For the comments:
1. The two (2) ponds certification was a partial just because the wetland was included in the permit...
the wetland certification from 11/14/14 should say "final". The pond was constructed for the total
BUA as permitted. If the multifamily was allocatad xx Sq.ft of BUA, the reduction in BUA to single
family would still be covered.

turned around and issued. Our review timeframes are longer than they have ever been. We are supposed to allow a

In response to your request for additional information on the above referenced permit transfers, we submit the
following.
As requested, we are working on Stormwater B.U.A. Exhibit Maps for each project similar to what was
previously submitted for Ryker Trace I (SW8-111212), Ryker Trace II (SW8-120710), Monarch Meadow (SW8-101110)
and Tinley Estates (SW8-100714). We are also working on requested Minor Modification Submittals and Recordation of
Deed Restrictions for Non -Conforming B.U.A. Lots, plus various other items outlined in your submitted requests.

However, fulfilling these requests require Engineer and Attorney involvement which may take more time than was
anticipated. We are requesting, rather than submitting these various items as they are received, it may be more efficient
to assemble a complete package. Based on our current workload and the ability to coordinate with the Attorney and
Engineer we are respectfully requesting an extension of time to submit all requests. We are anticipating a Revised.
response Date of April 12, 2022.
Please let us know if this is accepted and how you wish to proceed.

The field inspection for this project is compliant. But there are administrative items that still need to be
addressed. Please note that the following items were requested in the 5/6/2019 letter and again in the 10/14/2021
letter.
vY Certifications: Jonathan McDaniel certified the wetland on 11/14/14. He certified the two ponds on
9/17/14. No significant changes have been made to Pond 1's drainage area since the certification. But, Tinley
Estates (which drains to Pond 2) converted from multifamily to single family on 2/5/15. It appears that an
updated certification would be warranted, but an updated certification for Pond 2 was not received with the
previous response. Please advise. If the 9/17/14 certification is the final, I will attach your response to this
email to the certification so that it clear in the future.
Impervious Area per Lot: Each permit contains the following language, "The permittee is responsible for the
routine monitoring of the project for compliance with the built -upon area limits, grading, and the storm drainage
system established by this permit the permit documents, the approved plans, and the recorded deed
restrictions." I understand that there was some confusion about the necessity of monitoring/tracking the
impervious area that has been constructed on each lot. Since there is not a spreadsheet tracking impervious
area that has been constructed, we will have to identify an alternate path forward. Please determine the
impervious area constructed on 10% of the homes (the larger homes) in each permit per county records or other
means in order to demonstrate that the homes have been constructed within the appropriate

allocations. Please submit a summary with your resubmittal. Please address this issue. I have attached an
example spreadsheet.

modification has already been done. Was that submitted in error, or is there another modification needed? A
plan for Tinley Estates was also submitted which does not appear to be needed?

Good news. The owner of Lot 142 (401 Oldtowne St.) has accomplished the task of removing all fencing, trees, shrubs,
etc. from the 20' drainage access and maintenance easement as required by NCDEMLR to transfer the subject
stormwater permit to the HOA. We are still actively working with Lot 146 (409 Oldtowne St.) to remove the pipes
draining from their Lot and repair the ground. Please see pictures attached showing Lot 142 before/after fencing, tree,
shrubs, etc. removal. If you could confirm receipt that would be great.

The trees have been removed. I'd like to request a meeting on my property with you and a rep from the stormwater
folks to look at whether or not the fence needs to be moved. Based on the way the ditch runs along the back of the
property it looks like there is well over 20 feet if some of the brush is cleared out instead of moving the fence. Please

Thank you for the email. We have approached the board with a violation notice to inform the owner of Lot 142 they
have 15 days to remove the structures or items (fencing and associated landscaping — i.e shrubs, trees, landscape
boarder, etc.). If they do not remove everything in violation of the associated stormwater permit, we will have the
board hire a contractor to remove the items to ensure compliance is met.
Question — Nick Garner mentioned concerns with a perforated type of pipe terminating from a private Lot (possible
gutter or a drain in the yard) directly into the same stormwater wetland. Is this true? Can you please provide
information including the Lot # with pictures/maps/quote from the permit like the fence concern email? The
explanation and attached diagrams helped tremendously. We want to ensure we are providing the correct
documentation to the Board and homeowner for proper enforcement from the HOA if needed. Nick would be the
contractor to repair the wetland back to within the permit specifications.
Finally, please provide any other concerns with the other stormwater permits so we can address with Sydes and/or the
HOA. If I recall correctly, Nick mentioned these two items and an area the landscape contractor needs to mow near a
drain grate. We will address this with the HOA landscaper as well to ensure it is remedied as soon as possible.

Thanks for talking today about the fence in the easement on Lot 142. 1 talked to my supervisor, Christine Hall, about it
and I have attached some diagrams.
There is a 20ft drainage access and maintenance easement along the back property line of that lot. The other homes
have fences that appear to end at the easement, but this home does not. As we discussed, the other way to access that
property is to go through the wastewater treatment land on the back side of the wetland (as shown in the attached
pictures). However, the proposed permittee, Carolina Plantations Owners Association, does not own the land currently
used to access the wetland. It is owned by Old North State Water Company, LLC. (There is also a berm on that tract
which makes it difficult to access the stormwater wetland.) Section II (7) of the permit says, "Access to the approved
stormwater management system for inspection and maintenance must be provided. All stormwater collection and
treatment systems must be located in a right-of-way, a dedicated common area or a recorded easement. The final plats
for the project will be recorded showing all such required rights -of -way, common areas and easements, in accordance
with the approved plans."
Unfortunately, the fence is blocking access to the stormwater wetland and there is no other way to access the wetland
that the proposed permittee owns, and would have access to in perpetuity. Access must be provided.

I spoke to Premier about the Swale you listed the other day. We had a sinkhole repair over in that area over a year ago.
The landscapers were taking care of this area earlier but I think they took it off the schedule because of danger of the
sinkhole. That leaking pipe joint is repaired now and the landscapers will have that area cut shortly.
As for the wetland SCM, I repaired the outlet structure which I sent pictures of last week. As for the downspout pipe, we
removed this a few months ago and repaired the bank. The resident just recently cut through our repair and reinstalled
the pipe as well as additional garbage in the common area. We have documented this on our last inspection report and
told Premier Management to contact the resident to remove this debris and repair the trench. I will let you know next
week how this plays out. Premier is also contacting the resident with the fenceline in the easement for removal. This has
been something I have been discussing for a while due to limited access.

Excerpts from the May 6, 2019, Letter (SW8 100714) — Updates in Red
2. Impervious Area per Lot: Each permit contains the following language, "The permitlee is
responsible for the routine monitoring of the project for compliance wilh the built -upon area
limits, grading, and the storm drainage system established by this permit, the permit documents,
the approved plans, and the recorded deed restrictions. " 1 understand that there was some
confusion about the necessity of monitoring/tracking the impervious area that has been
constructed on each lot. Since there is not a spreadsheet tracking impervious area that has been
constructed, we will have to identify an alternate path forward. Please determine the impervious
area constructed on 10% of the homes (the larger homes) in each permit per county records or
