Marine Boulevard Jacksonville, NC 28546 Subject: Stormwater Management Permit No. SW8 960326 Modification Don Williamson Nissan High Density Alternative Stormwater Project Onslow County Dear Mr. Williamson: Dee Freeman Secretary On June 20, 2012, the Wilmington Regional Office of the Division of Water Quality renewed the stormwater management permit for the subject project, and initiated the review of the proposed ownership transfer to DWNR, LLC, and a project name change to Don Williamson Nissan. The two compliance items identified in the April 5, 2012 Notice of Deficiency have been provided, namely, the permit has been renewed and the Designer's Certification has been submitted. Staff review of the file documents, plans and specifications has determined that the project, as proposed, complies with the Stormwater Regulations set forth in Title 15A NCAC 2H.1000. We are forwarding the renewed and transferred Permit No. SW8 960326 Modification dated August 8, 2012, for the construction, operation and maintenance of the built -upon areas and BMP's associated with the subject project. This permit shall be effective from the date of issuance until June 20, 2020, and shall be subject to the conditions and limitations as specified therein. Please pay special attention to the conditions listed in this permit regarding the Operation and Maintenance of the BMPs, certification of the BMP's, and the procedures for changing ownership, transferring the permit, and renewing the permit. Failure to establish an adequate system for operation and maintenance of the stormwater management system, to certify the BMP's, to transfer the permit, or to renew the permit, will result in future compliance problems. The plans previously approved on April 4, 1997 remain as the approved plan set for this project. If any parts, requirements, or limitations contained in this permit are unacceptable, you have the right to request an adjudicatory hearing by filing a written petition with the Office of Administrative Hearings (OAH). The written petition must conform to Chapter 150B of the North Carolina General Statutes, and must be filed with the OAH within thirty (30) days of receipt of this permit. This permit shall be effective from the date of issuance until April 4, 2007 and shall be subject to the following specified conditions and limitations: I. DESIGN STANDARDS This permit is effective only with respect to the nature and volume of stormwater described in the application and other supporting data. 2. This stormwater system has been approved for the management of stormwater runoff as described in Section 1.6 of this permit. The Stormceptor@ STC 1800 has been designed to handle the runoff from 46,072 ft=, and the sediment pits have been designed to handle the runoff from 31,000 ft2 of impervious area. 3. Approved plans and specifications for this project are incorporated by reference and are enforceable parts of the permit. 4. The tract and each drainage area will be limited to the amount of built -upon area indicated in Section 1.2 of this permit, and as indicated on the approved plans. 5. Stream Classification: "SC HQW NSW" OAvailable in 273 If 48" pipe, 75 If 18" pipe, and 244 cf within STC 1800 unit itself. II. SCHEDULE OF COMPLIANCE 1. The permittee is responsible for verifying that the built -upon area within each drainage area does not exceed the maximum allowed under this permit. 2. Prior to construction, the permittee shall have submitted a modified permit application package and received approval for any modification, including but not limited to the following: a. Any revision to the approved plans, regardless of size. b. Redesign or addition to the approved amount of built -upon area. C. Further subdivision of the project area. d. Alteration of any BMP, drainage feature, collection system, or vegetative conveyance shown on the approved plan from its approved condition. 3. In addition, the Director may determine that other revisions to the project should require a modification to the permit. 4. The Director may notify the permittee when the permitted site does not meet one or more of the minimum requirements of the permit. Within the time frame specified in the notice, the permittee shall submit a written time schedule to the Director for modifying the site to meet minimum requirements. The permittee shall provide copies of revised plans and certification in writing to the Director that the changes have been made. 5. The stormwater management system shall be constructed in its entirety, vegetated and operational for its intended use prior to the construction of any built -upon surface except roads. 