It has been determined that the nature of the proposed change meets the definition of a minor modification in that it does not result in an increase in the size of the permitted stormwater control measure (SCM) and does not increase the amount of built -upon area. The following minor modifications are included and covered by this permit We are forwarding you an approved copy of the modified plans for your files. Please replace the old approved plan sheets with the new ones. 1. The NCDOT required additional catch basins to protect vehicle motor safety during large rain events. Those additional catch basins are now shown on the plans. Please be aware that all terms and conditions of the permit issued on February 5, 2015 and modified as attached, remain in full force and effect, including the requirement to revise or amend the recorded deed restrictions with the updated built -upon area allocations. Please also understand that the approval of this minor modification to the subject State Stormwater Permit is done on a case -by -case basis. Any other changes to this project must be approved through this Office prior to construction. The approval of this minor modification does not preclude the permittee from complying with all other applicable statutes, rules, regulations or ordinances which may have jurisdiction over the proposed activity and obtaining a permit or approval prior to construction. This permit shall be effective from the date of issuance until December 31, 2021 and shall be subject to the following specified conditions and limitations: I. DESIGN STANDARDS 1. This permit is effective only with respect to the nature and volume of stormwater described in the application and other supporting data. 2. This stormwater system has been approved for the management of stormwater runoff as described in Sections 1.7 and 1.8 of this permit. The subdivision is permitted for 141 lots, each limited to a maximum amount of built -upon area as indicated in Section 11.20 (f) of this permit. There are 90 lots in Great Neck Section 11; 28 lots in Regal Hill; and 23 lots in Tinley Estates. The stormwater controls designated as Pond 1, Pond 2, and Wetland 3, have been designed to treat the runoff from 310,600, 670,170, and 35,750 square feet of built -upon area, respectively. 3. The tract will be limited to the amount of built -upon area indicated in Sections 1.2 and 1.7 of this permit, and per approved plans. The built -upon area for the future development within the drainage areas of Pond 1 and Pond 2 is limited to 5,488 and 115,931 square feet, respectively. This permit does not provide any allocation of built -upon area for future development within the drainage area of Wetland 3. Page 3 of 11 State Stormwater Management Systems Permit No. SW8 100714 4. The runoff from all built -upon area within the permitted drainage areas of this project must be directed into the permitted stormwater control systems. 5. A 50' wide vegetative buffer must be provided and maintained adjacent surface waters, measured horizontally from and perpendicular to the normal pool of impounded structures, the banks of each side of streams and rivers and the mean high-water line of tidal waters. The wet detention pond(s) may not be located within the buffer and no built -upon area is allowed within the buffer. 6. All runoff being directed into wetlands shall flow into and through those wetlands at a non -erosive velocity. 7. SCHEDULE OF COMPLIANCE No homeowner/lot owner/developer shall alter the approved stormwater management system, or fill in, alter, or pipe any drainage feature (such as swales) shown on the approved plans as part of the stormwater management system without submitting a modification or revision to the permit and receiving approval from the Division. The permittee is responsible for routine monitoring of the project's built -upon area and verifying that the built -upon area for the entire project and for each lot does not exceed the maximum allowed by this permit. Once the lot transfer is complete, the lot owner may not increase the built -upon area above the permitted maximum for that lot without approval from both the permittee and the Division. The permittee shall not approve any requests for additional built -upon area over and above the permitted maximum on any lot without first submitting for and receiving a permit modification from the Division. Page 5 of 11 State Stormwater Management Systems Permit No. SW8 100714 The permittee must maintain compliance with the overall BUA limit for the project established by this permit, the permit documents and the recorded deed restrictions. If any lot is found to have exceeded the permitted BUA limit for that lot without the approval of the Division and the permittee, the permittee shall notify the lot owner in writing and require resolution. The permittee shall review all proposed new and modified lot plans for compliance with the BUA limit. The plans reviewed must include all proposed built -upon area. The permittee shall not approve any plans that exceed the maximum allowed BUA limit. Any approvals given by the Permittee do not relieve the permittee or the lot owner of the responsibility to maintain compliance with the BUA limit established by the permit and in the recorded deed restrictions. The Director may notify the permittee when the permitted site does not meet one or more of the minimum requirements of the permit. Within the time frame specified in the notice, the permittee shall submit a written time schedule to the Director for modifying the site to meet minimum requirements. The permittee shall provide copies of revised plans and certification in writing to the Director that the changes have been made. 6. The stormwater management system shall be constructed in its entirety, vegetated and operational for its intended use prior to the construction of any built -upon surface. 