The project is currently forested, vacant, and undeveloped. Interstate 1-85 is located North of the review area and 1-485 is located along the Eastern boundary of the review area. The land
use South and West of the review area is predominantly forested, residential, and industrial properties.

The purpose of the project is for the construction of an industrial development including commercial vehicle parking, employee parking, a roadway connecting the two buildings, stormwater
treatment, and additional infrastructure and necessary utilities.
41. Describe the overall project in detail, including indirect impacts and the type of equipment to be used: *
Building 1 is proposed to be on the West side of Paw Creek and building 2 is proposed on the East side of Paw Creek. A roadway is proposed in the Northen region of the review area as
access to building 2. The road has been designed in the Northern region to avoid the large wetland identified as WL 1000. Heavy equipment will be used for tree clearing, earth moving,
and preparation for of the buildings pads for construction. Two stormwater control measures are proposed one located South of building 1 and the second being located North of building 2.

The project has been designed and engineered to avoid and minimize impacts to the greatest extent possible. The size and positioning of the buildings,
parking, road crossing, and stormwater control measures has taken into consideration the existing aquatic resources. Eetlands WL 1000, WL 4000, and
WL 4100 are being entirely avoided. Additionally, perennial channels CH 300 and CH 400 and intermittent channel CH 200 are being entirely avoided.
1b. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques:
The road crossing at channel CH 100 will be constructed with headwalls at the upper and lower extent of the culvert avoiding and minimizing impacts to
the perennial channel and shortening the crossing to only 48 linear feet. Embedded rip -rap has been proposed to minimize the potential for future
stabilization issues at the crossing.

The applicant, Matt Bramwell of McCraney Property Company is requesting approval of the
enclosed nationwide permit verification for unavoidable impacts to aquatic resources. A
preliminary jurisdictional determination was issued for the Paw Creek site on November 16,
2021 and an approved jurisdictional determination was requested for the S. 1-85 Service Road
site on March 10, 2023. At the time of this permit verification request no Action ID number had
been assigned for the S. 1-85 Service Road site. This Paw Creek NWP 14/18 permit request
includes both of the above referenced sites. The review area is generally located West of
Seddon Rusty Goode FWY 1-485 and Southeast of S 1-85 Service Road.
In total, there are three permanent stream impacts and two permanent wetland impacts. Impact
S1 is to channel CH 100 and approximately 48 linear and 0.024 acre for a road crossing
between the two proposed buildings. Impacts S2 (30 LF) and S3 (40 LF) are embedded rip rap
at the upstream and downstream ends of the box culverts. All stream impacts are proposed to
be permitted under NWP 14. Impact W1 (WL 1200: 0.0003 acre, 0.24 Cu/Yds) is permanent fill
associated with the side slopes of the proposed road crossing. Impact W2 (WL 1100: 0.011
acre, 4.55 Cy/Yds) is also permanent fill associated with the side slopes of the proposed road
crossing. Both proposed wetland impacts are located within the FEMA floodplain and are
proposed to be permitted under NWP 18. Atlas is proposing 2:1 mitigation for stream impact S1
by purchasing credits through a private mitigation bank. A Statement Of Availability is included
from Wildlands Holdings IV LLC for 96 credits.
The project has been designed and engineered to avoid and minimize impacts to the greatest
extent possible. The majority of the project is occurring outside of the FEMA floodplain and
wetlands WL 1000, WL 4000, and WL 4100 are being entirely avoided. Additionally, perennial
channels CH 300 and CH 400 and intermittent channel CH 200 are being entirely avoided. The
only proposed impacts to streams is channel CH 100 for the necessary road crossing.
Headwalls are being constructed at the upstream and downstream extents of the proposed
culvert to avoid and minimize impacts. Only 48 linear feet of the 2626 linear feet of channel
within the review area is proposed to be impacted, which equates to less than 2 percent.

Wildlands Holdings VI, LLC, owned and operated by Wildlands Engineering, Inc., currently has sufficient stream
credits from the Wildlands Catawba 01 Umbrella Mitigation Bank: Firestone Mitigation Site and Double Rock
Mitigation Site to satisfy the stream mitigation requirements related to the above -mentioned project. The
project is located within the Catawba River Basin of the service area (HUC 03050101) of the Bank.
This letter is simply a statement of availability of credits as of the date written. It is neither a guarantee of
future credit availability, nor a guarantee of credit pricing. Credits are sold on a first come, first serve basis at
the Bank's price at the time an invoice is requested. Invoices reserve both the credits and the price for a period
of 30 days. Credits and associated pricing may be reserved for up to 6 months with a signed reservation
agreement and a 10% deposit.
Final transfer of the credits will be made upon receipt of a copy of the US Army Corps of Engineers
Compensatory Mitigation Responsibility Transfer Form approving the Stream and/or wetland mitigation
purchase from the Bank and upon receipt of your payment to Wildlands Holdings VI, LLC.

appealable action under the Regulatory Program Administrative Appeal Process (Reference 33 CFR Part 331). However, you may
request an approved JD, which is an appealable action, by contacting the Corps district for further instruction.

