Dear Mr. Nipp:
The Wilmington Regional Office received a complete 8 year Stormwater Management Permit Renewal
Application for Hock Subdivision on November 21, 2013. This site was inspected on June 4, 2013, and as
noted in the enclosed inspection report, the site is currently in compliance with the terms and conditions
of the current state stormwater permit. The Division is hereby notifying you that permit SW8 960321 has
been renewed on December 11, 2013, and shall be effective until May 22, 2022. The plans previously
approved on May 29, 1996, in accordance with the regulations set forth in Title 15A NCAC 2H.1000
effective September 1, 1995, shall remain in full force and effect. Please attach this cover letter and
permit addendum to your High Density Permit originally issued on May 29, 1996.
Upon file review for this Renewal, it was noticed that applications for Plan Revision have not been
received for Tracts B, G, and J, which all have built -upon area on them (reference the BUA Summary
table attached). Therefore, please request that the Owners of these tracts submit applications for Plan
Revision including as -built plans. Failure to submit these applications within thirty (30) days will result in
future compliance problems.
This permit is subject to the conditions and limitations as specified therein. Please pay special attention
to the conditions listed in this permit regarding the Operation and Maintenance of the BMP(s), recordation
of deed restrictions, procedures for changing ownership, transferring the permit, and renewing the
permit. Failure to establish an adequate system for operation and maintenance of the stormwater
management system, to record deed restrictions, to transfer the permit, or to renew the permit, will result
in future compliance problems.
If any parts, requirements, or limitations contained in this permit are unacceptable, you have the right to
request an adjudicatory hearing by filing a written petition with the Office of Administrative Hearings
(OAH). The written petition must conform to Chapter 150E of the North Carolina General Statutes, and
must be filed with the OAH within thirty (30) days of receipt of this permit. You should contact the OAH
with all questions regarding the filing fee (if a filing fee is required) and/or the details of the filing process
at 6714 Mail Service Center, Raleigh, NC 27699-6714, or via telephone at 919-431-3000, or visit their
website at www.NCOAH.com. Unless such demands are made this permit shall be final and binding.

construction, operation and maintenance of one wet detention pond in compliance with the
provisions of 15A NCAC 2H .1000 (hereafter referred to as the "stormwaterrules') and the
approved stormwater management plans and specifications and other supporting data as
attached and on file with and approved by the Division of Water Quality and considered a part of
this permit.
The permit is hereby renewed subject to the following addendums, clarifications, conditions and
limitations:
1. The original permit conditions contained in the permit issued on May 29, 1996
remain in full force and effect, except as amended herein. (An additional copy of this
original permit can be obtained from the Division of Water Quality, Wilmington
Regional Office.)
2. This permit shall be effective from the date of issuance until May 22, 2022.
3. The permittee shall submit a permit renewal application request at least 180 days
prior to the expiration date of this permit. The renewal request must include the
applicable documentation and the processing fee.
4. Decorative spray fountains are allowed in a wet detention pond, subject to the
following criteria:
a. The fountain must draw its water from less than 2' below the permanent pool
surface.
b. Separated units, where the nozzle, pump and intake are connected by tubing,
may be used only if they draw water from the surface in the deepest part of the
pond.
c. The falling water from the fountain must be centered in the pond, away from the
shoreline.
d. The maximum horsepower for a fountain in this pond is based on the permanent
pool volume, as shown in Table 10-5 of the BMP manual.
5. If the use of permeable pavement is desired, this permit must be modified to add the
permeable pavement conditions.

This form may be photocopied for use as an original
'['his form is to be completed by the current permit holder pursuant to Title 15A NCAC 2H.1003 (h) (2). This states
that stormwater management permits, issued for projects that require the construction of engineered stormwater
control measures (High Density Permits), shall be required to submit an application to renew the permit 180 days
prior to expiration of the permit. Renewed permits are valid for a period of 8 years per Session Law 2011-398 (SB
781) Section 60. (c).
1. SUBMITTAL REQUIREMENTS
Only complete application packages will be accepted and reviewed by the North Carolina Department of
Environment and Natural Resources (NCDENR) Division of Energy Mineral and Land Resources (DEMLR). A
complete package includes all of the items listed below. The complete application package should be submitted
to the appropriate DEMLR Regional Office. (The appropriate office may be found by clicking on the interactive

from the Regional Office of the Division of Energy, Mineral and Land Resources.)

On September 27, 2013, the Division received an incomplete State Stormwater Management
Application for the project listed above. The application is being returned because the
application package lacked the necessary elements to accept it for review. Please provide the
following information upon the next submittal of this application package:
The permittee for the Hock Subdivision is Stormwater Owner's Association, Inc and they
must submit any modifications or revisions to Permit # SW8 960321. You have two
options:
a. Work with the permittee, Stormwater Owner's Association, Inc, to submit the
modification to this master permit. The application and documents discussing
the permitted area must cover the entire permitted area, not just the area
associated with Triangle Rentacar.
b. Obtain an offsite permit for your lot. One benefit to this option is that any future
changes proposed within the lot will not involve Stormwater Owner's Association,
Inc. This option for an offsite permit was created after the plans for this site were
submitted on August 23, 1996.
2. It is the understanding of the Division that NC DOT is proposing changes to Cinema Dr
that will affect this permit. NC DOT and Stormwater Owner's Association, Inc will need
to work together to modify the state stormwater permit for any changes proposed by
DOT within the permitted area. Changes can include any additional impervious areas
and any possible changes to the drainage area or outparcel lot areas.

PROJECT NARRATIVE
TRIANGLE RENTACAR PARKING ALIGNMENT
WILMINGTON, NC
This project is being submitted for a REVISION to the existing permit. The address of
the site is 4124 Market Street, Wilmington, NC. The site was originally permitted in
1996. The original project proposed 45,772 sf of impervious area and was issued a
storm water permit by NCDWQ (Permit No. SW8 960321).
This project is a result of NCDOT making improvements to Market Street and Cinema
Drive in Wilmington, NC. NCDOT is acquiring additional right-of-way along Market
Street and Cinema Drive from Triangle Rentacar for the improvements. The property will
be reduced from 1.48 acres to 1.31 acres. As a result of these improvements, Triangle
Rentacar is adding a driveway on Cinema Drive to allow customers to be able to turn left
onto Cinema Drive. A proposed concrete median in Cinema Drive would prevent
customers from turning left onto Cinema Drive from the current driveway.
The addition of a new driveway required some internal parking lot changes to allow for
a drive isle. This required the removal of some existing landscaping and the addition of
two landscape islands. Based on the current site plan, the amount of impervious area
totaled 50,706 sf (88.6% impervious). The maximum allowed based on the original
permit was 90% impervious.