7. The permittee shall submit to the Director and shall have received approval for revised plans, specifications, and calculations prior to construction, for any modification to the approved plans, including, but not limited to, those listed below: a. Any revision to the approved plans, regardless of size. b. Redesign or addition to the approved amount of built -upon area. C. Further development, subdivision, acquisition, or sale of any, all or part of the project area. d. Filling in, altering, or piping of any vegetative conveyance shown on the approved plan. e. The construction of any future BUA allocation listed on the application. 8. The Director may determine that other revisions to the project should require a modification to the permit. 9. Access to the approved stormwater management system for inspection and maintenance must be provided. All stormwater collection and treatment systems must be located in a right-of-way, a dedicated common area or a recorded easement. The final plats for the project will be recorded showing all such required rights -of -way, common areas and easements, in accordance with the approved plans. 10. During construction, erosion shall be kept to a minimum and any eroded areas of the system will be repaired immediately. 11. If the stormwater system was used as an Erosion Control device, it must be restored to design condition prior to operation as a stormwater treatment device, and prior to occupancy of the facility. Page 6 of 11 State Stormwater Management Systems Permit No. SW8 100714 12. Upon completion of construction, prior to issuance of a Certificate of Occupancy, and prior to operation of this permitted facility, a certification must be received from an appropriate designer for the system installed certifying that the permitted facility has been installed in accordance with this permit, the approved plans and specifications, and other supporting documentation. Any deviations from the approved plans and specifications must be noted on the Certification. 13. The permittee shall at all times provide and perform the operation and maintenance items as specified in the signed Operation and Maintenance agreements, to assure that all components of the permitted stormwater system function at design condition. The approved Operation and Maintenance Agreement must be followed in its entirety and maintenance must occur at the scheduled intervals. 14. Records of maintenance activities must be kept by the permittee. The records will indicate the date, activity, name of person performing the work and what actions were taken. 15. The facilities shall be constructed in accordance with the conditions of this permit, the approved plans and specifications, and other supporting data. 16. Prior to transfer of the permit, the stormwater facilities must be inspected by DEMLR personnel. The project and the stormwater facility must be in compliance with all permit conditions. Any items not in compliance must be repaired, replaced or restored to design condition prior to the transfer. Records of maintenance activities performed to date will be required. 17, Decorative spray fountains will be allowed in the stormwater treatment system, subject to the following criteria: a. The fountain must draw its water from less than 2' below the permanent pool surface. b. Separated units, where the nozzle, pump and intake are connected by tubing, may be used only if they draw water from the surface in the deepest part of the pond. C. The falling water from the fountain must be centered in the pond, away from the shoreline. d. The maximum horsepower for the fountain's pump is based on the permanent pool volume. The maximum pump power for a fountain in Pond 1 and 2 is 1/3 and 3/4 HP, respectively. 18. If permeable pavement credit is desired, the permittee must submit a request to modify the permit to incorporate such language as required by the DEMLR. The request to modify must include a soils report identifying the type of soil, the Seasonal High Water Table elevation and the infiltration rate. Upon the successful completion of a permit modification, the individual lot owners that request to utilize permeable pavements shall submit the necessary forms and documentation to the permittee, or a designated agent, and receive approval prior to construction of the permeable pavement. Page 7 of 11 State Stormwater Management Systems Permit No. SW8 100714 19. Prior to the sale of any lot, the following deed restrictions must be recorded: a. The following covenants are intended to ensure ongoing compliance with State Stormwater Management Permit Number SW8 100714, as modified and reissued by the Division of Energy, Mineral and Land Resources under NCAC 02H.1000. b. The State of North Carolina is made a beneficiary of these covenants to the extent necessary to maintain compliance with the Stormwater Management Permit. C. These covenants are to run with the land and be binding on all persons and parties claiming under them. d. The covenants pertaining to stormwater may not be altered or rescinded without the express written consent of the State of North Carolina. e. Alteration of the drainage as shown on the approved plans may not take place without the concurrence of the Division. f. The maximum built upon area per lot is as follows: 90 lots - Lots 142-231 Great Neck Section II @4,500 sf; 28 lots - Lots 247-274 Regal Hill @3,500 sf; 23 lots - Lots 1-23 Tinley Estates @4,500 sf This allotted amount includes any built -upon area constructed within the lot property boundaries, and that portion of the right-of-way between the front lot line and the edge of the pavement. Built upon area includes, but is not limited to, structures, asphalt, concrete, gravel, brick, stone, slate, coquina and parking areas, but does not include raised, open wood decking, or the water surface of swimming pools. g. All runoff on the lot must drain into the permitted system. This may be accomplished through providing roof drain gutters, which drain to the street, grading the lot to drain toward the street, or grading perimeter swales and directing them into the pond or street. Lots that will naturally drain into the system are not required to provide these measures. h. Built -upon area in excess of the permitted amount will require a permit modification. 