1. The Corps of Engineers believes that there may be jurisdictional aquatic resources in the
review area, and the requestor of this PJD is hereby advised of his or her option to request
and obtain an approved JD (AJD) for that review area based on an informed decision after
having discussed the various types of JDs and their characteristics and circumstances when
they may be appropriate.
2. In any circumstance where a permit applicant obtains an individual permit, or a Nationwide
General Permit (NWP) or other general permit verification requiring "pre- construction
notification" (PCN), or requests verification for a non -reporting NWP or other general
permit, and the permit applicant has not requested an AJD for the activity, the permit
applicant is hereby made aware that: (1) the permit applicant has elected to seek a permit
authorization based on a PJD, which does not make an official determination of
jurisdictional aquatic resources; (2) the applicant has the option to request an AJD before
accepting the terms and conditions of the permit authorization, and that basing a permit
authorization on an AJD could possibly result in less compensatory mitigation being
required or different special conditions; (3) the applicant has the right to request an
individual permit rather than accepting the terms and conditions of the NWP or other
general permit authorization; (4) the applicant can accept a permit authorization and
thereby agree to comply with all the terms and conditions of that permit, including
whatever mitigation requirements the Corps has determined to be necessary; (5)
undertaking any activity in reliance upon the subject permit authorization without
requesting an AID constitutes the applicant's acceptance of the use of the PJD; (6)
accepting a permit authorization (e.g., signing a proffered individual permit) or undertaking
any activity in reliance on any form of Corps permit authorization based on a PJD
constitutes agreement that all aquatic resources in the review area affected in any way by
that activity will be treated as jurisdictional, and waives any challenge to such jurisdiction
in any administrative or judicial compliance or enforcement action, or in any administrative
appeal or in any Federal court; and (7) whether the applicant elects to use either an AID or
a PJD, the JD will be processed as soon as practicable. Further, an AJD, a proffered
individual permit (and all terms and conditions contained therein), or individual permit
denial can be administratively appealed pursuant to 33 C.F.R. Part 331. If, during an
administrative appeal, it becomes appropriate to make an official determination whether
geographic jurisdiction exists over aquatic resources in the review area, or to provide an
official delineation of jurisdictional aquatic resources in the review area, the Corps will
provide an AJD to accomplish that result, as soon as is practicable. This PJD finds that
there "may be" waters of the U.S. and/or that there "may be" navigable waters of the U.S.
on the subject review area, and identifies all aquatic features in the review area that could
be affected by the proposed activity, based on the following information:

Dear Austin Baggarley:
The U.S. Fish and Wildlife Service (Service) has reviewed the information provided in your
email correspondence dated November 1, 2021 wherein you solicit our comments regarding
project -mediated impacts to federally protected species. We submit the following comments in
accordance with the provisions of the Fish and Wildlife Coordination Act, as amended
(16 U.S.C. 661-667e); the National Environmental Policy Act (42 U.S.C. §4321 et seq.); and
section 7 of the Endangered Species Act of 1973, as amended (16 U.S.C. 1531-1543) (Act).
Project Description
Based on the information provided, the proposed project would entail the construction of an
industrial development on approximately 46 forested acres in Charlotte, North Carolina which
would require authorization from the Army Corps of Engineers for unavoidable impacts to
jurisdictional Waters of the United States. A preliminary design plan has not been prepared
and/or submitted at this time.
Federally Listed Endangered and Threatened Species
According to Service records, suitable summer roosting habitat may be present in the action area
(50CFR 402.02) for the federally threatened northern long-eared bat (Myotis septentrionalis).
However, the final 4(d) rule, (effective as of February 16, 2016) exempts incidental take of
northern long-eared bat associated with activities that occur greater than 0.25 miles from a
known hibernation site, and greater than 150 feet from a known, occupied maternity roost during
the pup season (June 1 — July 31). Based on the information provided, the project would occur at
a location where any incidental take that may result from associated activities is exempt under
the 4(d) rule for this species. Although not required, we encourage the Applicant to avoid any
associated tree clearing activities during this animal's maternity roosting season from May 15 —
August 15.
The information provided suggests that suitable habitat is present within the action area for the
federally endangered Schweinitz's sunflower (Helianthus schweinitzii) and Michaux's sumac
(Rhus michauxii). However, targeted surveys conducted during the appropriate timeframe
(September 3, 2021) did not detect evidence for these species at that time. Therefore, we would
concur with a "may affect, not likely to adversely affect" determination from the appropriate
action agency for these species. The survey results provided are valid for two years for the
purposes of consultation under the Act:

In accordance with the Act, it is the responsibility of the appropriate federal action agency or its
designated representative to review its activities or programs and to identify any such activities
or programs that may affect endangered or threatened species or their habitats. If it is
determined that the proposed activity may adversely affect any species federally listed as
endangered or threatened, formal consultation with this office must be initiated.

1 Introduction
Matt Bramwell of McCraney Property Company has requested Atlas Environmental, Inc.
to perform a site assessment for Federally listed Endangered, Threatened, and
Candidate species that could potentially occur on the subject property and recommend a
determination of effects.
.1 Site Location and Description
The subject site is located at 6611 S 1-85 Service Road, Charlotte, North Carolina 28214,
and is comprised of one Mecklenburg County parcel (Parcel ID 05553102), totaling
approximately 3.4 acres. The project site is within the Mountain Island Lake and
Charlotte West 1-24,000 Quadrangles. The project site lies on the South side of 1-85 just
West of the interchange with 1-485, approximately 10.3 driving miles West of the City of
Charlotte, North Carolina.
The ground surface slopes toward the Southeast toward Paw Creek. The topographic
relief of the project site is approximately 56 feet with an approximate maximum elevation
of 648 feet and minimum elevation of 592 feet. The land use of the review area is a
forested area. The surrounding area consists of Interstate Highway and commercial
development with a residential development to the South.
1.2 Project Purpose
The proposed project purpose is for the construction of an industrial development. The
development will require the construction of stormwater treatment, roadways, utilities,
and additional associated infrastructure. The project site also will require mechanized
land clearing for grading to remove existing vegetation and to prepare the ground surface
for construction. No aquatic resources were found on the property. A preliminary site
plan has not been provided.
1.3 Endangered Species Act
The Endangered Species Act of 1973, as amended (ESA), provides a program for the
conservation of Endangered and Threatened plants and animals and the habitats in
which they are found. The lead Federal agencies for implementing the ESA are the U.S.
Fish and Wildlife Service (USFWS) and the National Marine Fisheries Service (NMFS).
Before a species can receive the protection provided by the ESA, it must first be added
to the Federal lists of Endangered and Threatened wildlife and plants. A species is
added to this list when the respective Federal agency determines that it has met a
definition of Endangered or Threatened under the ESA. Species may also be removed
from the list (i.e., "delisted") when they no longer require ESA protection, or have a
change in status (i.e., "reclassified"), for example from Endangered or Threatened.
Under the ESA, a species must be listed if it is endangered or threatened because of
any of the following 5 factors:
1. present or threatened destruction, modification, or curtailment of its habitat or range;
2. over -utilization of the species for commercial, recreational, scientific, or educational
purposes;
3. disease or predation;
4. inadequacy of existing regulatory mechanisms; and,
5. other natural or manmade factors affecting its continued existence.

