HomeMy WebLinkAboutNC 24 Living Shoreline LOA March 17 2023 March 17, 2023 Ms. Anneliese Westphal Environmental Senior Specialist NC Department of Transportation - Division 3 5501 Barbados Blvd. Castle Hayne, NC 28429-5647 RE: Letter of Authorization, CAMA Major Development Permit Number 78-22, (TIP No. M-0540A) NC 24 Resiliency and Living Shoreline Project, adjacent to the White Oak River, Onslow County. Dear Ms. Westphal: This letter is in response to the N.C. Department of Transportation (NCDOT) request dated March 16, 2023, including a cover letter and one attached drawing dated as received on March 16, 2023. NCDOT proposes the following: (1) update the plans for the embankment and low marsh habitat creation areas within an area of approximately 2,414 square feet (0.05 acres) due to the discovery of previously unknown and unsuitable fill material; (2) reduce fill within existing Coastal Wetlands; and (3) allow the use of a truck mounted “Telebelt” (Telescopic Belt Conveyor) as the method of installing marine sand fill on the project. The authorized changes will not result in any additional permanent impacts to wetlands or waters of the State, and will potentially reduce impacts to Coastal Wetlands. NCDOT states that fill will be limited between STA. 20+25 and 22+75 with the goal of maintaining the existing coastal wetland vegetation to the extent practicable, and recently discovered unsuitable fill will be removed between STA. 23+00 and 24+50. Additionally, NCDOT states that unsuitable debris will be removed from the embankment and slope area between STA. 23+75 and 24+75. Approximately 1,559 square feet of Class II riprap will be placed at a 3:1 slope in the area where unsuitable materials are removed from the existing embankment. Approximately 855 square feet of marine sand fill will be placed at a 10:1 slope with Coastal Wetland plantings in the area where unsuitable materials are removed from the slope area as authorized in the current landscape plan for the adjacent areas. The request also indicates that NCDOT is planning to implement the use of a truck mounted “Telebelt” (Telescopic Belt Conveyor) as the method of adding the authorized sand fill landward of the inner and outer sills. The Telebelt methodology change would eliminate the need to construct Phase 1 and Phase 2 of the “alternate trestle” design during the sand fill operation. Please be advised that through this Letter of Authorization, the Division of Coastal Management conveys its determination that the revision as described in the NCDOT request dated March 16, 2023 is consistent with existing State rules and regulations and is in keeping with the original purpose and intent of CAMA Major Development Permit Number 78-22. This letter shall be attached to the original of CAMA Major Development Permit Number 78-22, which was issued on July 22, 2022, as well as the minor modification issued on November 7, 2022, and copies of all documents shall be readily available on-site when a Division of Coastal Management representative inspects the project for compliance. All conditions and stipulations of the active permit shall remain in force unless altered herein. This approval does not eliminate the need to obtain any additional permits, approvals or authorizations that may be required.