20. A copy of the recorded deed restrictions must be submitted to the Division within 30 days of the date of recording the plat, and prior to selling lots. The recorded copy must contain all of the statements above, the signature of the Permittee, the deed book number and page, and the stamp/signature of the Register of Deeds. III. GENERAL CONDITIONS This permit is not transferable to any person or entity except after notice to and approval by the Director. The permittee shall submit a completed and signed Name/Ownership Change Form, accompanied by the supporting documentation as listed on the form, to the Division of Energy, Mineral and Land Resources at least 60 days prior to any one or more of the following events: a. An ownership change including the sale or conveyance of the project area in whole or in part, except in the case of an individual lot sale that is made subject to the recorded deed restrictions; b. The sale or conveyance of the common areas to a Homeowner's or Property Owner's Association, subject to the requirements of Session Law 2011-256; c. Bankruptcy, d. Foreclosure; e. Dissolution of the partnership or corporate entity; f. A name change of the current permittee; g. A name change of the project; h. A mailing address change of the permittee; 2. The permittee is responsible for compliance with all permit conditions until such time as the Division approves a request to transfer the permit. Any individual or entity found to be in noncompliance with the provisions of a stormwater management permit or the stormwater rules is subject to enforcement procedures as set forth in North Carolina General Statute 143, Article 21. 4. The issuance of this permit does not preclude the Permittee from complying with any and all statutes, rules, regulations, or ordinances, which may be imposed by other government agencies (local, state, and federal) having jurisdiction. 5. In the event that the facilities fail to perform satisfactorily, including the creation of nuisance conditions, the Permittee shall take immediate corrective action, including those as may be required by this Division, such as the construction of additional or replacement stormwater management systems. 6. The permittee grants DENR Staff permission to enter the property during normal business hours for the purpose of inspecting all components of the permitted stormwater management facility. 7. The permit issued shall continue in force and effect until the permittee files a request with the Division for a permit modification, transfer, renewal, or rescission; however, these actions do not stay any permit conditions. 8. Unless specified elsewhere, permanent seeding requirements for the stormwater control must follow the guidelines established in the North Carolina Erosion and Sediment Control Planning and Design Manual. 9. The application form, supplement forms, and approved plans and specifications for this project are incorporated by reference and are enforceable parts of the permit. 10. The permittee shall maintain a copy of the approved plans and specifications on file at all times. 11. The issuance of this permit does not prohibit the Director from reopening and modifying the permit, revoking and reissuing the permit, or terminating the permit as allowed by the laws, rules and regulations contained in Session Law 2006- 246, Title 15A NCAC 2H.1000, and NCGS 143-215.1 et.al. 12. The permittee is responsible for compliance with all permit conditions until such time as the Division approves the transfer request. Neither the sale of the project, in whole or in part, nor the conveyance of common area to a third party constitutes an approved transfer of the stormwater permit. 13. The permittee shall submit a permit renewal application at least 180 days prior to the expiration date of this permit. The renewal request must include the appropriate documentation and the processing fee. Often, the transfer application has to be returned so that it can be modified before it is transferred. And, if it is contentious the HOA generally wants to be kept informed and educated about the whole process which can be time consuming. The volume of this workload has become a huge problem. Transfers are only 30% of my workload, but they are at least 60% of my time. We are trying to find ways to streamline the transfer process. What date do you want to extend to? Also, as for the NCOOT catch basins, I just need to rectify the fact that there are more catch basins on the ground than there are on the plans. I recommend that you all apply for a minor modification to update the plans for the appropriate permit(s). Since the permits are already in-house for the transfer, and this is a fairly minor change (in that it doesn't impact the function of the system), there is an administrative piece that I want to make you aware of (which won't negatively impact your schedule). For any permit needing the minor modification, the package has to be formally returned in our database, then modified, and then accepted for transfer again. The transfer fee you already paid will be applied to the transfer when it is re -accepted, and there is no fee for a minor modification. I will set these dates one day apart, and as I said, it won't impact your timeline. But, it will seem like a strange procedural thing and so I wanted to give you a head's up. There isn't any other way to accomplish this in our database. I also don't see lists of constructed impervious area per lot? I just wanted to give you a heads up that I will be asking for a list of lot numbers, owners, impervious area constructed, maximum BUA per lot, and the exact Book/Page where the deed restrictions are recorded for each of the six permits. For instance, since SW8 110615 has 207 lots, I need to have just those 207 lots on the list for that permit transfer so that I can verify that that permit has sold at least 50% of the lots per the regulations for transferring to HOAs. This is a suggested format. (If there are lot numbers that repeat in different sections of the same permit you may also want to add the phase or other identifying name.) It will probably be 60 days or so until I go through this again, and so if you want to email these six lists over in the meantime that could speed up your review process.
