Dear Mr. Georgius:
The application dated 25 June 2608 concerning the pumping and hauling of wastewater
generated from Little River Vineyards was received on 26 June 2008 and reviewed by
staff in the Division of Water Quality — Aquifer Protection Section' of Fayetteville
Regional Office.
As explained in the pump and haul application, Little River Vineyards plans to pump and
haul approximately 2000 gallons per event (based upon the contract haulers truck
capacity of 2300 gallons) of wastewater generated by the facility to the Town of Troy
wastewater treatment. plant located in Troy, North Carolina. The Town of Troy has
indicated its willingness to accept and treat the wastewater in accordance with their letter
of intent signed by Mr. Grey Walls as part of the permit application package received on
26 June 2008 (copy included with this letter).
Based upon the information provided, the requested Pump and Haul' activity at. Little
River Vineyards is hereby approved.
Once the infrastructure and equipment associated with this pump and haul activity is
constructed and before it is put into operation, the following information shall be
presented to the Division:
1. Notification to the Fayetteville Regional Office that the infrastructure and
equipment has been installed in accordance with the application submitted;
2. Provide the anticipated start date for the pump and haul activities;
3. If not provided in the initial application; a contact name or names of individuals
that will be on -site during the operation of the winery that will oversee the
operations of the facility, especially the transfer of wastewater from the on -site
holding tank to pump truck, with a telephone number;

4. A spill prevention plan and clean up plan shall be on -site and made available upon
request, if and when inspection of Little River Vineyards is made by the Division
of Water Quality.
Please be aware that wastewater generated by Little River Vineyards is ultimately Little
River Vineyards responsibility for the proper management of the e wastewater to the
designated receiving sites. Upon completion of these pump and haul activities, Little
River Vineyards shall provide notification to this office that these activities have ceased.
Any environmental impact that can be attributed to this activity may be used as
justification for the Division to request termination of the subject pump and haul
activities.

The Division of Water Quality will not accept this"application unless all tructions are followed:
Plans and specifications must be prepared -in accordance with 15A NCA .0200, all applicable
general statutes, and good engineering practices. Failure to submit all of the required items will lead to
additional processing time for the permit application or in the application being returned as incomplete.
A. Application Form:
✓Submit one original and one copy ofthe completed and appropriately executed application form. The Division of
Water Quality (Division) will only accept complete application packages.
✓The project name should be consistent with the project name on any plans, letter of flow acceptance, operational
agreements, etc.

SUBJECT: Advance Notice of Renewal Application Requirements

Dear Permittee:
Your NPDES permit for a municipally owned/operated WWTP expires on June 30, 2009. This notice is
being sent to explain the requirements for your permit renewal application.
You are receiving this advance notice because your facility has a permitted flow at or above 1
MGD, or the facility receives industrial [pretreatment] wastewater. If either of these criteria no
longer applies, contact the NPDES Unit before submitting a renewal application.
Federal (40 CFR 122) and state (15A NCAC 2H.0105(e)) regulations require that permit renewal
applications be filed at least 180 days prior to expiration of the current permit. Your renewal application is
due to the Division postmarked no later than January 1, 2009..Failure to apply for renewal by the
appropriate deadline may result in a civil.penalty assessment or other enforcement activity at the discretion
of the Director.
The U.S. EPA- revised and expanded the application requirements for municipal permits, effective August 1,
2001. EPA form 2A is attached to this Notice, and must be used for your permit renewal application. The
new application requirements mandate additional effluent testing:
1. Conduct three Priority Pollutant Analyses (PPAs) and submit results with your renewal
application. Collect samples for the PPAs in conjunction with sampling for your current
quarterly toxicity test. The new PPA requirements differ from previous versions. Each PPA
must include:
➢ Analyses for all total recoverable metals listed in Part D of form 2A. This includes metals
that are not normally monitored through your NPDES permit.
➢ Analyses for total phenolic compounds and hardness.
➢ Analyses for all of the volatile organic compounds listed in Part D.
➢ Analyses for all of the acid -extractable compounds listed in Part D.
➢ Analyses for all base -neutral compounds listed in Part D.
➢ Analyses for Total Mercury must be performed using EPA Method 1631.
2. Conduct four toxicity tests for an organism other than Ceriodaphnia and submit results with
your renewal application. The tests should be conducted quarterly, with samples collected on the
same day as your current toxicity test. Call the Aquatic Toxicology Unit at (919) 733-2136 for
guidance in conducting the additional tests.