Additionally, the USFWS and NMFS periodically publish a Notice of Review or Notice of
Reclassification in the Federal Register that presents an updated list of plant and animal
taxa which are regarded as Candidate or species proposed for possible addition to the
Lists of Endangered and Threatened Wildlife and Plants.
An Endangered species is a taxon "in danger of extinction throughout all or a significant
portion of its range" (ESA, Section 3). A Threatened species is a taxon "likely to become
an Endangered species within the foreseeable future throughout all or a significant
portion of its range" (ESA, Section 3). Candidate species are "taxa for which the Service
has on file enough substantial information on biological vulnerability and threat(s) to
support proposals to list them as Endangered or Threatened. Proposed rules have not
yet been issued because this action is precluded at present by other listing activity.
Development and publication of proposed rules on these taxa are anticipated. The
Service encourages State and other Federal agencies as well as other affected parties
to give consideration to these taxa in environmental planning." (Federal Register,
February 28, 1996). Taxa formerly considered as `Category 1' are now considered as
`Candidate'. A Federal Species of Concern (FSC) is a species under consideration for
listing, for which there is insufficient information to support listing at that time. FSCs may
or may not be listed in the future, and many of these species were formerly recognized
as "C2" Candidate species.
2 Methods
2.1 Action Area
A site assessment for Federally listed Endangered, Threatened, and Candidate Species
includes a thorough search of historical and recent records for potential and known
occurrences of species on and in the vicinity of the proposed project site. Initially, we
define the Action Area as a one -mile zone around the property boundaries. The Action
Area may include species that occur nearby, but not necessarily on, the proposed project
site. The Action Area is defined this way because species may be affected (positively or
negatively) by the project that exist in a nearby geographic area. For example, certain
aquatic species may appear on the species list because a project could cause
downstream effects, such as sedimentation, on the species. The Action Area also may
vary depending on the activities associated with the proposed project (e.g., construction,
operational, or maintenance activities) and its potential direct and indirect effect on the
species identified in the vicinity. For example, operational impacts associated with
lighting or noise could affect species that occur away from the project site. In most
cases, the Action Area contracts to an area no less than the proposed project boundary
but remains species dependent. If applicable, the species dependent Action Area is
further defined in the individual species account below.
2.2 Information, Planning and Conservation System
A record search of the USFWS website is conducted to determine what species are
known or believed to occur within the County of the proposed project. The USFWS's
Information, Planning, and Conservation System (IPaC) mapping tool also is used to
generate a list of Endangered, Threatened, and Candidate species, and/or designated
Critical Habitat. Species on the IPaC list include species that may be affected by your
project and could include species that exist in another geographic area.

2.3 North Carolina Natural Heritage Program
The North Carolina Department of Environment and Natural Resources (NCDENR),
North Carolina Natural Heritage Program (NCNHP) GIS database is searched to
determine what species or rare natural communities (element occurrences) are known to
occur within a one -mile radius of the approximate center of the project site. A list of the
Endangered, Threatened, and rare species and communities known to occur within the
quadrangle(s) of the proposed project site is generated for the field search. This list
indicates what species have been reported as occurring in the state, each county, and
within each quadrangle. This is not a complete listing of what exists as no
comprehensive survey of the state has ever been conducted. The list also provides the
last date of observation and accuracy of the observation. Natural and Managed areas,
such as parks, open space, and greenways, known to occur within a one -mile radius of
the approximate center of the project site also are documented.
2.4 Field Assessment
A site assessment also includes a pedestrian survey of the proposed project site by
botanists and biologists with specialized experience in the identification of Endangered,
Threatened, and Candidate species. Atlas Environmental staff identify potentially
suitable habitat for Federally listed species within the project review area based on the
species' known and preferred habitat requirements reported in the IPaC and NCNHP
reviews. The project review area is then traversed to evaluate all potentially suitable
habitat areas for the presence of Federally listed Endangered, Threatened, and
Candidate species.
3 Results
3.1 Information, Planning and Conservation System
A search of the USFWS's IPaC website (www.ecos.fws.gov/ipac) identified Federally
listed Endangered, Threatened, and Candidate species that could occur within the
proposed project review area or be impacted downstream (Appendix A). These species
include: 1) Tricolored Bat (Perimyotis subf/avus), a Proposed Endangered mammal; 2)
Monarch Butterfly (Danaus plexippus), a Candidate butterfly; 3) Michaux's Sumac (Rhus
michauxii), an Endangered flowering plant; 4) Schweinitz's Sunflower (Helianthus
schweinitzii), an Endangered flowering plant; and 5) Smooth Coneflower (Echinacea
laevigata), a Threatened flowering plant. No Critical Habitat has been designated for any
species within the Action Area.
3.2 North Carolina Natural Heritage Program
A search of the NCNHP website (www.ncnhp.org/web/nhp/database-search) identified
one historic element occurrence of Federally listed Endangered or Threatened species
within a one -mile radius of the project site (Carolina Heelsplitter (Lasmigona decorata),
EO ID 450, last observed 1918-Pre; Appendix B). One historic element occurrence of
rare species and species or habitats of conservation concern was documented within a
one -mile radius of the project site (Tall Larkspur (Delphinium exaltatum), EO ID 13743,
last observed 1800s). No Natural areas were documented to exist within a one -mile
radius of the project site. Eight Managed areas were documented to exist within a one -
mile radius of the project site, including City of Charlotte Open Space (x4), Mecklenburg
County Open Space, Mecklenburg County Open Space — Paw Creek Greenway,
Mecklenburg County Open Space — Robert L. Smith Park, and Mecklenburg County
Open Space — West Mecklenburg Park.

