Per 15A NCAC 02H .0502 (b)(1) DWR is required to evaluate if the proposed activity has avoided and minimized impacts to surface waters and wetlands to ensure any remaining surface waters or wetlands, and any surface waters or wetlands downstream, continue to support existing uses during and after project completion; DWR echoes the concerns raised by the USACE regarding the ability to further avoid and minimize impacts to wetlands onsite. DWR is placing the project on -hold until additional information is proved that addressees avoidance and minimization of impacts to wetlands. Doesn't seem like there will much traffic using the project site/facility? Is the road width a county or safety requirement? The road is 18' wide with 2' shoulders. There is an additional 3:1 slope beyond that, so the total width of impact is 27'. There is a cross section on the site plan drawing that helps to depict this. The applicant evaluated the option you mentioned and I tried to explain this in the PCN. He considered starting the road along the eastern boundary, following west along the bay rim, and then tying into the western boundary to try to reduce wetland impacts. However, this would have required that the office trailer be placed in the northern part of the tract. For safety reasons, the applicant prefers to have the office placed closer to Hwy 211 where it would be more easily accessed by Fire/EMS. Additionally, it would be more expensive to construct a longer road. Let me know if this adequately addresses your concerns. And enjoy your vacation! I think the PCN said the road was going to be 18' wide?, the plans show a road disturbance of 27' wide (limits of disturbance) and a graveled road of 22' wide. Seems like a lot of the wetland impacts could be avoided if they built the road off 211 on the eastern edge of the lot. They could then follow the upland bay ridge around and construct the 18' wide road up into the high ground for the conex containers. The proposed culverts (as mentioned in the PCN) will also need to be shown on the plans (dimensions, installation, etc..) This project as a purpose and need, but there doesn't seem to be a avoidance or minimization taking place. Please contact me if you have any questions about these comments or about the USACE Regulatory Comments.
