Dear Dr. Williamson:
Effective August 1, 2013 the State Stormwater program was transferred from the Division of Water
Quality (DWQ) to the Division of Energy, Mineral and Land Resources (DEMLR). All previous
references to DWQ will remain in older stormwater permits issued prior to August 1, 2013 until they are
modified. Please note that any updated pages or addendums to this permit will now reference DEMLR as
the Division responsible for issuance of the permit
On January 13, 2016, the Wilmington Regional Office received a complete request to transfer ownership
of the subject state stormwater management permit under the provisions of Session Law 2013-121.
Additionally, a change to the project name was also requested. Staff of DEMLR has inspected the project
and reviewed the available documentation, and determined that the project is currently in compliance with
the terms and conditions of the state stormwater permit.
The Division has determined that the provisions of SL 2013-121 have been met as indicated by the
supporting documents and findings listed below:
1. The successor -owner of the property has submitted a written request for the transfer of the permit.
Reference is made to the attached signed Name/Ownership Change Form;
2. The original permit holder, Odell Williamson with Ocean Isle Beach Realty, sold the property on
which the permitted activity is occurring.
3. The successor -owner holds title to the property on which the permitted activity is occurring.
Reference is made to the deed recorded on May 14, 1997 in deed book 1146 on page 701.
4. The successor owner has not proposed any substantial changes to the permitted activity.
5. The updated permit does not impose new or different terms — it merely restates some of the
previous terms to provide you with a better understanding of your obligations under the permit.
By signing the Name/Ownership Change Form and acknowledging receipt of a copy of the permit, which
includes the application and supplement forms, a copy of the approved plans and a copy of the required
Operation and Maintenance agreement, you have accepted the responsibility for complying with the terms
and conditions outlined in this permit. The Division is hereby notifying you that the subject permit has
been transferred per the requirements of SL 2013-121 and the project name has been changed on March 7,
2016.
Permit Renewal
On March 7, 2106, the Wilmington Regional Office received two (2) complete 8 year Stormwater
Management Permit Renewal Application for the subject project. The Division is hereby notifying you
that permit SW8 960404 has been renewed on March 8, 2016, and shall be effective until .October 17,
2022. The plans originally approved on October 17, 1996, will remain in full force and effect in
accordance with the regulations set forth in Title 15A NCAC 2H.1000 effective September 1, 1995.

Permit Correction
Please note that during the review and update of this permit, it was discovered that the original permit
contained errors. This permit correction is intended to correct the receiving waters, correct the total
amount of built -upon area approved for this project and correct the number of approved stormwater
control measures. The receiving waters has been corrected to the Eastern Channel with an index of 15-
25-6 and a classification of SA, HQW. The previously issued permit listed 34,575 square feet of built -
upon area to be treated in a single infiltration trench. However this permit clarifies that there are 3
approved stormwater control measures: two (2) infiltration trenches and one (1) infiltration basin treating
the runoff from a total of 36,159 square feet of built -upon area as documented in the calculations from
East Coast Engineering dated August 6, 1996.
For your records, please find enclosed an updated permit, a copy of the Name/Ownership Change form, a
copy of the renewal application, and a copy of the inspection report. Please keep this permit on file at all
times. This permit is subject to the conditions and limitations as specified in the updated permit
If any parts, requirements, or limitations contained in this permit are unacceptable, you have the right to
request an adjudicatory hearing by filing a written petition with the Office of Administrative Hearings
(OAH). The written petition must conform to Chapter 150B of the North Carolina General Statutes, and
must be filed with the OAH within thirty (30) days of receipt of this permit. You should contact the OAH
with all questions regarding the filing fee (if a filing fee is required) and/or the details of the filing process
at 6714 Mail Service Center, Raleigh, NC 27699-6714, or via telephone at 919-431-3000, or visit their
website at www.NCOAH.com. Unless such demands are made this permit shall be final and binding.

construction, operation and maintenance of two (2) infiltration trenches and one (1) natural
dune area acting as an infiltration basin (hereafter referred to as infiltration system or
stormwater control measures) in compliance with the provisions of 15A NCAC 2H .1000
(hereafter referred to as the "stormwater rules') and the approved stormwater management
plans and specifications and other supporting data as attached and on file with and approved
y the Division of Energy, Mineral and Land Resources (hereafter referred to as the Division
or DEMLR) and considered a part of this permit.
This permit shall be effective from the date of issuance until October 17, 2022, and shall be
subject to the following specified conditions and limitations:
I. DESIGN STANDARDS
This permit is effective only with respect to the nature and volume of stormwater
described in the application and other supporting data.
2. This stormwater system has been approved for the management of stormwater runoff
as described in Section 1.7 and 1.8 of this permit. The runoff from all built -upon area
within the permitted drainage areas of this project must be directed into the permitted
stormwater control measures. The stormwater controls identified as Area 1-8, 10; Area
9; and Area 12 have been designed to handle the runoff from 32,981, 1,594, and
1,584 square feet of impervious area, respectively.
3. The maximum built -upon area allowed for the entire project is 36,159 square feet.
4. The drainage areas will be limited to the amounts of built -upon area indicated in
Sections 1.2, 1.7, and 1.8 of this permit, and per approved plans.
5. The excess design storm overflow from the infiltration system labeled Area 1-8,10
must be directed into a 50 foot vegetated filter strip and level spreader, designed per
Section .1008 (f) of the stormwater rules.