3.3 Field Assessment
The field assessment of the project review area was completed on February 15 and 21,
2023. The species identified through the IPaC and NCNHP review have the potential to
exist within the project review area or be potentially impacted by the proposed project.
Each of these species are described below, including the typical features, suitable habitat
requirements, and other related observations by Atlas Environmental staff.
3.3.1 Tricolored Bat (Perimyotis subf/avus)
The Tricolored Bat is a species of microbat native to Eastern North America. It was
formerly known as the Eastern Pipistrelle, based on the incorrect belief that it was closely
related to European Pipistrellus species. Its common name derives from the coloration of
the hairs on its back, which have three distinct color bands: dark gray at the base, buffy
(yellowish brown) in the middle, and brown or reddish brown at the tip. It is the smallest
bat species in the Eastern and Midwestern US, with individuals weighing 0.16-0.28 oz.
The Tricolored Bat is a seasonal breeder, with copulation (mating) occurring in the fall
before hibernation. Ovulation does not occur until the spring, however, and females store
the males' sperm in their uteruses through the winter. Gestation length is about forty-four
days, with females giving birth in June or July. The litter size is typically two individuals.
As newborns, the combined mass of twin pups can be as great as 58% of the mother's
postpartum mass. At birth, the young lack fur and their eyes are closed. The mother
leaves the offspring behind at the roost while she forages at night. Offspring develop
rapidly, beginning to fly at three weeks old. By four weeks old, they are foraging for
themselves. Young do not reach sexual maturity in their first fall; they do not breed until
their second fall. Individuals can live 15 years in the wild; juveniles have higher mortality
rates than adults, and females have higher mortality rates than males.
During the summer, the Tricolored Bat will roost in tree foliage or buildings, with females
alone or in maternity colonies of up to thirty individuals. Trees used for this purpose
include oak, maple, the eastern cottonwood, and American tulip tree. Males are solitary
and do not form colonies. In the winter, the Tricolored Bat hibernates in mines, caves, or
other human structures. A study of a mine in Nebraska found that in the summer, the
mine was mostly occupied by males, ranging from zero to forty-three individuals. Bats
were in a state of torpor from November to April. More bats used the mine as a roost in
the winter than in the summer. In another abandoned mine in Indiana, researchers found
that the Tricolored Bat roosts solitarily during hibernation most of the time.
The Tricolored Bat is insectivorous, consuming small prey such as mosquitoes, beetles,
ants, moths, and cicadas. It forages with slow, erratic flight in areas near water or forest
edges. It is one of the first bat species to begin foraging each night. It navigates and
searches for prey via echolocation. The Tricolored Bat's natural predators include the
northern leopard frog, birds of prey, raccoons, snakes, skunks, and prairie voles. Feral
cats will also catch and kill them as they leave their hibernacula. There also are records
of it being attacked by the Hoary Bat.
The Tricolored Bat is common throughout eastern North America, with the southern
extent of its range in Central America and the northern extent in southern Canada. Its
range has expanded since the 1980s, with westward expansion reaching Colorado, New

Mexico, South Dakota, and Wyoming. Additionally, its range started to include the Great
Lakes Basin.
The Tricolored Bat has experienced severe population decline because of the fungal
disease White -nose syndrome, which arrived in the US in 2006, with losses of 70% and
greater detected in multiple US states. The disease kills bats by colonizing their skin
during the winter, causing them to arouse from torpor and burn through their limited fat
reserves. Though its population experienced dramatic reduction, subsequent studies
have found that their numbers may be stabilizing.
The Tricolored Bat was proposed for listing as Endangered under the ESA on September
13, 2022. Proposed Endangered (PE) species are not protected by the take prohibitions
of Section 9 (Prohibited Acts) of the ESA until the rule to list is finalized. Under Section
7(a)(4) of the ESA, federal agencies must confer with the Service if their action will
jeopardize the continued existence of a proposed species.
3.3.1 Monarch Butterfly (Danaus plexippus)
Adult monarch butterflies are large and conspicuous, with bright orange wings with a
black border and covered with black veins. The black border has a double row of white
spots, present on the upper side of the wings. Adult monarchs are sexually dimorphic,
with males having narrower wing venation and scent patches. The bright coloring of a
monarch serves as a warning to predators that eating them can be toxic.
During the breeding season, monarchs lay their eggs on their obligate milkweed host
plant (primarily Asclepias spp.), and larvae emerge after 2 to 5 days. Larvae develop
through five larval instars (intervals between molts) over a period of 9 to 18 days, feeding
on milkweed and sequestering toxic chemicals as a defense against predators. The larva
then pupates into a chrysalis before emerging 6 to 14 days later as an adult butterfly.
There are multiple generations of monarchs produced during the breeding season, with
most adult butterflies living 2 to 5 weeks; overwintering adults enter reproductive
diapause (suspended reproduction) and live 6 to 9 months.
In many regions where monarchs are present, monarchs breed year-round. Individual
monarchs in temperate climates, such as eastern and western North America, undergo
long-distance migration, and live for an extended period. In the fall, in both eastern and
western North America, monarchs begin migrating to their respective overwintering sites.
This migration can take monarchs distances of over 2000 miles and last for over two
months. In early spring (February -March), surviving monarchs break diapause and mate
at the overwintering sites before dispersing. The same individuals that undertook the
initial southward migration begin flying back through the breeding grounds and their
offspring start the cycle of generational migration over again.
The monarch butterfly is a Candidate species and not yet listed or proposed for listing.
There generally are no ESA protections or Section 7 (Interagency Cooperation)
requirements for Candidate species, but the USFWS encourages any opportunity to
conserve the species.
3.3.2 Michaux's Sumac (Rhus michauxii)
Michaux's Sumac is a rhizomatous, densely hairy shrub, with erect stems from 1 to 3 feet

