Director Certified Mail # 7019 1120 0001 5505 0865 Return Receipt Requested Archie B Hicks, Jr, Mayor Town of East Bend 108 W Main St East Bend, NC 27018 NORTH CAROLINA Environmental Quality March 20, 2023 SUBJECT: NOTICE OF VIOLATION & INTENT TO ISSUE CIVIL PENALTY Tracking Number: NOV-2023-LR-0009 Late/Missing Discharge Monitoring Reports (DMRs) East Bend Industrial Park WWTP Permit No. NCO064726 Yadkin County Dear Mr. Hicks: A review of the Division of Water Resources (DWR) database which tracks the monthly submittal of Discharge Monitoring Reports (DMRs) revealed that the October 2022 Discharge Monitoring Report (DMR) was not filed with the Division within the thirty (30) calendar days after the end of the reporting period for which the report is made [per 15A NCAC 02B .0506]. Report Period Due Date Received Date Days Late October 2022 11/30/2022 12/21/2022 21 Based upon the above facts, I conclude that Town of East Bend violated or failed to act in accordance with the requirements of NPDES Permit NCO064726 and G.S. 143-215.65. A civil penalty of not more than $25,000.00 per violation may be assessed against a person who fails to file, submit, or make available any documents, data, or reports required by G.S. 143-215.65. The State's enforcement costs in this matter may be assessed pursuant to G.S. 143-215.3(a) (9) and G.S. 143-282.1(b) (8).