6. The infiltration systems labeled Area 9 and Area 12 are permitted per the Alternative
Design Criteria under Section .1008 (h). These proposed systems provides equal or
better control, equal or better protection of surface waters and results in no increased
potential for nuisance conditions. The infiltration systems has been designed to handle
the 25 year storm without discharging therefore neither an LSNFS nor an offline
bypass are required.
7. The following design criteria have been permitted for the two (2) infiltration trenches
and it must be provided and maintained at the design condition:

II. SCHEDULE OF COMPLIANCE
No person or entity, including the permittee, shall alter any component of the approved
stormwater system shown on the approved plans unless and until the Division has
approved of the revised plan.
2. The stormwater management system shall be constructed in its entirety, vegetated
and operational for Its intended use prior to the construction of any built -upon surface.
3. During construction, erosion shall be kept to a minimum and any eroded areas of the
system will be repaired immediately.
4. The permittee shall at all times provide the operation and maintenance necessary to
assure that all components of the permitted stormwater system function at design
condition. The approved Operation and Maintenance Agreement is incorporated by
reference into this permit and must be followed in its entirety and maintenance must
occur at the scheduled intervals.
5. Records of maintenance activities must be kept and made available upon request to
authorized personnel of the Division. The records will indicate the date, activity, name
of person performing the work and what actions were taken.
6. The facilities shall be constructed in accordance with the conditions of this permit, the
approved plans and specifications, and other supporting data.
7. Upon completion of construction, prior to issuance of a Certificate of Occupancy, and
prior to operation of this permitted facility, a certification must be received from an
appropriate designer for the system installed certifying that the permitted facility has
been installed in accordance with this permit, the approved plans and specifications,
and other supporting documentation. Any deviations from the approved plans and
specifications must be noted on the Certification. A modification may be required for
those deviations.

8. The permittee shall submit to the Director and shall have received approval for revised
plans, specifications, and calculations prior to construction, for any modification to the
approved plans, including, but not limited to, those listed below:
a. Any revision to any item shown on the approved plans, including the stormwater
management measures, built -upon area, details, etc.
b. Redesign or addition to the approved amount of built -upon area or to the
drainage area.
C. Further development, subdivision, acquisition, lease or sale of any, all or part of
the project area. The project area is defined as all property owned by the
permittee, for which Sedimentation and Erosion Control Plan approval or a
CAMA Major permit was sought.
d. Filling in, altering, or piping of any vegetative conveyance shown on the
approved plan.
e. The construction of any future BUA listed on the application.
9. Prior to transfer of the permit, the stormwater facilities will be inspected by Division
personnel. The project and the stormwater facility must be in substantial compliance
with all permit conditions. Any items not in substantial compliance must be repaired,
replaced or restored to design condition prior to the transfer. Records of maintenance
activities performed to date will be required.
10. The Director may notify the permittee when the permitted site does not meet one or
more of the minimum requirements of the permit. Within the time frame specified in the
notice, the permittee shall submit a written time schedule to the Director for modifying
the site to meet minimum requirements. The permittee shall provide copies of revised
plans and certification in writing to the Director that the changes have been made.
III. GENERAL CONDITIONS
Any individual or entity found to be in noncompliance with the provisions of a
stormwater management permit or the stormwater rules, is subject to enforcement
action as set forth in NCGS 143, Article 21.
2. The issuance of this permit does not preclude the Permittee from complying with any
and all statutes, rules, regulations, or ordinances, which may be imposed by other
government agencies (local, state, and federal) having jurisdiction.
3. In the event that the facilities fail to perform satisfactorily the Permittee shall take
immediate corrective action, including those as may be required by this Division, such
as the construction of additional or replacement stormwater management systems.
Additional or replacement stormwater management systems shall receive a permit
from the Division prior to construction.
4. This permit is not transferable to any person or entity except after notice to and
approval by the Director. The permittee shall submit a completed and signed
Name/Ownership Change Form, accompanied by the supporting documentation as
listed on the form, to the Division at least 60 days prior to any one or more of the
following events:
a. An ownership change including the sale or conveyance of the project area in
whole or in part;
b. The sale or conveyance of the common areas to a Homeowner's or Property
Owner's Association, subject to the requirements of Session Law 2011-256;
C. Bankruptcy;
d. Foreclosure;
e. Dissolution of the partnership or corporate entity;
f. A name change of the current permittee;
g. A name change of the project;
h. A mailing address change of the permittee;