in height. The compound leaves contain evenly serrated, oblong to lanceolate,
acuminate leaflets. Most plants are unisexual; however, more recent observations have
revealed plants with both male and female flowers on one plant. The flowers are small,
borne in a terminal, erect, dense cluster, and colored greenish yellow to white. Flowering
usually occurs from June to July; while the fruit, a red drupe, is produced through the
months of August to October. Michaux's Sumac grows in sandy or rocky open woods in
association with basic soils. The habitat area is moister than surrounding habitat types.
The plant survives best in areas where some form of disturbance has provided an open
area so it can receive sunlight.
Michaux's Sumac is threatened by the loss and degradation of its habitat and by barriers
to reproduction. Much of its habitat has been cleared for residential, industrial, and
agricultural operations, including silviculture, and the construction of roads. As the plant
requires open habitat, it may arise in artificially cleared areas such as roadsides. There it
is vulnerable to destruction from construction, maintenance, and herbicides.
This plant also has difficulty reproducing. It is clonal, often reproducing vegetatively, so
populations are low in genetic variability. One major reproductive problem is that many
populations are composed entirely of one sex. Furthermore, the populations are small
and very widely spaced, making reproduction impossible.
Michaux's Sumac was listed as endangered wherever found on September 28, 1989. No
Critical Habitat has been designated for the Michaux's Sumac.
3.3.3 Schweinitz's Sunflower (Helianthus schweinitzii)
Schweinitz's Sunflower is a perennial wildflower endemic to the Piedmont physiographic
province of North Carolina and South Carolina. It is a member of the sunflower family
(Asteraceae) and is one of the rarest species of sunflower in the United States.
Schweinitz's Sunflower grow 6 to 7 feet in height (though it can be shorter is young or
injured) and can occasionally reach heights of 16 feet. It has thickened roots that are
used by the plant to store starch. The stem is purplish in color and usually solitary,
branching only at or above mid -stem at 45-degree angles. The leaves are arranged in
pairs on the lower parts of the stem but usually occur singly (or alternate) on the upper
parts. Leaves are attached to the stem at right angles and the tips of the leaves tend to
droop. The leaves are thick and stiff, with a rough upper surface. The upper leaf
surfaces have broad spiny hairs that are directed toward the tip of soft white hairs cover
the underside. The species flowers from late August until frost.
Schweinitz's Sunflower generally is found growing in Xeric Hardpan Forests openings
and along roadside rights -of -way, maintained power lines and other utility rights -of -way,
edges of thickets and old pastures, clearings and edges of upland oak -pine -hickory
woods and Piedmont longleaf pine forests, and other sunny or semi -sunny habitats
where disturbances (e.g., mowing, clearing, grazing, blow downs, storms, frequent fire)
help create open or partially open areas for sunlight. Schweinitz's Sunflower occurs in
full to partial sun and is intolerant of full shade and excessive competition from other
vegetation. Schweinitz's sunflower occurs in a variety of soil series, including Badin,
Cecil, Cid, Enon, Gaston, Georgeville, Iredell, Mecklenburg, Misenheimer, Secrest,
Tatum, Uwharrie, and Zion. It is found growing on shallow sandy soils with high gravel
content; shallow, poor, clayey hardpans; or shallow rocky soils, especially those derived

from mafic rocks.
Schweinitz's Sunflower was Federally listed as Endangered on May 7, 1991. The
USFWS recently completed a 5-Year Review of the species (dated December 2019) and
found that no changed in the listing status of the species was warranted. No Critical
Habitat has been designated for Schweinitz's Sunflower. The optimal surveying window
is during flowering from late August through October.
3.3.4 Smooth Coneflower (Echinacea laevigata)
Smooth Coneflower is one of nine species of Echinacea native to North America. It is an
herbaceous perennial of the Aster family. It is closely related to the more common purple
coneflower (E. purpurea). Smooth Coneflower leaves emerge from a fleshy rhizome and
fibrous roots. The leaves are 4 to 6 inches long and 1 to 3 inches wide, with 3 to 5
prominent veins. The leaf surface is smooth to slightly rough above and
smooth beneath. A smooth stem to 4.5 feet tall with a few alternate leaves supports a
solitary flower head. The flower heads contain 13 to 21 pale pink or lavender drooping
ray flowers surrounding tubular disk flowers that form a hemisphere or cone. The
ray flowers emerge rolled, appearing stringlike, and open gradually.
Smooth Coneflower grows in open sunny areas in which it receives little competition from
other plants. It requires neutral to alkaline soils rich in calcium and magnesium with good
drainage. Before the arrival of Europeans, it thrived in oak savanna openings where its
growth conditions were maintained by fire or grazing. Today, Smooth Coneflower is
typically found in open woods, glades, cedar barrens, roadsides, clear cuts, dry limestone
bluffs. The plant's most available habitat is often along utility line rights -of -way and
roadsides where it is subject to frequent mowing or disturbance. The plant flowers from
May through July and sets seed from July through October. The fruiting structures often
persist through the fall. Although the flowers attract bees and butterflies, specific
pollinators and seed dispersers have not been identified. One rhizome can produce
multiple rosettes, which can divide and become viable plants.
Populations of Smooth Coneflower are small and at risk of destruction. Smooth
Coneflower readily hybridizes with other Echinacea species, such as E. purpurea, which
also risks decreasing genetic diversity. Most populations have been affected by habitat
loss due to agriculture or development. Mowing of rights -of -way and the use of
herbicides in these areas threaten populations unless they are protected and managed
for the species. Fire suppression also has allowed encroachment of competing plants,
which the Smooth Coneflower cannot tolerate. Smooth Coneflower occurs only in
Virginia, North Carolina, South Carolina, and Georgia. It may once have occurred in
Pennsylvania but, if so, has been extirpated there.
Smooth Coneflower was Federally listed as Endangered wherever found on November 9,
1992. The USFWS recently completed a 5-year status review of Smooth Coneflower,
initiated on March 12, 2018. On June 24, 2021, as part of the 5-year review, the USFWS
proposed to reclassify Smooth Coneflower as a Threatened species and establish a rule
under section 4(d) of the Act for the protection of Smooth Coneflower. A final
determination on the listing status or 4(d) rule has not been made. No Critical Habitat
has been designated for Smooth Coneflower. The optimal surveying window is during
flowering from late May through October.

