Accordingly. we are forwarding the attached NPDES discharge permit. This permit is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the U.S. Environmental Protection Agency dated May 9, 1994 (or as subsequently amended). If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this letter. This request must be in the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of Administrative Hearings (6714 Mail Service Center, Raleigh, North Carolina 27699-6714). Unless such demand is made, this decision shall be final and binding. Please note that this permit is not transferable except after notice to the Division. The Division may require modification or revocation and reissuance of the permit. This permit does not affect the legal requirements to obtain other permits which may be required by the Division of Water Quality or permits required by the Division of Land Resources, the Coastal Area Management Act or any other Federal or Local governmental permit that may be required. EFFLUENT LIMITATIONS AND MONITORING REQUIREMENTS — FINAL During the period beginning on the effective date of the permit and lasting until expiration, the Permittee is authorized to discharge from outfalls 001 and 002. Total Nitrogen Monitoring The Permittee shall calculate annual total nitrogen mass loading as the sum of monthly loadings, according to the following equations: Monthly Loading (pounds) = Days x TN x Qw x 8.34 where: Days =The number of discharge days in that month TN = The average total nitroger.concentration (mg/L) of the composite samples collected during the month Qw = The average daily waste flow (MGD) on days when discharge occurs for the month 8.34 = Conversion factor, from (mg/L x MGD) to pounds The annual mass loading is the sum of the monthly loadings for a calendar year: Annual Mass Loading (pounds per year)= E (Monthly Loadings) for the calendar year. We take this action, specific only to the permits listed, based on the understanding that the Division is requiring nutrient monitoring and the processes and agents used by these dischargers for filter backwash are managed strictly to minimize, to the greatest extent possible, additional nutrient loading in the Neuse Estuary. The combined flow of 16,000 gpd was a burden to the Town's WWTP,due to population growth in the area. Both WTPs discharge to Plantation Canal and the two facilities have identical treatment components. It is most expedient to permit the two WTPs under one permit,given their close physical proximity and common receiving stream. A staff report from the Washington Regional Office agreed to issuance of the permit,provided limits for phosphorus and pH were included. Phosphorus monitoring has been included in the draft but pH monitoring has not,as DWQ policy for WTPs does not require pH monitoring. The draft permit has the expanded nutrient monitoring present in all Neuse River basin permits,pursuant to the Division's informal agreement with the Neuse River Foundation (NRF). The NRF has agreed to waive objections to issuance of non-nutrient loaded discharge permits,provided that nutrient monitoring is conducted by those facilities. The nutrient monitoring requirements in the draft permit are consistent with nutrient monitoring regimen in other Neuse River WTP permits. The receiving stream is not impaired or threatened. Plantation Canal does not appear on the latest 303(d) list. Downstream impairment to the Trent River is not attributed to point sources. HOWEVER, I AM CONCERNED ABOUT ANOTHER NEUSE BASIN PERMIT THAT I JUST DISCOVERED A NOTICE ON -THAT PERMIT IS NPDES PERMIT #NC0060321, FIRST CRAVEN SANITARY DISTRICT - SOMEHOW THAT NOTICE WAS DELAYED IN GE I rTNG HERE (PROBABLY BY CHRISTMAS MAIL). There are two justifications for this discharge: • The discharge would be into a canal that has little or no flow except during heavy rains. It is hoped that the flow provided by the discharge would help to eliminate stagnation in the canal and aid in the prevention of algae growth on the canal surface. • We are exploring the possibility of extending sewer service to areas of the town that currently are served by septic tanks. There is also proposed development in areas of the town that would require sewer service. These additional sewer connections would bring the waste water treatment plant near its permitted capacity. Removing the 16,000 gallons per day backwash water from the plant flow would lessen the chance of hydraulic over load and therefore provide a more efficient treatment operation.