6. During construction, erosion shall be kept to a minimum and any eroded areas of the system will be repaired immediately. Page 4 of 6 State Stormwater Management Systems Stormwater Permit No. SW8 960326 Mod The permittee shall at all times provide the operation and maintenance necessary to assure the permitted stormwater system functions at optimum efficiency. The approved Operation and Maintenance Plan for each BMP must be followed in its entirety and maintenance must occur at the scheduled intervals including, but not limited to: a. Semiannual scheduled inspections (every 6 months). b. Sediment removal. c. Mowing and revegetation of side slopes. d. Immediate repair of eroded areas. e. Maintenance of side slopes in accordance with approved plans and specifications. f. Debris removal and unclogging of outlet structure, orifice device and catch basins and piping. g. Access to the pump and outlet structure must be available at all times. The pump shall be inspected every 6 months, cycled, and routine maintenance peformed. The pump shall be maintained in good eperating condition. If the pump fails, immediate repair/replacement to original design specifications is required. 8. Records of maintenance activities must be kept and made available upon request to authorized personnel of DWQ. The records will indicate the date, activity, name of person performing the work and what actions were taken. 9. This permit shall become voidable unless the facilities are constructed in accordance with the conditions of this permit, the approved plans and specifications, and other supporting data. 10. Upon completion of construction, prior to issuance of a Certificate of Occupancy, and prior to operation of this permitted facility, a certification must be received from an appropriate designer for the system installed certifying that the permitted facility has been installed in accordance with this permit, the approved plans and specifications, and other supporting documentation. Any deviations from the approved plans and specifications must be noted on the Certification. The required Designer's Certification for the permitted project was submitted on May 15, 2012. 11. A copy of this permit, O&M agreements, the approved plans, and specifications shall be maintained on file by the Permittee at all times. III. GENERAL CONDITIONS This permit is not transferable to any person or entity unless approved by the Director. At least 30 days prior to an ownership change (including the dissolution of the LLC), or a name change of the owner or of the project, or a mailing address change, the permittee shall submit a completed and signed Name/Ownership Change Form to the Division of Water Quality accompanied by the required documentation as listed on the form. The approval of this request will be considered on its merits and may or may not be approved. 2. Failure to abide by the conditions and limitations contained in this permit may subject the Permittee to enforcement action by the Division of Water Quality, in accordance with North Carolina General Statute 143-215.6A to 143-215.6C. 3. The issuance of this permit does not preclude the Permittee from complying with any and all statutes, rules, regulations, or ordinances which may be imposed by other government agencies (local, state, and federal) which have jurisdiction. 4. In the event that the facilities fail to perform satisfactorily, the Permittee shall take immediate corrective action, including those as may be required by this Division, such as the construction of additional or replacement stormwater management systems. 5. The permittee grants DEHNR Staff permission to enter the property for the purpose of inspecting all components of the permitted stormwater management facility. DWQ file review and site inspection revealed that the site is not in compliance with the terms and conditions of this permit. Our stormwater permit covers the right half of the shaded area on your plan. However, there is no building on our plan, it is only "proposed asphalt". Those 2 adjoining "shaded" properties to the north with access to Doctor's Drive, were not part of the Cardinal Motors site on our approved plan. The lot on the corner had existing asphalt, but the other one to the east was undeveloped in 1996. Do you see that small note to the right of the northern -most driveway, and just west of the sidewalk, below the shaded side of the project, that points to a small circle and says "Existing Stormceptor"? That's one of our permitted BMP's. The other BMP is a small permanent "sediment pit" in a 20' drainage easement behind that long narrow building at the back (east side) of the property where it abuts the Jacksonville Doctors Park LLC property. It's wedged between the property line and the back of the curb line on the Doctors Park property. On our approved plan, the Stormceptor is located within the property of Cardinal Motors. On this plan, it looks like it's now within the right-of-way. I expect the addition of that turn lane on Western Boulevard may have pushed the ROW back, or the unit was not installed in the correct location in the first place. That will be a problem, as Mr. Williamson may need to obtain a permit from DOT in order to maintain it. The "new" part of the project (the unshaded area on your plan) is shown on my approved plan from 1996 as 100% impervious, but