Division personnel have reviewed and approved your application for renewal of the subject permit. Accordingly, we
are forwarding the attached NPDES discharge permit. This permit is issued pursuant to the requirements of North
Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the U.S.
Environmental Protection Agency dated May 9, 1994 (or as subsequently amended).
This final permit includes the following changes' from the draft permit sent to you on April 14, 2004.
➢ All conditions and requirements concerning a flow of 0.84 have been deleted as the Division received your
Engineer's Certification for the recent upgrade to allow for a permitted.flow of 1.2 MGD.
This permit includes a TRC limit that will take effect on January 1, 2006.
If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable to you, you
have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this letter.
This request must be in the form of a written petition, conforming to Chapter 150B of the North Carolina General
Statutes, and filed with the Office of Administrative Hearings (6714 Mail Service Center, Raleigh, North Carolina
27699-6714). Unless such demand is made, this decision shall be final and binding.
Please note that this permit is not transferable except after notice to the Division. The Division may require
modification or revocation and reissuance of the permit. This permit does not affect the legal requirements to obtain
other permits which may be required by the Division of Water Quality or permits required by the Division of Land
Resources, the Coastal Area Management Act or any other Federal or Local governmental permit that maybe

Here is the Pump and Haul application forms to be utilized for
submitting a application.
When submitting the completed pump & haul application, please provide the following
documents: letter(s) from Town of Troy and/or"other wastewater treatment plant that
will accept your wastewater, site schematic of building and tank location, detail of
tank (i.e. traffic rated tank or not, capacity, baffles, access points. The
manufacturers diagrams will suffice) with alarm as addressed by .0204(c)].
Also provide the name or names of pumpers that you will contract with or may
contract with for the pumping and hauling of the wastewater from your winery.
Provide a brief narrative on spill prevention and response (this can be provided by
your pumper if he has a spill prevention plan for managing septage). If a specific
area is designated for the pump truck to park when emptying the tank; include this
location on the site drawing.

As discussed on the phone this morning, the fee listed on the cover page of the pump
& haul application is not required. The Division of Water Quality will issue a Pump
& Haul approval/authorization letter and not a permit. Richmond County may require
you to submit a copy of the DWQ Pump & Haul letter for their files, prior to issuing
a occupancy certification (this has happened in Moore County, not sure about
Richmond)

Grey Walls most likely is referring to Ms. Belinda Henson, regional supervisor for the Surface Water
Protection Section that inspects and oversees the operations of wastewater treatment plants that
discharge to surface waters in the Fayetteville region. I'm not aware of any specific information that
the Surface Water Section will have on wastewater from wineries, although they may have contacts in
other regional offices that deal with wineries. I believe the Winston-Salem office has a large number
of wineries located in the "Yadkin Valley area" and therefore some wastewater treatment plants may
have information similar to what Grey Walls is looking for. If you speak with Grey, you can ask if he
has any contacts with treatment plant operators in some of the following counties they may provided
some information:
Davidson, Yadkin, Surry, Alleghany, Wilkes, Stanley and Cabarus. I got these counties from
reviewing the NC Wineries list and map of wineries located in NC at this website,
http://www.ncwine.org.
Hopefully one of the counties listed will have some experience in dealing with wastewater from
wineries.

issue of land applying the grape skins/hulls, leaves, stem pieces and the sediment that
collects in the vats. According to Mike, composting of the material is the
management technique to be utilized. Concerns arise with respect to the introduction
of spore and other crop diseases from land applying raw materials, especially if those
feed stocks didn't originate from the land on which the,land application activity take