4 Findings and Determinations
The following findings and determinations are based on the review of available resources
including, IPaC and NCNHP websites, applicable regulatory guidelines, and the field
assessment performed by Atlas Environmental.
4.1 Tricolored Bat
According to the USFWS IPaC and NCNHP websites, the Tricolored Bat is known, or
believed, to occur in the proposed project County. Because the Tricolored Bat is a
Proposed Endangered species, the species is not protected by the take prohibitions of
Section 9 (Prohibited Acts) of the ESA until the rule to list is finalized. Under Section
7(a)(4) of the ESA, federal agencies must confer with the USFWS if their action will
jeopardize the continued existence of a proposed species.
4.2 Monarch Butterfly

were observed within the Action Area. Because the Monarch butterfly is a Candidate
species and not yet listed or proposed for listing, there generally are no ESA protections

4.3 Michaux's Sumac
According to the USFWS IPaC and NCNHP websites, Michaux's Sumac is known, or
believed, to occur in the proposed project County, but there are no known occurrences of
the species within the project area. Atlas Environmental staff thoroughly traversed all
areas within the project site. The Action Area is a forested lot. No suitable habitat nor
individual occurrences of Michaux's Sumac were observed to exist within the Action Area.
As a result, we have proposed a ""No Effect" determination for Michaux's Sumac.
4.4 Schweinitz's Sunflower
According to the USFWS IPaC and NCNHP websites, Schweinitz's Sunflower is known, or
believed, to occur in the proposed project County, but there are no known occurrences of
the species within the project area. Atlas Environmental staff thoroughly traversed all
areas within the project site. The Action Area is a forested lot. No suitable habitat nor
individual occurrences of Schweinitz's Sunflower were observed to exist within the Action
Area. As a result, we have proposed a ""No Effect" determination for Schweinitz's
Sunflower.
4.5 Smooth Coneflower
According to the USFWS IPaC and NCNHP websites, Smooth Coneflower is known, or
believed, to occur in the proposed project County, but there are no known occurrences of
the species within the project area. Atlas Environmental staff thoroughly traversed all
areas within the project site. The Action Area is a forested lot. No suitable habitat nor
individual occurrences of Smooth Coneflower were observed to exist within the Action
Area. As a result, we have proposed a ""No Effect" determination for Smooth Coneflower.

5 Conclusions
5.1 Summary
Atlas Environmental has completed the Endangered and Threatened species
assessment for the subject project. No Federally listed Endangered or Threatened
species or their habitats were observed within the Action Area. No Federally listed
species is expected to be adversely affected, or Critical Habitat adversely modified, by
the proposed project. No other Federally listed Endangered or Threatened species or
their habitats were observed within the project review area.
5.2 Permitting
If impacts to regulated waters or wetlands are required to develop the property, Condition
18 of Nationwide Permit (NWP) 39 is applicable as follows:
1. Endangered Species. (a) No activity is authorized under any NWP which
is likely to directly or indirectly jeopardize the continued existence of a Threatened or
Endangered species or a species proposed for such designation, as identified under the
ESA, or which will directly or indirectly destroy or adversely modify the critical habitat of
such species. No activity is authorized under any NWP which "may affect" a listed
species or critical habitat, unless ESA Section 7 consultation addressing the effects of
the proposed activity has been completed. Direct effects are the immediate effects on
listed species and critical habitat caused by the NWP activity. Indirect effects are those
effects on listed species and critical habitat that are caused by the NWP activity and are
later in time, but still are reasonably certain to occur.
(b) Federal agencies should follow their own procedures for complying with
the requirements of the ESA. If pre -construction notification is required for the
proposed activity, the Federal permittee must provide the district engineer with the
appropriate documentation to demonstrate compliance with those requirements. The
district engineer will verify that the appropriate documentation has been submitted. If
the appropriate documentation has not been submitted, additional ESA Section 7
consultation may be necessary for the activity and the respective Federal agency would
be responsible for fulfilling its obligation under Section 7 of the ESA.
(c) Non -Federal permittees must submit a pre -construction notification to the
district engineer if any listed species or designated critical habitat might be affected or is
in the vicinity of the activity, or if the activity is located in designated critical habitat, and
shall not begin work on the activity until notified by the district engineer that the
requirements of the ESA have been satisfied and that the activity is authorized. For

