Dear Mr. Hayes:
My company Glover Rental Holdings LLC is the owner of the
above -referenced property, which is leased to a company that
operates a restaurant there. I am writing as requested in response to
the Notice of Violation and Intent to Issue Civil Penalty dated
February 10, 2023, which I received on February 23, 2023.
The overflow was caused by a partially broken sewer cap that
had fallen into the sewer line and obstructed it. The broken cap was
removed on February 15, 2023. The line has been inspected several
times since then, and the plumber who fixed it is confident there
should be no recurrence. There has been no other problem since.

The tenant had contacted a plumber to inspect the line within
an hour of being told about the problem on February 11, 2023. The
duration of the overflow is believed to have been approximately 2
hours. When the plumber initially snaked the line, the problem was
not detected because the cap was acting like a butterfly valve, and
opened when the line was snaked. The problem was detected upon
further inspection. Needless to say, the discharge was accidental.
Our best information is no overflow reached any surface
waters. The estimate of 200 gallons discharged from the line in the
parking lot, which I put in the overflow report, is the best one I could
get from the plumber who was the first on the scene and did the
initial inspection. It flowed across the parking lot and into a catch
basin, which drains by pipe into a ditch behind the parking lot. On
the overflow report, I put 200 gallons (estimate) reaching surface
waters, but qualified that as "maybe." Since then, we have looked at
the relevant maps and it appears that ditch is not an identified surface
water. We have no information to indicate any of the overflow went
further than that ditch. As you know, no remediation was necessary.