5. The permittee is responsible for compliance with all permit conditions until such time
as the Division approves the transfer request. Neither the sale of the project, in whole
or in part, nor the conveyance of common area to a third party constitutes an approved
transfer of the stormwater permit.
6. The permittee grants DEMLR Staff permission to enter the property during normal
business hours for the purpose of inspecting all components of the permitted
stormwater management facility.
7. The permit issued shall continue in force and effect until modified, revoked, terminated
or renewed. The permit may be modified, revoked and reissued or terminated for
cause. The filing of a request for a permit modification, revocation and re -issuance or
termination does not stay any permit condition.
8. Approved plans, calculations, supplement forms, operation and maintenance
agreements and specifications for this project are incorporated by reference and are
enforceable parts of the permit. A copy of the approved plans and specifications shall
be maintained on file by the Permittee at all times.
9. The issuance of this permit does not prohibit the Director from reopening and
modifying the permit, revoking and reissuing the permit, or terminating the permit as
allowed by the laws, rules and regulations contained in Session Law 2008-211, Title
15A NCAC 2H.1000, and NCGS 143-215.1 et. al.
10. The permittee shall submit a permit renewal application request at least 180 days prior
to the expiration date of this permit. The renewal request must include the appropriate
application, documentation and the processing fee.

A request to transfer a permit will not be approved by the Division of Water Quality (DWQ) unless all
of the applicable required items listed below are included with the submittal. Failure to provide the
listed items may result in processing delays or denial of the transfer.
1. This completed and signed form. This certification must be completed and signed by both the
current permit holder and the new applicant if this is a change of ownership.
2. Legal documentation of the property transfer to a new owner.
3. A copy of any recorded deed restrictions, covenants, or easements, if required by the permit.
4. The designer's certification (DWQ Engineer and Designer Certification Forms are available from
each DWQ Regional office), if required by the permit and if not already submitted to DWQ.
5. If the proposed permittee is a firm, partnership, association, institution, corporation, limited liability
company, or other corporate entity, provide documentation showing the authority of the named
representative to act on behalf of the proposed permittee.
6. The $40.00 processing fee. If this is an initial transfer from the original permittee the processing
fee is not required. Subsequent ownership transfers will require the $40.00 processing fee.

PROJECT DESCRIPTION
The project consists of a stormwater infiltration system along West First Street of Ocean Isle
Beach within Brunswick County. The original stormwater permit was issued in October of 1996
for eight separate parcels in the name of Ocean Isle Beach Realty, with property ownership in the
name of Odell and Virginia Williamson. Original permit expiration was October 2006. Project
was constructed and a substantial compliance certification was submitted by David B. Bowman,
PE on July 14, 1998.
Ownership of said property (eight parcels) was transferred in April of 1997 to Odell DeCarol
Williamson. Ownership was transferred to The Islander Inn, Inc. on May of 1997. An Instrument
of Combination combining the eight separate parcels into one single tax parcel number with
ownership still reflected as The Islander Inn, Inc. in August 2013.
Dr. Odell DeCarol Williamson is listed with the North Carolina Dept. of the Secretary of State as
President of the Corporation.

On September 9, 2015, the Wilmington Regional Office of the Division of Energy, Mineral and Land
Resources (DEMLR) conducted a file review inspection of the Ocean Isle Beach. Motel Islander Inn
permit, located off First St, Ocean Isle Beach in Brunswick County to determine the status of
compliance with the State Stormwater Management Permit Number SW8 960404 issued on October
17, 1996. DEMLR file review revealed that the site is not in compliance with the terms and conditions
of this permit. Please find a copy of the completed form entitled "Compliance Inspection Report"
attached to this letter, which summarizes the findings of the recent inspection.
As indicated in the attached inspection report, the following deficiencies must be resolved:
15A NCAC 21-1.1003 (h): This permit expired on October 17, 2006 and must be renewed. The
current renewal period is 8 years. In order to bring this permit into an active status, two
renewals are required to be submitted as demonstrated below:
Renewal 1: October 17, 2006 + 8 years = October 17, 2014 (new expiration date)
Renewal 2: October 17, 2014 + 8 years = October 17, 2022 (new expiration date)

2. Permit conditions 1.6 and 111.1: According to the Brunswick County GIS website and tax records,
it appears that the property associated with this permit has been transferred to The Islander Inn,
Inc. Per the aforementioned permit conditions, a request must be submitted to the Division to
transfer the ownership of the permit.
In order to transfer the permit, please submit the appropriate Name/Ownership change form
available on our website at: http://portal.ncdenr.oM/web/ir/state-stormwater-forms docs along
with the documentation necessary to transfer the permit to the new owner. Please note that the
"HOA Name/Ownership Change Form" is only for use by permittees that have developed their
project under the Planned Community Act. The other "Name/Ownership Change Form" is for all
other projects planning to change the name of the project or transferring their permit to the new
owner of the project.
Please inform this Office in writing before October 12, 2015, of the specific actions that will be
undertaken and the time frame that will be required to correct the deficiencies. Failure to provide the
requested information, or to respond to this letter by the due date, may initiate enforcement action
including the assessment of civil penalties of up to $25,000 per day. If a written plan of action is not
submitted to this office by October 12, 2015 then DEMLR staff will re -inspect the site and issue a Notice
of Violation if the listed deficiencies have not been addressed.

or if the permit holder has changed its name and/or mailing address, or if the project name has
