Hey Zach!
The bank we originally requested mitigation from could no longer support our request. There were no other banks in the
HUC that had enough to cover our request either, so we had to request mitigation from DMS. The acceptance letter is
attached!
Thanks,
Kim

Hey Zach,
No verification received yet from April, but we passed 45 days just this week, so I suspect we'll hear something soon. She
has not asked for additional information, and no revisions were submitted. I'll see if I can drop her a line.
Thanks,
Kim

Hi Sean and Kim,
Has the Corps verified the use of NWP29 for this project? I am finishing up my review and I wanted to reach out for
confirmation from them as well as any information you had regarding the historical concerns. Have any changes been
made since submittal of the application?
Thank you,
Zach Thomas

Hi April,
Apologies, this one does show up in my queue but under Chatham County rather than Caswell. I just spoke with Sean
and he confirmed that it is in Chatham.
DWR received this application on 11/4/22 with payment received 11/9/22.
Sean and Kim: if you have any information/emails on this that may have gone to Colleen, please forward them to me
and I will add them to my review file.
Thank you!

Hi April,
This project appears to be in Caswell County and would fall under the Winston Salem RO. I have copied Sue Homewood
to see if she has this one in her queue since it is not showing up in mine.

Dear Zachary Thomas,
This email is concerning the attached Preconstruction Notification (PCN) received by the U.S. Army Corps of Engineers
(USACE) on November 4, 2022. The Corps Action ID Number associated with this project is: SAW-2021-00165.
Please provide a written response within 14 days from the date of this email, regarding the North Carolina Division of
Water Resources (DWR) receipt date for this project, otherwise, we will consider our receipt date as accurate. Also,
within 14 days, please notify me if the certification request does not contain the nine (9) components listed in Section
121.5(b) of the 2020 Clean Water Act Section 401 Certification Rule.
As specified in the September 16, 2022, Programmatic Agreement (PA) between the USACE, Wilmington District, and the
North Carolina Department of Environmental Quality, Division of Water Resources, the reasonable period of time (RPOT)
for DWR to act on a Section 401 certification request is 120 days unless the RPOT is extended per the terms of this PA.
As such, unless we receive an email request for an extension of the RPOT, the USACE will consider the Section 401
certification for this project to be waived on March 4, 2023.
Please contact me if you have any questions regarding this request.
