Robeson County FOR THE continued operation of a 0.57 MGD spray irrigation type non -discharge wastewater treatment system consisting of rotary screens, air floatation unit and grease trap, --it removal, a 10,000 GPD extended aeration domestic wastewater treatment plant with infection, impervious lining for lagoon No. 2 of the 1.6 MG two -stage lagoon ,.item, a 4.0 MG emergency storage basin with impervious lining, instrumented flow measurement, dual irrigation pumps, 120 acres of irrigation fields and for the operation of a 16,000 gallon/year sludge disposal system to approximately 50 acres of land owned by Lumbee Farms all to serve Lumbee Farms facility at Lumber Bridge, North Carolina with no discharge to the surface waters of the State, pursuant to the application received September 23, 1988, and in conformity with the project plan, specifications, and other supporting data subsequently filed and approved by the Department of Natural Resources and Community Development and considered a part of this permit. This permit shall be effective from the date of issuance until December 31, 1989, and shall be subject to the following specified conditions and limitations: 1. This permit is effective only with respect to the nature and volume of wastes described in the application and other supporting data. 2. The facilities shall be properly maintained and operated at all times. 3. This permit is riot transferable. The facilities shall be effectively maintained and operated at all times so that there is no discharge to the surface waters, nor any contamination of ground waters which will tender them unsatisfactory for normal use. In the event that the facilities fail to perform satisfactorily, including the creation of nuisance conditions or failure of the irrigation area to adequately absorb the wastewater, the Permittee shall take such immediate corrective action as may be required by the Division of Environmental Management. 5. Irrigation shall not be performed during.inclement weather or when the ground is in a condition that will cause runoff. 6. Adequate measures shall be taken to prevent wastewater runoff from the spray field. 7. Sludge shall not be applied in inclement weather or until 24 hours following a rainfall event of 1/2-inch or greater in 24 hours. Emergency sludge disposal measures shall be approved by the Division of Environmental Management. B. Freeboard in the lagoons and storage basin shall not be less than one (1) foot at any time. 9. A suitable year round vegetative cover shall be maintained. 10. The application rates shall not exceed (a) 1.1 in/ac/wk to the spray irrigation. site (b) approximately 16,000 gallons/year of sludge (c) 4,000 gallons of sludge per application. 11. Adequate facilities shall be provided to prevent surface runoff from carrying any disposed or stored material into any surface waters. 12. Diversion or bypassing of the untreated wastewater from the treatment facilities is prohibited. 13. The Permittee shall employ a certified wastewater treatment plant operator to be in responsible charge of the wastewater treatment facilities. Such operator must hold a certificate of the grade at least equivalent to the classification assigned to the wastewater treatment facilities by the Certification Commission. 14. The issuance of this permit shall not relieve the Permittee of the responsibility for damages to surface or groundwaters resulting from the operation of this facility. 15. The facilities shall be effectively maintained and operated as a non -discharge system to prevent the discharge of any wastewater resulting from the operation of this facility. - 16. No type of sludge other than that from Lumbee Farms Cooperative, Inc. shall be placed on the land application disposal site. �. No type of wastewater other than that from Lumbee Farms Cooperative, Inc. shall be sprayed onto the irrigation area. Wastewater and sludge shall be uniformly applied to the land areas in such a manner so as to prevent toxic conditions from a single application or by the accumulation of more than one application of wastewater or sludge. 19. Lagoon No. 2 and the emergency storage basin shall have impervious lining. 20. A 50-foot buffer shall be maintained between drainageways, a 100-foot buffer shall be maintained between each landowner's property lines, and a 400-foot buffer shall be maintained between any residence and any applied sludge. 21. The Permittee, at least six (6) months prior to the expiration of this permit, shall request its extension. Upon receipt of the request, the Commission will review the adequacy of the facilities described therein, and if warranted, will extend the Permit for such period of time and under such conditions and limitations as it may deem appropriate. 22. This facility must provide the Fayetteville Regional Office with an annual summary of the management procedures for the spray irrigation site(s). This annual report must be submitted by December 31st of the particular year. This information must include current wastewater analysis, soils analysis (a report from a certified soil scientist describing the land application systems effect on the soil must accompany the technical soils sample), total volume of wastewater spray irrigated on the permitted acreage, and the approximate yield of the cover crop. The two (2) ton per acre application of Dolomitic lime as recommended by Dr. Rubin's soils report must be applied by March 31, 1989. Any supplemental nutrient additions to the soils will be determined by future annual evaluations. 24. The permittee shall submit to the Division on or before January 1, 1989 to following information: A. A complete topographic map which also includes the following: (i) location of all property boundaries; (ii) delineation of each of the spray fields; (iii) the boundaries of the two (2) bays (shown on Figure I of the EHC Report dated September 15, 1988); (iv) all facility -related structures (including lagoon); (v) all spray irrigation lines; (vi) north arrow. B. The four_ (4)_groundwater monitoring wells recently installed in the vicinity of the lagoons shall be sampled and analyzed for the following parameters: Nitrate pH Total Dissolved Solids Chlorides Total Coliform Water -Level TOC e measurement of water level should be taken prior to sampling for other .rameters. Lithologic logs, well construction details and the analytical results of the sampling should be submitted to the Groundwater Section, Division of Environmental Management. 25. Any monitoring deemed necessary by the Division of Environmental Management to insure surface and ground water protection will be established and an acceptable sampling reporting schedule shall be followed. 26. Within 90 days of permit issuance, seven (7) monitor wells, three (3) upgradient and four (4) downgradient, shall be installed at the spray irrigation fields to monitor groundwater quality. The location and construction details for these wells must be by approval of the Fayetteville Regional Office, from which a well construction permit must be obtained. 27. The seven (7) spray field monitoring wells shall be sampled initially after construction and thereafter every March, July, and November. The four (4) monitoring wells around the lagoon sites shall also be sampled every March, July and November, following the initial sampling as describer) in Condition No. 24B. Samples from all eleven (11) monitoring wells shall be analyzed for those parameters outlined in Condition 24B. The results of the sampling and analysis shall be sent to the N. C. Division of .nvironmental Management on Form GW-59 (Compliance Monitoring Report Form) every )ril, August, and December. 28. The three (3) supply wells as shown on Figure 1 of the submitted plans shall be abandoned as per 15 NCAC 2C .0100.