activities that might affect Federally listed Endangered or Threatened species or
designated critical habitat, the pre- construction notification must include the name(s) of
the Endangered or Threatened species that might be affected by the proposed activity
or that utilize the designated critical habitat that might be affected by the proposed
activity. The district engineer will determine whether the proposed activity "may affect"
or will have "no effect" to listed species and designated critical habitat and will notify the
non -Federal applicant of the Corps' determination within 45 days of receipt of a
complete pre -construction notification. In cases where the non -Federal applicant has
identified listed species or critical habitat that might be affected or is in the vicinity of the
activity, and has so notified the Corps, the applicant shall not begin work until the Corps
has provided notification that the proposed activity will have "no effect" on listed species
or critical habitat, or until ESA Section 7 consultation has been completed. If the non -
Federal applicant has not heard back from the Corps within 45 days, the applicant must
still wait for notification from the Corps.
(d) As a result of formal or informal consultation with the FWS or NMFS
the district engineer may add species -specific permit conditions to the NWPs.
(e) Authorization of an activity by an NWP does not authorize the "take" of a
Threatened or Endangered species as defined under the ESA. In the absence of
separate authorization (e.g., an ESA Section 10 Permit, a Biological Opinion with
"incidental take" provisions, etc.) from the FWS or the NMFS, the ESA prohibits any
person subject to the jurisdiction of the United States to take a listed species, where
"take" means to harass, harm, pursue, hunt, shoot, wound, kill, trap, capture, or collect,
or to attempt to engage in any such conduct. The word "harm" in the definition of "take"
means an act which actually kills or injures wildlife. Such an act may include significant
habitat modification or degradation where it actually kills or injures wildlife by
significantly impairing essential behavioral patterns, including breeding, feeding or
sheltering.
(f) If the non -Federal perm ittee has a valid ESA Section 10(a)(1)(B) incidental
take permit with an approved Habitat Conservation Plan for a project or a group of
projects that includes the proposed NWP activity, the non -Federal applicant should
provide a copy of that ESA Section 10(a)(1)(B) permit with the PCN required by
paragraph (c) of this general condition. The district engineer will coordinate with the
agency that issued the ESA Section 10(a)(1)(B) permit to determine whether the
proposed NWP activity and the associated incidental take were considered in the
internal ESA Section 7 consultation conducted for the ESA Section 10(a)(1)(B) permit. If
that coordination results in concurrence from the agency that the proposed NWP activity
and the associated incidental take were considered in the internal ESA Section 7
consultation for the ESA Section 10(a)(1)(B) permit, the district engineer does not need

migratory birds, eagles, and their habitats should follow appropriate regulations and consider

Probability of Presence (.)
Each green bar represents the bird's relative probability of presence in the 10km grid cell(s) your
project overlaps during a particular week of the year. (A year is represented as 12 4-week
months.) A taller bar indicates a higher probability of species presence. The survey effort (see
below) can be used to establish a level of confidence in the presence score. One can have higher
confidence in the presence score if the corresponding survey effort is also high.
How is the probability of presence score calculated? The calculation is done in three steps:
1. The probability of presence for each week is calculated as the number of survey events in
the week where the species was detected divided by the total number of survey events for
that week. For example, if in week 12 there were 20 survey events and the Spotted Towhee
was found in 5 of them, the probability of presence of the Spotted Towhee in week 12 is
0.25.
2. To properly present the pattern of presence across the year, the relative probability of
presence is calculated. This is the probability of presence divided by the maximum
probability of presence across all weeks. For example, imagine the probability of presence
in week 20 for the Spotted Towhee is 0.05, and that the probability of presence at week 12
(0.25) is the maximum of any week of the year. The relative probability of presence on
week 12 is 0.25/0.25 = 1; at week 20 it is 0.05/0.25 = 0.2.
3. The relative probability of presence calculated in the previous step undergoes a statistical
conversion so that all possible values fall between 0 and 10, inclusive. This is the
probability of presence score.

Nationwide Conservation Measures describes measures that can help avoid and minimize
impacts to all birds at any location year round. Implementation of these measures is particularly
important when birds are most likely to occur in the project area. When birds may be breeding in
the area, identifying the locations of any active nests and avoiding their destruction is a very
helpful impact minimization measure. To see when birds are most likely to occur and be breeding
in your project area, view the Probability of Presence Summary. Additional measures or permit

may be advisable depending on the type of activity you are conducting and the type of
infrastructure or bird species present on your project site.
What does IPaC use to generate the list of migratory birds that potentially occur in my
specified location?
The Migratory Bird Resource List is comprised of USFWS Birds of Conservation Concern
(BCC) and other species that may warrant special attention in your project location.
The migratory bird list generated for your project is derived from data provided by the Avian
Knowledge Network (AKN). The AKN data is based on a growing collection of survey, banding.
and citizen science datasets and is queried and filtered to return a list of those birds reported as
occurring in the 10km grid cell(s) which your project intersects, and that have been identified as
warranting special attention because they are a BCC species in that area, an eagle (Ea gle Act
requirements may apply), or a species that has a particular vulnerability to offshore activities or
development.
Again, the Migratory Bird Resource list includes only a subset of birds that may occur in your
project area. It is not representative of all birds that may occur in your project area. To get a list