it was not part of the 1996 project area or permit — it was noted on the plans as "existing" because my project was only the 78,000 square foot "expansion" of Cardinal Motors located in the shaded part of your plan. It's called a "Stormceptor". It's essentially a glorified oil/water separator. The Cardinal Motors site was issued one of the first "innovative" design permits for that new technology. We no longer issue permits for stormceptors because they don't achieve the minimum 85% TSS removal. They are great as pretreatment devices, but not stand-alone. When there is an existing permit, the site can't be issued a "redevelopment" permit — it would require a permit modification. I'd be willing to let the City take over the whole site if you'll require Mr. Williamson to take the existing permitted site and BMP into account and include them in any permits you issue for the additional project area. But, Mr. Jacobs (or his legal heir) would have to request that the existing state permit be transferred to Mr. Williamson first, and then we could rescind that old state permit upon issuance of the City's all-inclusive permit to Mr. Williamson. On March 7, 2011, staff of the Wilmington Regional Office performed an inspection of the project and conducted a file review to determine the status of compliance with Stormwater Management Permit Number SW8 960326, which was issued to Mr. Clifton Jacobs on April 4, 1997, for Cardinal Motors Expansion, located at 310 Western Boulevard, Jacksonville, Onslow, County, North Carolina. On April 4, 2007, this permit expired. The site's built -upon areas and BMP's have been constructed, but the site has no active permit, which is a violation of NCGS 143-215.1. As a result of the site inspection and Di file review, the following violations are noted: 1. Failure to Renew State Stormwater Permit Title 15A NCAC 2H .1003 (h) (2) requires that applications for permit renewals be submitted 180 days prior to the expiration of the permit. On October 4, 2006 (180 days prior to expiration of permit), an application for a permit renewal was required to be submitted to DWQ. As of the date of this letter, DWQ has not received an application to renew Stormwater Permit SW8 960326. II. Failure to Transfer the Permit to the New Property Owner. The Onslow County Tax Records indicate that the property at 310 Western Boulevard is now owned by Don Williamson, DWNR, LLC. Per Section 111.1, the permittee is required to submit a formal request to the Division, to approve the transfer of the permit. To date, no formal request to transfer the permit has been submitted and the Division has not approved a transfer of this permit . If Mr. Jacobs (or his legal heir) does not complete, sign and submit the attached Name/Ownership Change form, by May 2, 2012, the permit will modified for good cause as allowed under NCAC 02H.1011 and transferred to Mr. Williamson as the current property owner of record. The inspection and DWQ file review confirms that Mr. Williamson does not currently hold an active State Stormwater Management Permit for this project. Mr. Williamson is currently in violation of NCGS 143-215.1, making an outlet into waters of the State and construction or operation of a treatment works, without having received a permit to do so. Mr. Williamson must now either apply for a new permit under today's rules, or accept the renewed and transferred permit. It is to Mr. Williamson's benefit to accept the renewed and transferred permit. IV. Failure to Submit the Required Designer's Certification The construction of the project's built -upon areas and BMP's has been completed and placed into operation. Per Section 11.5 of the permit, the permittee is required to submit a certification from an appropriate designer for the type of system installed, prior to the operation of that system. To date, DWQ has not received the required Designer's Certification. This particular permitted BMP was a new and innovative technology at the time called Stormceptor®. Certification of this technology is paramount to its continued use as a permitted BMP under this permit. Failure to certify the BMP may lead to additional violations and enforcement action to remove the BMP and provide a replacement BMP. A Notice of Violation dated March 21, 2011 was sent to Mr. Jacobs at the business address of 310 Western Boulevard. No response to that NOV has been received, either from Mr. Jacobs or Mr. Williamson. This Office requires that both parties respond to this letter in writing within 60 calendar days of receipt of this Notice. Your response should be sent to this office at the letterhead address. Please complete, sign and submit the enclosed renewal application with a new signed O&M agreement and a Designer's Certification along with the processing fee, currently set at $505.00. This Office is considering an enforcement action including the assessment of civil penalties regarding these violations and any continuing violations that may be encountered.
