fail to perform satisfactorily, including the creation of nuisance conditions, the Permittee shall take immediate corrective action, including those as may be required by this Division, such as the construction of additional or replacement stormwater management systems. These additional or replacement measures shall receive a permit from the Division prior to construction. Page 5 of 8 State Stormwater Management Systems Permit No. SW8 960705 4. This permit is not transferable to any person or entity except after notice to and approval by the Director. The permittee shall submit a completed and signed State Stormwater Request Form for Permit Transfer or Permit Information Update, accompanied by the supporting documentation as listed on the form, to the Division at least 60 days prior to any one or more of the following events: a. Any ownership change including: I. The sale or conveyance of the project area in whole or in part, except in the case of an individual lot sale that is made subject to the recorded deed restrictions and protective covenants; ii. Dissolution of the partnership or corporate entity, subject to NCGS 57D-2- 01(e) and NCGS 57D-6-07; b. Bankruptcy; c. Foreclosure, subject to the requirements of Session Law 2013-121; d. A name change of the current permittee; e. A name change of the project; f. A mailing address change of the permittee; 5. The permittee is responsible for compliance with all terms and conditions of this permit until the Division approves the transfer request. Neither the sale of the project, in whole or in part, nor the conveyance of common area to a third party constitutes an approved transfer of the permit. 6. The permittee grants Division Staff permission to enter the property during normal business hours to inspect all components of the permitted project. 7. The permit issued shall continue in force and effect until the permittee files a request with the Division for a permit modification, transfer, renewal, or rescission, however, these actions do not stay any permit conditions. 8. Unless specified elsewhere, permanent seeding requirements for the stormwater control must follow the guidelines established in the North Carolina Erosion and Sediment Control Planning and Design Manual. 9. Approved plans, application documents, supplements, calculations, operation and maintenance agreement, and specifications for this project are incorporated by reference and are enforceable parts of the permit. A copy of this permit, application, supplements, operation and maintenance agreement, and approved revised plans and specifications shall be maintained on file by the permittee. 10. The issuance of this permit does not prohibit the Director from reopening and modifying the permit, revoking and reissuing the permit, or terminating the permit for cause as allowed by the laws, rules, and regulations contained in Title 15A NCAC 2H.1000 and NCGS 143- 215.1 et.al. 11. A permit renewal request must be submitted at least 180 days prior to the expiration date of this permit. The renewal request must include the appropriate application, documentation and the processing fee as outlined in Title 15A NCAC 021-1.1045(3). I'm not sure where the difference came from but I expect it is in the rounding from acres to square feet by the original permittee. To make it easy,on both of us, the best thing to do is to revise the drainage area in IV.10 based on the original pond drainage area minus the 5,345 SF. At the time of the original site's construction, 1.01 acres of the property was not developed though the BUA was accounted for in the wet detention basin's design. We had all three (Aldan, Jonathan and myself) walked away from the meeting thinking we could just cut those two acres out or away from the Low Density permit for the Commons so the High density permit that the City issued would stand. That is why we got behind, didn't realize that was not an option anymore until last week. However Aldon and I have worked the last two days on filling out the paperwork. I have a question. Is there an offsite permit fee? If so, what is that amount? Will you or do you take credit cards for payment? I am planning on driving the whole package to Wilmington on this Friday. If you take credit cards and there is an offsite fee I can pay then. If not, if we do a "PO" for a check to be cut, it won't be done until Tuesday. If it comes down to that, if we can get the whole package to you Friday, and you don't take credit cards, can you accept the check for the offsite permit on Tuesday of next week? It has been demonstrated that the pond is taking runoff from the Commons project area. The same entity needs to be able to enforce the entire drainage area. The two options discussed and agreed to at the meeting, discussed in follow-up emails, and listed in the Notice of Inspection / Request for Additional Information are: • Include the wet pond within the City of Jacksonville property in the permit for SW8 950417. 'I'his would require the application submitted on August 14, 207 to be revised to include the wet pond as an area of high density. • The City of Jacksonville take over the entire permit under the current rules. If the intent is to go with the first option, then yes, a complete pond submittal is required including calculations, supplements, C&M, and plans for the pond.