wastewater treatment plant located in Troy, North Carolina. The Town `of Troy has
indicated its willingness to accept and treat the wastewater in accordance with their letter
of intent signed by Mr.. Grey Walls as part of the permit application package received on
26 June 2008 (copy included with this letter).
Based upon the information provided, the requested Pump and Haul activity at Little
River Vineyards is hereby approved.
Once the infrastructure and equipment associated with this pump and haul activity is
constructed and before it is put into operation, the following information shall .be
presented to the Division:
-1. Notification to the Fayetteville Regional Office that the infrastructure and
equipment has been installed in accordance with the, application submitted;
2. Provide the anticipated start date for the pump and haul activities;
3. If not provided in the initial application; a contact name or names of individuals
that will be on -site during the operation of the winery that will oversee the
operations of the facility, especially the transfer of wastewater from the on -site

request, if and when inspection of Little River Vineyards is made by the Division
of Water Quality.
Please be aware that wastewater generated by Little River Vineyards is ultimately Little
River Vineyards responsibility for the proper management of the wastewater .to the
designated receiving sites. Upon completion of these pump and haul activities, Little
River Vineyards shall provide notification to this office that these activities have ceased.
Any environmental impact that can be attributed to this activity may be used as
justification for the Division to request termination of the subject pump and haul

Plans and specifications must be prepared in accordance with 15A NCA .0200, all applicable
general statutes, and good engineering practices. Failure to submit all of the required items will lead to

Dear Permittee:
Your NPDES permit for a municipally owned/operated WWTP expires on June 36, 2009. This notice is
being sent to explain the requirements for your permit renewal application.
You are receiving this advance notice because your facility has .a permitted flow at or above 1
MGD, or the facility receives industrial [pretreatment] wastewater. If either of these criteria no
longer applies, contact the NPDES Unit before submitting a renewal application.
Federal (40 CFR 122) and state (15A NCAC 2H.0105(e)) regulations require that permit renewal
applications be filed at least,180 days prior to expiration of the current permit. Your renewal application is
due to the Division postmarked no later than January 1, 2009. Failure to apply for renewal by the
appropriate deadline may result in a civil penalty assessment or other enforcement activity at the discretion
of the Director.
The U.S. EPA revised and expanded the application requirements for municipal permits, effective August 1,
2001. EPA form 2A is attached to this Notice, and must be used for your permit renewal application. The
new application requirements mandate additional effluent testing:
1. Conduct three Priority Pollutant Analyses (PPAs) and submit results with your renewal
application. Collect samples for the PPAs in conjunction with sampling for your current
quarterly toxicity test. The new PPA requirements differ from previous versions. Each PPA
must include:
➢ Analyses for all total recoverable metals listed in Part D of form 2A. This includes metals
that are not normally monitored through your NPDES permit.
➢ Analyses for total phenolic compounds and hardness.
➢ Analyses for all of the volatile organic compounds listed in Part D. .
➢ Analyses for all of the acid -extractable compounds listed in Part D.
➢ Analyses for all base -neutral compounds listed in Part D.
➢ ' Analyses for Total Mercury must be performed using EPA Method 1631.
2. Conduct four toxicity tests for an organism other than Ceriodaphnia and submit results with
your renewal application. The tests should be conducted quarterly, with samples collected on the
same day as your current toxicity test. Call the Aquatic Toxicology Unit at (919) 733-2136 for
guidance in conducting the additional tests.

Division personnel have reviewed and approved your application for renewal of the subject permit. Accordingly, we
are forwarding the attached NPDES discharge permit. This permit is issued pursuant to the requirements of North
Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the U.S.
Environmental Protection Agency dated May 9, 1994 (or as subsequently amended).
This final permit includes the following changes from the draft permit sent to you on April 14, 2004.
➢ All conditions and requirements concerning a flow of 0.84 have been deleted as the Division received your
Engineer's Certification for the recent upgrade to allow for a permitted flow of 1.2 MGD.
This permit includes a TRC hmit that will take effect on January 1, 2006.
If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable to.you, you
have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of. this letter.
This request must be in the form of a written petition, conforming to Chapter 150B of the North Carolina General
Statutes, and filed with the Office of Administrative Hearings (6714 Mail Service Center, Raleigh, North Carolina
27699-6714). Unless such demand is made, this decision shall be final and binding..
Please note that this permit is not transferable except after notice to the Division. The Division may require
modification or revocation and reissuance of the permit. This permit does not affect the legal requirements to obtain
other permits which may be required by the Division of kVater Quality or permits required by the Division of Land
Resources, the Coastal Area Management Act or any other Federal or Local governmental permit that may.be
