Based on our review of the revised project plans and specifications, we have determined that the Crosswinds South stormwater control system complies with the Stormwater Regulations set. forth in Title 15A NCAC 2H.1003(i). The runoff will be treated in a detention pond sized to achieve 85% reduction in Total Suspended Solids. The revision consists of addition of 460 feet of 18" RCP to pipe a portion of the existing ditch between Crosswinds Section II and Crosswinds South. Any modification of the plans submitted to this Office or further development of this site will require an additional Stormwater Submittal/Modification and approval prior to initiation of construction. Modifications include but are not limited to; project name changes, transfer of ownership, redesign of built -upon surfaces, addition of built -upon surfaces, redesign or further subdivision of the project area. This Certification shall be effective from the date of issuance until rescinded. The project shall be constructed and maintained in accordance with the plans and specifications approved by the Wilmington Regional Office. This Certification does not supersede any other permit or approval. The developer is responsible for obtaining any and all permits and approvals necessary for the development of this project. Brief Explanation: This detention pond is designed to remove 85 % total suspended solids and will therefore be operated with a vegetative filter. The outlet ditch qualifies as the filter due to the long length of travel by the runoff prior to entering Mott Creek. This covenant is intended to insure continued compliance with stormwater runoff rules adopted by the State of North Carolina and therefore benefits may be enforced by the State of North Carolina. Deed Restriction: These covenants are to run with the land and shall be binding on all parties and all. persons claiming under them.