What does IPaC use to generate the probability of presence graphs for the migratory birds

bird in your results. If a bird on your migratory bird species list has a breeding season associated
with it, if that bird does occur in your project area, there may be nests present at some point
within the time frame specified. if "Breeds elsewhere" is indicated, then the bird likely does not
breed in your project area.
What are the levels of concern for migratory birds?
Migratory birds delivered through IPaC fall into the following distinct categories of concern:
1. 'BCC Rangewide" birds are Birds of Conservation Concern (BCC) that are of concern
throughout their range anywhere within the USA (including Hawaii, the Pacific Islands,
Puerto Rica, and the Virgin Islands);
2. "BCC - BCR" birds are BCCs. that are of concern only in particular Bird Conservation
Regions (BCRs) in the continental USA; and
1 "Non -BCC - Vulnerable" birds are not BCC species in your project area, but appear on
your list either because of the FagleAct requirements (for eagles) or (for non -eagles)
potential susceptibilities in offshore areas from certain types of development or activities
(e.g. offshore energy development or longline fishing).
Although it is important to try to avoid and minimize impacts to all birds, efforts should be made,
in particular, to avoid and minimize impacts to the birds on this list, especially eagles and BCC
species of rangewide concern. For more information on conservation measures you can
implement to help avoid and minimize migratory bird impacts and requirements for eagles,
please see the FAQs for these topics.
Details about birds that are potentially affected by offshore projects
For additional details about the relative occurrence and abundance of both individual bird species
and groups of bird species within your project area off the Atlantic Coast, please visit the
Northeast Ocean Data Portal. The Portal also offers data and information about other taxa besides
birds that may be helpful to you in your project review_ Alternately, you may download the bird
model results files underlying the portal maps through the NOAA NCCOS Integrative Statistical

Bird tracking data can also provide additional details about occurrence and habitat use
throughout the year, including migration. Models relying on survey data may not include this

What if I have eagles on my list?
If your project has the potential to disturb or kill eagles, you may need to obtain a permit to avoid
violating the Eagle Act should such impacts occur.
Proper Interpretation and Use of Your Migratory Bird Report
The migratory bird list generated is not a list of all birds in your project area, only a subset of
birds of priority concern. To learn more about how your list is generated, and see options for

effort is high, then the probability of presence score can be viewed as more dependable. In

2 Introduction
At the request of Matt Bramwell of McCraney Property Company on February 15, 2023,
staff from Atlas Environmental, Inc. (Atlas) performed a pedestrian survey of the S 1-85
Service Road review area to search for cultural resources that may be subject to Section
106 of the National Historic Preservation Act and North Carolina General Statute 121-
12(a). Prior to the fieldwork, publicly available records and aerial imagery was searched
for potentially known resources and to identify areas that may require enhanced
inspection. This report is not to be used to determine eligibility of structures for addition
to the National Register of Historic Places and is not a historic structure survey report.
2.1 Site Location and Description
The subject site is located at 6611 S 1-85 Service Road Charlotte, NC 28214. The review
area is comprised of one Mecklenburg County parcel (PIN Number: 05553102) and is
approximately 3.4 acres. The project location lies on the South side of 1-85 just West of
the interchange with 1-485. The ground surface is generally sloping towards the
Southwestern boundary. The topographic relief of the review area was approximately 74
feet with an approximate maximum elevation of 658 feet and minimum elevation of 584
feet. The surrounding land use predominantly consists of commercial, industrial,
institutional, and residential properties. Land use immediately South of the review area
consists of predominantly forested land and a single-family residential property. Land
use immediately North of the review area includes the 1-85 exit ramp leading to 1-485.
The review area is predominantly forested with evidence of two previously existing
access roads. At the time of the site visit, no structures and no evidence of previously
existing structures were observed within the review area.
2.2 Project Purpose
The project purpose is for the construction of an industrial development. The project will
require mechanized land clearing for grading, utility installation, and stormwater
treatment. It is likely that a U.S. Army Corp of Engineers Nationwide Permit 39 will be
required for unavoidable impacts to potential waters of the United States. At the time of
this submittal, a preliminary site plan has not been finalized.
2.3 Recent Site Use and History
The current land use of the review area is predominantly forested. The surrounding land
use predominantly consists of commercial, industrial, institutional, and residential
properties. According to Mecklenburg County GIS records there is one postal address
associated with the review area: 6611 S 1-85 Service Road Charlotte, NC 28214. At the

time of the site visit, no structures were observed within the review area. Historical
aerial imagery from 1938 to 2020 indicates that the site has remained forested.
Surrounding land use previously consisted of agricultural development and forested
land; however, industrial, commercial, residential, and institutional development have
continued to grow within the area since the completion of 1-85 in 1958.
3 Methods
3.1 North Carolina Historic Preservation Office Buffer Map
Using the interactive map viewer web application, the project review area was added to
the map using a geographic information system file for visualization of potential cultural
resources. The results were spatially filtered to buffer and view known site within 0.5
miles of the review area boundary. The map and any associated results were
downloaded for further investigation.
3.2 Pedestrian Site Evaluation
The reconnaissance was performed by walking transects across the site, walking the site
boundaries, and when necessary, performing a vehicular reconnaissance of the
immediate vicinity. The entirety of the property was inspected to the greatest extent
possible. It is important to note that heavy vegetation, seasonal variations, and other site
features such as thick ground can obstruct observation of certain features.
4 Results
4.1 North Carolina Historic Preservation Office Buffer Map
The NC HPO Buffer Map indicated no potential cultural resources located within 0.5-mile
buffer from the review area boundary. The buffer map is included in Appendix B.
4.2 Pedestrian Site Evaluation
At the time of the site visit, no structures were observed within the review area.
4.3 Property Research
No additional research was conducted as part of the Section 106 property review.
5 Findings
The NC HPO buffer map did not identify any sites within a 0.5-mile buffer of the review
area; therefore, the proposed development was determined to have no effect on cultural
resources.
6 Conclusions
The proposed development was determined to have no effects on cultural resources.
This concludes our Report of Finding for the North Carolina Historic Preservation Office
Environmental Review Request.
